No. PFRDA-16/07/0001/2025-SUP-CG.—In exercise of the powers conferred by sub-section (1) of Section 52 read with clauses (f) and (w) of sub-section (2) thereof, of the Pension Fund Regulatory and Development Authority Act, 2013 (23 of 2013), the Pension Fund Regulatory and Development Authority hereby makes the following regulations to amend the Pension Fund Regulatory and Development Authority (Operationalisation of Unified Pension Scheme under National Pension System) Regulations, 2025, namely, - 1. These regulations may be called the Pension Fund Regulatory and Development Authority (Operationalisation of Unified Pension Scheme under National Pension System) (Amendment) Regulations, 2025. 2. These regulations shall come into force from the date of their publication in the Official Gazette. 3. In the Pension Fund Regulatory and Development Authority (Operationalisation of Unified Pension Scheme under National Pension System) Regulations, 2025, the following amendments are made: I. Clause (i) of sub-regulation(1) of regulation 2 under chapter I shall be substituted as follows – (i) "Legally wedded spouse” means the spouse of a subscriber whose name appears as such in the service records on the date of cessation of employment; II. Clause (k) of sub-regulation(1) of regulation 2 under chapter I shall be substituted as follows – (k) "Qualifying Service” means the period of service in respect of a UPS subscriber, as determined by head of office in accordance with the applicable service rules; III. After clause (1) of sub-regulation (1) of regulation 2 under chapter I, a new clause (la) shall be inserted as follows: (la) "Switch Facility” means one-time option made available to UPS subscriber to move from UPS to NPS, in the manner specified under regulation 3A. IV. After clause (o) of sub-regulation (1) of regulation 2 under chapter I, a new clause (oa) shall be inserted as follows: (oa) “UPS Rules" means Central Civil Services (Implementation of Unified Pension Scheme under National Pension System) Rules, 2025 or such applicable service rules as prescribed by the respective employer for UPS Subscribers. V. Sub-regulation (3) of regulation 3 under chapter II shall be deleted. VI. After regulation 3 under chapter II, following new regulation 3A shall be inserted as follows: 3A. One time Switch Facility – (1) A subscriber who has exercised an option for UPS under NPS shall be permitted to exercise a one-time switch facility to revert to the National Pension System (NPS) at any time during the service of the Subscriber, but not later than: (i) twelve months prior to the date of superannuation (ii) three months prior to the deemed date of voluntary retirement (iii) at the time of resignation or compulsory retirement under 56(j), which is not a penalty as the case maybe Provided that the switch facility will not be applicable in the case of removal or dismissal from service or compulsory retirement from service as a penalty or where departmental or judicial proceedings are pending or contemplated against the subscriber. Provided further that if the subscriber is exonerated from such departmental or judicial proceedings, switch facility maybe exercised by subscriber within three months from the date of exoneration. (2) In case the switch facility is availed by the employee as per sub-regulation (1) above - (i) The employee will be eligible for Central Government contribution @14% as available under the National Pension System. The differential 4% contribution along with returns for the period during which the employee was under Unified Pension Scheme (before the switch facility becomes effective) shall be computed on the (ii) default investment pattern under UPS, as notified by the Authority, and credited to the NPS Tier 1 account of the employee at the time of switch, from the pool corpus. (iii) Future contributions of the Central Government, after the switch facility becomes effective, will be credited to the NPS account of the employee @14% as per provisions of CCS (INPS) Rules, 2021, from the month in which switch has been exercised. (iv) Provisions of PFRDA (Exit & Withdrawal under NPS) Regulations, 2015 shall apply in respect of such employees. Such employees will not be eligible for assured payouts and other benefits provided under the Unified Pension Scheme. VII. Clause (a) of sub-regulation (1) of regulation 4 under chapter III shall be substituted as follows – (a) A Central Government employee in service as on 1st April 2025, who is subscribed to NPS shall submit an application to the concerned Drawing and Disbursing Officer (DDO) in Form A2 of Schedule I to enrol in UPS option under NPS in accordance with these regulations along with option forms to avail benefits on death or invalidation or disability of Subscriber during service, as prescribed; VIII. Clause (b) of sub-regulation (1) of regulation 4 under chapter III shall be substituted as follows – (b) In case of a new recruit to the