The Ministry of Road Transport and Highways, through Notification S.O. 370(E) dated 19th January, 2026, issued under section 7 of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008, has superseded its previous notifications S.O. 1611(E) dated 16th April, 2019, and S.O. 4382(E) dated 25th September, 2025. This notification authorizes the Central Government to levy and the National Highways Authority of India (NHAI) to collect fees for the use of the four-laned Sonauli-Gorakhpur section of National Highway number 24 (old NH-29E) in Uttar Pradesh, effective from its Commercial Operation Date (COD). The designated stretch runs from design kilometer 0.000 to design kilometer 79.54 (existing chainage kilometer 80+295), comprising a net road length of 74.200 kilometers and specific bypasses totaling 5.340 kilometers, including the Pipiganj Bypass costing Rs. 121 Crore. Fees are levied at base rates (for the base year 2007-08) ranging from Rs. 0.65/km for cars to Rs. 4.20/km for oversized vehicles, with bypasses costing Rs. 10 crore or more charged at one and a half times the base rate. Fee plazas are located at Km 13.700 near village Chandithan in Dist. Maharajganj and at Km 77.476 near village Jungle kaudia in Dist. Gorakhpur. A monthly pass for non-commercial vehicles registered within 20 kilometers of a fee plaza is Rs. 340.000 for the year 2025-26, subject to annual revision. The estimated capital cost of the project is Rs. 2703.97 Crore, and fees will be revised annually in accordance with rule 5 of the 2008 Rules and published in English and vernacular newspapers.

Whereas by notification of the Government of India in the Ministry of Road Transport and Highways number S.O.3833(E) dated the 3rd August, 2018, issued under section 11 of the National Highways Authority of India Act, 1988 (68 of 1988), the Central Government had entrusted the stretch from Kilometer 0.000 to Kilometer 80.000 of Sonauli Gorakhpur Section of National Highway-29 Extension in the State of Uttar Pradesh to the National Highways Authority of India (hereinafter referred to as the "Authority"); And whereas, by notifications of the Government of India in the Ministry of Road Transport and Highways numbers S.O.1611(E) dated 16th April, 2019 and its subsequent amendment notification number S.O. 4382 (E) dated 25th September, 2025, the Central Government had authorised the authority to collect, either through its official or through a Contractor, for the use of two laning with paved shoulder of Sonauli to Gorakhpur Section from Design Km. 0.000 (Existing chainage Km. 0.000) to Design Km. 81.412 (Existing chainage Km. 80.000) of National Highway No. 24 (Old NH- 29E) in the State of Uttar Pradesh ; Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 (hereinafter referred to as the "rules"), and in supersession of the notifications of the Government of India in the Ministry of Road Transport and Highways numbers S.O. 1611(E) dated 16th April, 2019, and S.O. 4382(E) dated 25th September, 2025, except as respects things done or omitted to be done under such supersession, the Central Government hereby notifies that this notification shall come into force with effect from the Commercial Operation Date (COD) of the ongoing four-laning work of the existing two-lane Sonauli-Gorakhpur section. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometers from the fee plaza is Rs. 340.000 (Three Hundred and Forty Rupees only) for the year 2025-26 and is subject to revision every year as per the provisions of the said rules. 4. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the specified rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles. 6. The driver or owner or a person in charge of a mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collecting agency, equal to the fee specified in sub-rule 1A of rule 10 of the said rules, and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle. 7. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road, etc. shall be as per definitions specified in the said rules. 8. The fee rates shall be displayed for information of the users in accordance with rule 12 of the said rules. 9. Based on the base rate of fee per kilometer for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper in English and vernacular language. 10. The estimated capital cost of the project is Rupees 2703.97 Crore. The capital cost is subject to variation as the activities of land acquisition, utility shifting, tree cutting, etc. are yet to be completed.
