In rule 93, sub-rule 1, section (B), sr. no. (i) is replaced to specify that a rear view mirror/device for indirect vision, guard rail, direction indicator rub-rail (max 20mm), side foot step, or the load body enclosing system for tippers/dumpers (as per CMV Rule 138-B's second provision) shall not be included in overall height measurements. Furthermore, in Rule 138-B, a new proviso mandates that on and after April 1, 2027, all dumpers and tippers must be fitted with an electrically, electro-mechanical, hydraulic, or mechanically operated system to fully cover and enclose the load body while the vehicle is in motion, along with an audio-visual alert in the driver's cabin if the cover is open or unsecured. L.-33004/99 The Gazette of India CG-DL-E-28032026-271371 EXTRAORDINARY PART II-Section 3—Sub-section (i) PUBLISHED BY AUTHORITY No. 198] NEW DELHI, FRIDAY, MARCH 27, 2026/CHAITRA 6, 1948 MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 20th March, 2026 G.S.R. 214(E). — The following draft of certain rules further to amend the Central Motor Vehicles Rules, 1989, which the Central Government proposes to make in exercise of the powers conferred by section 110 of the Motor Vehicles Act, 1988 (59 of 1988), is hereby published as required by sub-section (1) of section 212 of the said Act, for information of all persons likely to be affected thereby; and notice is hereby given that the said draft rules will be taken into consideration after the expiry of thirty days from the date on which the copies of this notification as published in the Gazette of India, are made available to the public; The objections or suggestions which may be received from any person in respect of the said draft rules before the expiry of the aforesaid period will be considered by the Central Government. Short title and commencement.—(1) These rules may be called the Central Motor Vehicles (.......... Amendment) Rules, 2026. (2) Save as otherwise provided in these rules, they shall come into force on the date of their final publication in the Official Gazette. 2. In the Central Motor Vehicle Rules, 1989 (hereinafter referred to as the said rules), in rule 93, in sub-rule 1, in section (A), below the table in sub-section (VI), after the sixth proviso, the following proviso shall be inserted, namely: "Provided that in case of tippers and dumpers, the system fitted to enclose the load body, as per the provision given in the second provision of CMV Rule 138-B, shall not be taken into consideration in measuring the overall height of motor vehicles." 3. In the said rules, in rule 93, in sub-rule 1, in section (B), for sr. no. (i), the following shall be inserted, namely: "(i) A rear view mirror or device for indirect vision, or guard rail or a direction indicator rub-rail (rubber beading) having maximum thickness of 20 millimeter on each side of the body or side foot step, or the system fitted on tippers and dumpers to enclose the load body as per the provision given in second provision of CMV Rule 138-B, shall not be taken into consideration in measuring the overall height of motor vehicles." 4. In the said rules, in Rule 138-B, after the first proviso following proviso shall be inserted, namely: " Provided also that on and after 1st April 2027, in the case of all dumper and tippers, the load body shall be fitted with an electrically or electro-mechanical or hydraulic or mechanically operated system to cover the load body from top, to fully enclose the load body while the vehicle is plying on the road. The system specified above may use any suitable material for covering the roof of the load body. Additionally, an audio-visual alert system shall be provided in the driver's cabin to warn the driver if the load body cover is open or unsecured during vehicle movement." [F.