Central Government services joining on or after 1stApril 2025, the existing process of enrolment under NPS shall continue. In case such new recruit chooses the UPS option under NPS, such person shall submit an application to the concerned DDO in Form Al of Schedule I, to enrol in UPS option under NPS in accordance with these regulations along with option forms to avail benefits on death or invalidation or disability of Subscriber during service, as prescribed; IX. Sub-regulation (3) of regulation 5 under chapter III shall be substituted as follows – (3) In respect of a UPS Subscriber falling under clause (a) of sub-regulation (1) of regulation 4, upon his opting for UPS and after due authorisation by the concerned PAO, the funds from the NPS Tier I account of such subscriber (both the mandatory employee contribution as well as the government contribution along with returns thereon) accrued or credited for the period of qualifying service under Central Government shall be transferred to the PRAN tagged to UPS in such manner and within such timelines as may be determined by the Authority. The balance funds after such transfer shall continue to be part of same PRAN tagged to NPS Tier I under All Citizen Model. X. Proviso(2) and Proviso(3) of regulation 6 under chapter IV shall be deleted. XI. Sub-regulation (2) of regulation 12 under chapter V shall be substituted as follows – (2) The Benchmark Corpus value shall be based on the net asset value (NAV) of the default pattern, and corresponding units in the benchmark corpus. In respect of missing contribution(s), for any period, the net asset value shall be based on last working day of the month in which contribution(s)is to be received, for the period from 01st April 2025; XII. Sub-regulation (3) of regulation 12 under chapter V shall be deleted. XIII. Sub-clause(b) of clause(iii) of sub-regulation (4) of regulation 12 under chapter V shall be substituted as follows – (b) In the event of any missing contribution in any month, value shall be based on the NAV(s) of default pattern as on the last working day of the month applied to monthly contributions of previous full month. XIV. Clause(b) sub-regulation (1) of regulation 13 under chapter VI shall be substituted as follows – (b)In case of Central Government retiring an employee under the provisions of Fundamental Rule 56 or under the special voluntary retirement scheme, as the case maybe, as per UPS Rules. XV. Clause(c) sub-regulation (1) of regulation 13 under chapter VI shall be substituted as follows – (c)In case of voluntary retirement after a minimum qualifying service period of twenty-five years or as prescribed in the UPS Rules, from the date such employee would have superannuated, if the service period had continued to superannuation. XVI. Sub-regulation (2) of regulation 13 under chapter VI shall be substituted as follows- (2) Notwithstanding enrolment of an employee in the UPS option under NPS, such option shall cease to apply in case of a UPS Subscriber who has been removed or dismissed from service or who has resigned his services, in such cases individual corpus shall be paid in lumpsum to such subscriber, unless otherwise prescribed under UPS rules XVII. Following sub regulation (3) shall be inserted after sub-regulation (2) of regulation 13 under chapter VI – (3) In case of compulsory retirement as a penalty or any pending departmental or judicial proceedings as on retirement, the subscriber shall be granted benefits in accordance with UPS Rules. Provided that if such subscriber is exonerated from departmental or judicial proceedings, the subscriber shall be granted benefits in accordance with UPS Rules. XVIII. Explanation after sub-regulation(2) of regulation 13 under chapter VI shall be deleted. XIX. After regulation 13 under chapter VI, following new regulations 13A and 13B, shall be inserted as follows: "13A. Benefits payable in respect of a UPS subscriber, who has died while in service or discharged from service on account of invalidation or disability. (1) A Central Government employee who has opted for UPS, if provided under applicable UPS rules, shall be eligible to either opt for availing benefits under UPS or under the CCS (Pension) Rules, 2021 or the CSS (Extraordinary Pension) Rules, 2023 in the event of death of such employee during service or his or her discharge on the ground of invalidation or disablement, in accordance with the UPS Rules and to the extent provided thereunder. (2) The option exercised may be revised at any number of times by the Central Government employee if so available under the applicable UPS rules before his retirement by making a fresh option intimating his revised option to the Head of Office. (3) A Central Government employee who is discharged on invalidation or disability, if provided under applicable UPS rules, shall be given an opportunity to submit a fresh option at the time of such discharge. Where such Central Government employee does not