Detailed Summary

This notification, S.O. 2340(E) dated 26th May, 2025, issued by the Ministry of Road Transport and Highways under sub-section (1) of section 3D of the National Highway Act, 1956 (48 of 1956), declares the acquisition of land specified in the Schedule. This follows a previous notification (2948(E) dated 24 July, 2024) published under sub-section (1) of section 3A of the said Act, which declared the intention to acquire land for the construction, maintenance, management, and operation of National Highway No. 135A. The land is required for widening to 4 lanes in the stretch from Km. 139.00 to Km. 179.20 (Pkg-III, Jaunpur – Akbarpur section) and the Akbarpur bypass in the State of Uttar Pradesh. The substance of the intention notification was published in 'Aaj' and 'Times of India' on 19 September 2024, as per sub-section (3) of section 3A. No objection was received by the Competent Authority, and the authority submitted its report to the Central Government under sub-section (1) of section 3D. In exercise of powers under sub-section (1) and (2) of section 3D, the Central Government declares that the land in the Schedule is acquired and shall vest absolutely in the Central Government, free from all encumbrances, upon publication of this notification. The total area to be acquired is 0.2297 hectares across villages Khemipur, Chak Kurha, and Sikandar Patti in District Azamgarh, Uttar Pradesh, involving both Government and Private land classified as Agriculture and Naveen Parti.

L.-33004/99 The Gazette of India CG-DL-E-27052025-263393 EXTRAORDINARY PART II—Section 3—Sub-section (ii) PUBLISHED BY AUTHORITY No. 2286] NEW DELHI, MONDAY, MAY 26, 2025/JYAISTHA 5, 1947 MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 26th May, 2025 S.O. 2340(E).—Whereas by the notification of the Government of India in the Ministry of Road Transport and Highways, 2948(E) dated 24 July, 2024, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii) issued under sub-section (1) of section 3A of the National Highway Act, 1956 (48 of 1956) (hereinafter referred to as the said Act), the Central Government declared its intention to acquire the land specified in the Schedule annexed to the said notification for construction (Widening/4-Lane etc) maintenance, management and operation of National Highway No. 135A in the stretch of land from Km. 139.00 to Km. 179.20 for Widening to 4 lane from Km. 139.00 to Km. 179.200 Pkg-III (Jaunpur – Akbarpur section) and Akbarpur bypass of NH-135A in the State of Uttar Pradesh. And whereas the substance of the said notification has been published in "Aaj" and "Times of India" both dated 19 September 2024; under sub-section (3) of section 3A of the said Act; And whereas no objection has been received by Competnet Authority; And whereas, in pursuance of sub-section (1) of section 3D of the said Act, the competent authority has submitted its report to the Central Government; Now, therefore, upon receipt of the said report of the competent authority and in exercise of the powers conferred by the sub-section (1) of section 3D of the said Act, the Central Government hereby declares that the land specified in the said Schedule should be acquired for the aforesaid purpose; And further, in pursuance of sub-section (2) of section 3D of the said Act, the Central Government hereby declares that on publication of this notification in the Official Gazette, the land specified in the said Schedule shall vest absolutely in the Central Government, free from all encumbrances. And whereas the substance of the said notification has been published in "Aaj" and "Times of India" both dated 19 September 2024; under sub-section (3) of section 3A of the said Act; And whereas no objection has been received by Competnet Authority; And whereas, in pursuance of sub-section (1) of section 3D of the said Act, the competent authority has submitted its report to the Central Government; Now, therefore, upon receipt of the said report of the competent authority and in exercise of the powers conferred by the sub-section (1) of section 3D of the said Act, the Central Government hereby declares that the land specified in the said Schedule should be acquired for the aforesaid purpose; And further, in pursuance of sub-section (2) of section 3D of the said Act, the Central Government hereby declares that on publication of this notification in the Official Gazette, the land specified in the said Schedule shall vest absolutely in the Central Government, free from all encumbrances.
