Detailed Summary

The Ministry of Road Transport and Highways, through Notification S.O. 1596(E) dated 25th March, 2026, has notified the levy and collection of fees on mechanical vehicles for the Gorhar – Barwa Adda Section (Km 320.810 to Km 401.332) of NH-19 (Old NH-2) in Jharkhand. This action is taken under Section 8A of the National Highways Act, 1956 (48 of 1956), read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008, and supersedes Notification S. O. No 191(E) dated 14th January 2022. The Central Government had previously entrusted stretches of National Highway No. 2 and NH-19 (New NH-19) to the National Highways Authority of India (NHAI) via notifications S.O. 78 (E) dated 4th February 1999 and S.O. 660 (E) dated 27th September 1996, issued under Section 11 of the National Highways Authority of India Act, 1988 (68 of 1988). Pursuant to Section 14 of the same Act, NHAI entered into an agreement on 17th March 2026 with M/s Raajmarg 1 Projects Private Limited (Concessionaire) for the Tolling, Operation, Maintenance, and Transfer of the specified Gorhar – Barwa Adda Section. Fees will be collected at the Fee Plaza located at Km 352.100 of NH-19 near Kulgo Village in Girdihi District of Jharkhand. The rates are 100% of the base rates (ranging from Rs. 0.65 to Rs. 4.20 per Km for various vehicle types in Table 1) for the net road length of 72.357 km and equivalent structure length of 3.09 km (derived from 0.309 km of structures over 60m length), and 150% of the base rates for the use of bypasses (Bagodar Bypass and Rajganj Bypass, totaling 7.856 km and costing over Rs. 10 crore). A monthly pass for non-commercial vehicles residing within 20 km of the plaza is Rs. 340.00 for 2025-26, subject to annual revision. Commercial vehicles registered in the district where the fee plaza falls are eligible for a 50% discount if no alternative road is available. Overloaded mechanical vehicles are prohibited from using the highway until excess load is removed, and penalties apply based on the percentage of excess load. The Concessionaire is authorized to collect fees from the commercial operation date or publication date, whichever is later, until the agreement termination date. Fee rates are to be displayed as per Rule 12 and revised annually as per Rule 5 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008, with at least a six-month gap between revisions.

O. 660 (E), dated 27th September 1996, issued under section 11 of the National Highways Authority of India Act, 1988 (68 of 1988), the Central Government has entrusted the stretch from Kilometer 46.000 to Kilometer 398.750 (Uttarpradesh / Bihar Border to Barwa Adda Section) of National Highway No. 2 and Km 398.750 to Km 441.440 (Barwa Adda to Barakar Section) of National Highway No.2 (New NH-19) in the State of Bihar and Jharkhand to the National Highways Authority of India (hereinafter referred to as the “Authority"); And whereas, pursuant to the provision of Section 14 of the National Highways Authority of India Act, 1988 (68 of 1988), the Authority has entered into an agreement (hereinafter referred to as said agreement) with M/s Raajmarg 1 Projects Private Limited, having its registered office at G-5 & 6, Sector-10, Dwarka, Delhi, South West Delhi, Delhi, India, 110075 (hereinafter referred to as the “Concessionaire"), on 17th March 2026 for the Tolling, Operation, Maintenance and Transfer of Gorhar – Barwa Adda Section from Km 320.810 to Km 401.332 of NH-19 (Old NH-2) in the state of Jharkhand (hereinafter referred to as the said section) of the National Highway. Now, therefore, in exercise of the powers conferred by section 8A of the National Highways Act, 1956 (48 of 1956), read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 (hereinafter referred to as the "rules") and any other amendments notified thereof till signing of the Agreement and in supersession of the Notification Number S. O. No 191(E) dated 14 th January 2022, except as respects things done or omitted to be done before such supersession, the Central Government, having regard to the expenditure involved in building, maintenance, management and operation of the said section, interest on the capital invested, reasonable return, the volume of traffic and the period of the agreement entered into between the Authority and the Concessionaire, hereby notifies that there shall be levied and collected fees on mechanical vehicles for the use of the Six / Four Lane Highway of Gorhar - Barwa Adda Section from Km 320.810 to Km 401.332 of NH 19 in the State of Jharkhand (hereinafter referred to as the "said section'), for Net road length of 72.357 km (Table 2) at 100% of the rates specified in Column (2) of Table 1 below and for equivalent structure length (having length more than 60m) of 3.09 km. having length 0.309 km, Table 4) and one and half times of the base rate for use of bypasses, costing rupees ten crore or more, having length of 7.856 km (Table 3) for the four or more lane section on the type of vehicles specified in Column (1) of Table 1, and authorises the said Concessionaire to collect and retain the fee on and from the date of commercial operation or publication of this Notification in the Official Gazette, whichever is later, till the termination date as specified in the agreement. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometers from the fee plaza is Rs. 340.00 (Rupees Three Hundred Forty only) for the year 2025-26 and is subject to revision every year as per the provisions of the said rules. 5. Fee for commercial vehicle (excluding vehicles plying under national permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles. 7. A mechanical vehicle which is loaded in excess of permissible load specified for its category under the rules, shall not be permitted to use the National Highway for crossing the plaza until the excess load has been removed from such mechanical vehicle. The Fee rates shall be displayed for information of the users in accordance with rules 12 of the said rules. 9. Based on the base rate of fee per kilometer for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority. The same shall be got published by the authority in at least one newspaper in English and vernacular language through the concessionaire and thereafter revised annually in accordance with the rule 5 of the said rule and provisions of the concession agreement and will be published; provided, however, that such revision shall not be effected until a period of 6 (six) months from the date of preceding revision of fee.