exercise a fresh option or is not in a position to exercise fresh option at the time of discharge, the option already exercised by the Central Government employee shall become operative. (4) In the case of death of a Central Government employee while in service, if provided under applicable UPS rules the last option exercised by the deceased Central Government employee before his death shall be treated as final and the family shall have no right to revise the option. (5) In all cases where no such option was exercised by a Central Government employee if so available under applicable UPS rules, except: i. where a Central Government employee dies with less than fifteen years of service; ii. where a Central Government employee is discharged from Government service on account of invalidation or disability with less than fifteen years of service, and is also not in a position to exercise such an option at the time of discharge from service; or a Central Government employee has specifically exercised the choice of UPS and not for benefits under CCS (Pension) Rules, 2021 or the CSS (Extraordinary Pension) Rules, 2023, the claim of the Central Government employee on discharge from the service and that of the family on death of the Central Government employee, shall be as follows: (a) In case of death of Central Government employee falling under sub-regulation (5), then Individual Corpus shall be paid in lump sum or in any other manner from among the options made available by the Authority from time to time, to the legally wedded spouse at the time of demise or in case the legally wedded spouse does not exist, to the nominee(s) or the legal heir(s) on the basis of the legal heir certificate issued by the competent authorities of the State concerned or the succession certificate issued by a court of competent jurisdiction, as the case maybe. Provided that if in case the Central Government employee dies after completing 20 years of qualifying service, the legally wedded spouse of such employee shall have option to avail either the above benefits or the following benefits under UPS payable immediately- (i) lump sum payment, as would have been payable to such subscriber if such subscriber would have superannuated from service on the date of demise, calculated as per these regulations (ii) Final Withdrawal upto 60% of Individual UPS Corpus of such subscriber (iii) Family Payout at 60% of admissible payout to such subscriber if such subscriber would have superannuated from service on the date of demise, calculated as per these regulations. (b) In case of discharge of Central Government employee, on the ground of invalidation or disablement, falling under sub- regulation (5), then Individual Corpus shall be paid in lump sum or in any other manner from among the options made available by the Authority from time to time to the subscriber or in case of his demise before receiving such benefits, to the legally wedded spouse at the time of demise or in case the legally wedded spouse does not exist, to the nominee(s) or the legal heir(s) on the basis of the legal heir certificate issued by the competent authorities of the State concerned or the succession certificate issued by a court of competent jurisdiction, as the case maybe. (6) In cases where the option exercised by the deceased Subscriber or the default option for the benefit under the CCS (Pension) Rules, 2021 or the CCS (Extraordinary Pension) Rules, 2023 become infructuous on account of non-availability of an eligible member of the family for grant of family pension under the CCS (Pension Rules), 2021 or the CCS (Extraordinary Pension) Rules, 2023 such option would be deemed to have become invalid and the amount lying in the individual corpus shall be paid in lump sum to the legally wedded spouse at the time of demise or in case the legally wedded spouse does not exist, to the nominee(s) or the legal heir(s) on the basis of the legal heir certificate issued by the competent authorities of the State concerned or the succession certificate issued by a court of competent jurisdiction, as the case maybe. (7) If on death of a Central Government employee during service or his discharge from service on account of invalidation or disablement, benefits are payable under the CCS (Pension Rules), 2021 or the CCS (Extraordinary Pension) Rules, 2023, as per UPS Rules, the Government contribution and returns thereon in the individual corpus shall be transferred to the Government account. The remaining amount in the individual corpus shall be paid in lump sum to the subscriber or the nominee(s) or the legal heir(s) on the basis of the legal heir certificate issued by the competent authorities of the State concerned or the succession certificate issued by a court of competent jurisdiction, as the case maybe. 