Detailed Summary

The Ministry of Environment, Forest and Climate Change, through Notification S.O. 3921(E) dated 26th August, 2025, constitutes the State Level Environment Impact Assessment Authority, Uttar Pradesh (SEIAA, UP) and two State Level Expert Appraisal Committees for Uttar Pradesh (SEAC-1 and SEAC-2). This action is taken in exercise of powers under sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986), in pursuance of S.O. 1533(E) dated 14th September, 2006, and in suppression of S.O. 2776(E) dated 11th June, 2021, except as respects things done or omitted. The SEIAA, UP comprises Shri Anupam Gupta (Chairperson), Shri Amit Chandra (Member), and Shri Manish Mittal (Member Secretary). The two SEACs are also constituted with specific members, including Shri Kamlesh Kumar Pandey as Chairperson for SEAC-1 and Dr. Ram Lakhan Singh as Chairperson for SEAC-2, with Dr. Ravi Kumar Singh serving as Member Secretary for both SEACs. The SEIAA will make decisions based on SEAC recommendations, striving for unanimity, with majority decisions requiring detailed recording and submission to the Central Government. SEAC-1 has jurisdiction over 37 districts, while SEAC-2 covers 38 districts in Uttar Pradesh. The Chairperson and Members of both the Authority and Committees will hold office for three years from the notification's publication date. Strict conflict of interest guidelines are established, requiring members to declare associations, refrain from undertaking consultancy for projects they will appraise, and recuse themselves if they have provided services to a proponent in the preceding five years. The State Government of Uttar Pradesh is responsible for appointing a secretariat to provide financial and logistical support and for governing allowances, as specified in File No. J-11013/43/07-IA.II(I) (Pt.).

In exercise of the powers conferred by sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) and in pursuance of the notification of the Government of India in the erstwhile Ministry of Environment and Forests, number S.O. 1533(E), dated the 14th September, 2006 and in suppression of the notification of the Government of India, in the Ministry of Environment, Forests and Climate Change number vide S.O.2776(E ) dated the 11th June, 2021 except as respects things done or omitted to be done before such suppression, the Central Government hereby constitutes the State Level Environment Impact Assessment Authority, Uttar Pradesh (hereinafter referred to as the Authority) comprising of the following Members, namely:— (i) Shri. The Authority shall take its decision on the recommendations of the State Level Expert Appraisal Committees constituted under paragraph 4. 3. All decisions of the Authority shall be taken in a meeting and shall ordinarily be unanimous: Provided that, in case a decision is taken by majority, the details of views, for and against it, shall be clearly recorded in the minutes and a copy thereof sent to the Central Government. 4. The Central Government, in consultation with the State Government of Uttar Pradesh, for the purpose of assisting the Authority, hereby constitutes the following State Level Expert Appraisal Committees for the State of Uttar Pradesh (hereinafter referred to as the Committees) comprising of the following persons, namely: - State Level Expert Appraisal Committee-1 (i) Shri Kamlesh Kumar Pandey, Krishna Kunj, 4/502, Vikas Nagar, Lucknow-226022 (ii) Shri. The Chairperson and Members of the Authority and the Committees, shall hold office for a period of three years from the date of publication of this notification in the Official Gazette. 7. The Authority and the Committees shall exercise such powers and follow such procedures as specified in the said notification. 8. In order to avoid any conflict of interest, (i) the Chairperson and Members of the Authority, and the Committees shall, (a) declare to which consulting organisation they have been associated with and also the project proponents; and (b) not undertake any consultation or associate with regard to preparation of Environment Impact Assessment and Environment Management Plan for project, which is to be decided by the Authority or to be appraised by the Committees during their tenure; (ii) in the preceding five years, if the Chairperson or any Member of the Authority, and the Committees have provided consultancy services or conducted Environment Impact Assessment studies for any project proponent, in that event they shall recuse themselves from the meetings of the Authority or the Committees as the case may be, from the process of appraisal of any project proposed by such proponents. 9. The Committees shall function on the principle of collective responsibility and the Chairperson shall endeavour to reach a consensus in each case, and if consensus cannot be reached, the views of the majority shall prevail. 10. The State Government of Uttar Pradesh shall specify an agency to act as Secretariat of the Authority and the Committees which shall provide financial and logistic support, including accommodation, transportation and such other facilities in respect of their functions under the said notification. 11. The sitting fees, travelling allowances and dearness allowances to the Chairperson and Members of the Authority and the Committees shall be paid in accordance with the provisions of relevant rules of the State Government of Uttar Pradesh.
