Following the prior notification S.O. 3369(E) dated 26 July 2023 issued under Section 3A(1) of the National Highways Act, 1956 (48 of 1956), by which the Central Government declared its intention to acquire land for construction (widening/two lane with paved shoulder etc.), maintenance, management and operation of NH-730 (Shohrathgarh Bypass) from Km 413.700 to Km 419.000 in Siddharthnagar district, Uttar Pradesh; after publication of the substance of that notification in "Dainik Jagran" and "The Times of India" on 4 August 2023 under Section 3A(3); after objections received under Section 3C were considered and disallowed by the Competent Authority; and after the Competent Authority submitted its report under Section 3D(1); the Ministry of Road Transport and Highways (S.O. 4677(E), dated 26 October 2023) declared under Section 3D(1) that the scheduled land should be acquired for the aforesaid purpose, and further declared under Section 3D(2) that upon publication of this notification the land shall vest absolutely in the Central Government free from all encumbrances. The Schedule lists three private agricultural land parcels totaling 0.456 hectares in Parsiya village, Shohratgarh Taluk, Siddharthnagar district, Uttar Pradesh (survey nos. 196, 200 and 201), naming the owners/interested persons as Deepakchand, Diwakar Chandra, Prabhakar Chand, Sudhakarchand, Ratnakar Chand, Ashadevi, Suryaprakash, Bedprakash, Vijayprakash and Gyanprakash. CE-RO/LKO/NH -730/LA/2022 -23/3D ] MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi , the 26th October, 2023 S.O. 4677 (E).—Whereas by the notification number 3369 (E) dated 26 July 2023 of the Government of India in the Ministry of Road Transport and Highways, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub -section (ii) issued under sub -section (I) o f section 3A of the National Highway Act, 1956 (48 of 1956) (hereinafter referred to as the said Act), the Central Government declared its intention to acquire the land specified in the Schedule annexed to the said notification for construction (widening/t wo lane with paved shoulder etc.,) Maintenance, management and operation of NH -730 (Shohrathgarh Bypass) on the stretch of land from Km 413.700 to Km 419.000 in the district of Siddharthnagar in the state of UTTAR PRADESH. And whereas the substance of the said notification has been published in “ Dainik Jagran ” and “ The Times Of India ” both dated 04 August 2023 ; under sub -section (3) of section 3A of the said Act; And whereas objections have been received and the same have been considered and disallowed by the competent Authority; And whereas, in pursuance of sub -section (1) of section 3(D) of the said Act, the Competent Authority has submitted its report to the Central Government; Now, therefore, upon receipt of the said report of the competent authority a nd in exercise of the powers conferred by the sub -section (1) of section 3(D) of the said Act, the Central Government hereby declares that the land specified in the said Schedule should be acquired for the aforesaid purpose; And further, in pursuance of su b-section (2) of section 3(D) of the said Act, the Central Government hereby declares that on publication of this notification in the Official Gazette, the land specified in the said Schedule shall vest absolutely in the Central Government, free from all e ncumbrances.