13B Nomination. – For the purposes of these regulations, the nominations shall be in accordance with regulation 32 of the PFRDA (Exits and Withdrawals under the National Pension System), 2015 and amendments thereof. XX. Sub-regulation (1) of regulation 14 under chapter VI shall be substituted as follows (1) A UPS Subscribers shall be entitled to lumpsum payment equivalent to one-tenth of last drawn basic pay(including non- practising allowance, if applicable) and dearness allowance thereon, in accordance with these regulations, for each completed six months of qualifying service as certified by Head of Office. XXI.Sub-regulation (3) of regulation 14 under chapter VI shall be substituted as follows (3) This Lumpsum Payment shall be in addition to the assured payout payable to the UPS subscriber and shall not affect the quantum of assured payout and shall be payable upon superannuation or voluntary retirement or retirement under Fundamental Rules 56 (or under the special voluntary retirement scheme or upon resignation or upon absorption in accordance with UPS Rules, as may be applicable. XXII. Clause (i) of sub-regulation (1) of regulation 15 under chapter VI shall be substituted as follows (i) Assured payout: Assured payout shall be payable at fifty-percent. of the average of the last twelve months Basic Pay (as certified by Head of Office) immediately prior to the date of superannuation or voluntary retirement or retirement under Fundamental Rules 56 or under the special voluntary retirement scheme or upon resignation or upon absorption in accordance with UPS Rules, as may be applicable, subject to completion of minimum twenty-five years of qualifying services by a UPS subscriber, computed as per regulation 13.The formula for calculating assured payout is as under: Assured Payout (A) = (½ of P) x (Q/300) Where: P = average of Basic Pay for last twelve months, as certified by the Head of Office, from the date of superannuation or voluntary retirement or retirement under Fundamental Rules 56 or under the special voluntary retirement scheme or upon resignation or upon absorption in accordance with UPS Rules, as may be applicable Q = months of qualifying service as certified by the Head of Office (Provided where Q is - Less than 120, UPS shall not be applicable More than 300, then Q shall be taken as 300) XXIII. Para (a) of clause (iv) of sub-regulation (1) of regulation 15 under chapter VI shall be substituted as follows (a) Individual corpus is less than the benchmark corpus as on the date of superannuation or voluntary retirement or retirement under Fundamental Rules 56 or under the special voluntary retirement scheme or upon resignation or upon absorption in accordance with UPS Rules, as may be applicable; XXIV. Sub-regulation (2) of regulation 15 under chapter VI shall be substituted as follows – (2) Final Withdrawal Percentage: (i) UPS Subscriber or the legally wedded spouse, as the case may be, shall also have an option to withdraw an amount not exceeding sixty percent. of the individual corpus or benchmark corpus, whichever is lower, available in the PRAN tagged to UPS as on the date of superannuation or voluntary retirement or retirement under Fundamental Rules 56 or under the special voluntary retirement scheme or upon resignation or upon absorption in accordance with UPS Rules, as may be applicable, subject to proportionate reduction in the assured payout payable to such UPS Subscriber. Provided that in case the individual corpus is more than the benchmark corpus as on the date of superannuation or voluntary retirement or retirement under Fundamental Rules 56 or under the special voluntary retirement scheme or upon resignation or upon absorption in accordance with UPS Rules, as may be applicable, the final withdrawal amount shall be calculated on the benchmark Corpus and the excess amount in the individual corpus shall be credited to the designated bank account of the UPS Subscriber. (ii) Such final withdrawal shall be admissible on the date of superannuation or voluntary retirement or retirement under Fundamental Rules 56 or under the special voluntary retirement scheme or upon resignation or upon absorption in accordance with UPS Rules as may be applicable. XXV. Regulation 16 under chapter VI shall be substituted as follows – 16. Family Payout – (1) Upon demise of a UPS Subscriber who was receiving or was eligible to receive admissible payout on the deemed date of superannuation, as the case may be, the legally wedded spouse of such deceased subscriber shall receive for life, family pay out of sixty percent of the amount of the admissible payout drawn by or payable to the subscriber, from the date of demise of such subscriber. (2) In case of a deceased Central Government employee under NPS who has superannuated or retired on or before 31st March 2025, and was eligible to receive benefits under UPS, the legally wedded spouse, upon submission of claim and authorisation thereof, shall receive the difference of sixty percent. of the admissible payout payable to such UPS Subscriber and sixty percent. of representative annuity amount, as family payout after the date of demise, besides following benefits that shall become vested in the deceased employee, on the date of superannuation or retirement under Fundamental Rules 56 or under the special voluntary retirement scheme or upon resignation or upon absorption in accordance with UPS Rules, as may be applicable, until the date of demise and be payable to the legally wedded spouse: (i) lump sum payment payable to such deceased employee; (ii) monthly top-up amount payable to such deceased employee after the date of superannuation or retirement, until the date of demise; (iii) applicable dearness relief; and (iv) simple interest as per applicable Public Provident Fund rates on arrears with respect to above benefits for the past period, which interest shall become due from the following month after superannuation or retirement up to the month preceding the submission of claim Forms. Provided that no interest shall be payable where the UPS option form is submitted beyond the stipulated time period, for the period of such delay. XXVI. Sub-regulation (5) of regulation 18 under chapter VII shall be substituted as follows – (5) A subscriber who has made a partial withdrawal shall have an option to replenish the value of shortfall, if any, as per first proviso to clause (iv) of regulation 15. XXVII. Sub-regulation (3) of regulation 19 under chapter VIII shall be substituted as follows – (3) The UPS Subscriber, at superannuation or voluntary retirement or retirement under Fundamental Rules 56 or under the special voluntary retirement scheme or upon resignation or upon absorption in accordance with UPS Rules, as may be applicable, shall authorise the transfer of the value of units in the individual corpus to the pool corpus, which shall not exceed the value of the benchmark corpus. In case the value of the individual corpus authorised for transfer is less than the value of benchmark corpus, assured payout shall be proportionately reduced, unless the shortfall is replenished. XXVIII. Sub-regulation (5) of regulation 22 under chapter VIII shall be substituted as follows – (5) In respect of an employee who has superannuated or retired on or before 31st March 2025, and who seeks to avail the benefit of monthly top-up without a proportionate deduction on account of lumpsum withdrawal exercised under NPS and/or shortfall in the individual corpus as compared to the benchmark corpus, if there is any, such Subscriber shall have the option to replenish the shortfall(s) prior to submission of the claim form, in the following manner: (a) In case of shortfall arising due to lumpsum withdrawal made under NPS, the amount to be replenished shall be equivalent to the percentage of lumpsum withdrawal, computed on individual corpus or benchmark corpus, whichever is lower, and units valued as per their NAV as on the date of exercising the option. (b) In case of the shortfall in the individual corpus as compared to the benchmark corpus, the amount to be replenished shall be equivalent to the amount of such shortfall, and units valued as per their NAV as on the date of exercising the option. Provided that subscribers who exercised 100% lump sum withdrawal of the corpus under NPS shall not be eligible to avail this replenishment option in isolation. (c) The subscriber may choose to replenish either or both of the shortfalls referred to in clauses (a) and (b). XXIX. Sub-regulation (3) of regulation 23 under chapter VIII shall be substituted as follows – (3) The Head of Office shall keep updated the service records of such employees covered under sub-regulation (1). XXX. Following clause (xv a) shall be inserted after clause (xv) under sub-regulation (3) of regulation 26 under chapter VIII - (xv a) upon receipt of duly approved switch application from PAO, auto authorise release of differential 4% contribution along with returns computed on the default investment pattern under UPS, for the period during which the employee was under Unified Pension Scheme, from the Pool Corpus to the NPS Tier I Account of such subscriber, in accordance with these regulations; XXXI. Under Schedule I after the sentence Summary of Forms contained in Schedule I following shall be inserted – The data, content and other details provided in these forms are indicative in nature and maybe suitably modified by PFRDA for operational purposes including the process or procedure. Also, if required, PFRDA may prescribe any additional forms. XXXII. Form A1 under Schedule I shall be substituted with the following FORM A1 UNIFIED PENSION SCHEME (UPS) – SUBSCRIBER REGISTRATION FORM Before filling the form, please read the INSTRUCTIONS carefully given at the end of the form Joint Photograph Of Subscriber & spouse To, National Pension System Trust I, Son/Daughter of Mr/Mrs. having joined Central Government service on and having read and fully understood the provisions of the Unified Pension Scheme (UPS) as notified by the Central Government vide notification F.
