The Ministry of Communications, Department of Telecommunications, under F. No. 18-10/2017-IP dated 21st October 2024, in supersession of its earlier notifications dated 29.08.2018 and 31.08.2021, issues this notification pursuant to the Public Procurement (Preference to Make in India) Order, 2017 ("PPP-MII Order"), originally issued by the Department of Industrial Policy and Promotion (DIPP) vide Order No. P-45021/2/2017-B.E.-II dated 15.06.2017 and revised via subsequent orders dated 28.05.2018, 29.05.2019, 04.06.2020, 16.09.2020 and, by the Department for Promotion of Industry and Internal Trade (DPIIT), 19.07.2024; the notification applies to procurement by all attached/subordinate offices, autonomous bodies and Government Companies under the Government of India, and to Central Schemes/Central Sector Schemes and Digital Bharat Nidhi-funded projects; per clauses 2, 3 and 11 of the DPIIT PPP-MII Order dated 19.07.2024, it specifies in Table-A telecom products, services and works (including encryption/UTM platforms, IP/MPLS routers, managed leased line equipment, Ethernet switches, soft switches/IMS/unified communication systems, PABX/IP PBX, media gateways, customer premises equipment, SDH/NG-SDH, and packet optical transport equipment) each with a Minimum Local Content (MLC) percentage and a ceiling on local content attributable to design, with qualifying Local Content conditions in Table-B; under clause 2A, manufacturers under the Telecom PLI scheme are deemed Class-II local suppliers; under clause 9(a), suppliers must self-certify local content in Form-1; under clause 9(e), a Committee is constituted comprising DDG (TC), TEC, New Delhi (Chairperson), Director (Technical) C-DOT, DG TEPC, Director (Finance) DoT, Director (IP) and Director TEC (Convener) to examine complaints, with a complaint fee of Rs. 2 Lakh or 1% of value (whichever higher, capped at Rs. 5 Lakh); imported products are treated as non-local supplies and cannot claim local-value-addition status via services such as transportation, installation or after-sales support.

Accordingly, the Department of Telecommunications, in supersession of its previous notifications No. 18-10/2017-IP dated 29.08.2018 and 31.08.2021, hereby issues this notification. 3. This Notification shall be applicable in respect of the procurement made by all attached or subordinate offices or autonomous bodies under the Government of India including Government Companies as defined in the Companies Act, and/or the States and Local Bodies making procurement under all Central Schemes/ Central Sector Schemes where the Scheme is fully or partially funded by the Government of India. This Notification shall also be applicable in respect of projects wherein funding of goods, services or works is by the Digital Bharat Nidhi to the extent of having being awarded through bids. 4. In terms of Clause 2, 3 and 11 of the DPIIT's PPP-MII Order dated 19.07.2024, it is hereby notified that telecom products, services and works listed in Table-A have sufficient local capacity and local competition. A Class-I local supplier must meet the Minimum Local Content (MLC) requirement specified against each item in Table-A. Table-A also specifies the maximum ceiling of LC percentage for design out of total LC against each item. The conditions for the inputs to be qualified as Local Content (LC) are specified in Table-B. 5. In accordance with clause 2A of the DPIIT's PPP-MII Order dated 19.07.2024, the list of manufacturers manufacturing products under the PLI scheme for Telecom and Networking products and having received incentive will be published and uploaded from time to time on https://dot.gov.in/public-procurement-preference-make-india and https://pli-telecom.udyamimitra.in/. Such manufacturers will be treated as deemed Class-II local suppliers for the products specified in the list and upto the specified period. 6. In terms of clause 9 (a) of DPIIT's PPP-MII Order dated 19.07.2024, a supplier at the time of tender, bidding or solicitation shall provide self-certification in Form-1 specifying that the item(s) offered meet the minimum local content requirement and shall give details of the location(s) at which the local value addition is made. 7. In terms of clause 9 (e) of the DPIIT's PPP-PMI Order dated 19.07.2024, the following Committee is hereby constituted to examine complaints and conduct independent verification of self-declarations and auditor's/accountant's certificates regarding Local content on random basis: a) DDG (TC), TEC, New Delhi -Chairperson b) Director (Technical), C-DOT - Member c) Any other member(s) as co-opted by the chairperson - Member d) DG, TEPC - Member e) Director (Finance), DoT - Member f) Director (IP) - Member g) Director, TEC - Convener 8. In terms of clause 9 (f) of DPIIT's PPP-MII Order dated 19.07.2024, a complaint fee of Rs. 2 Lakh or 1% of the value of the locally supplied telecom products, services or works being procured (whichever is higher, up to a maximum of Rs. 5 Lakh) must be paid by Demand Draft or online, and to be deposited with Telecommunications Engineering Centre (TEC), along with the complaint by the complainant. If the complaint is found to be incorrect, the complaint fee shall be forfeited. However, if the complaint is upheld in part or full, deposited fee of the complainant will be refunded without any interest. 9. The Committee's findings shall be forwarded to the procuring entity for appropriate action in accordance with Clause 9 of the DPIIT's PPP-MII Order dated 19.07.2024. 10. For the products, services or works listed in Table-A that have an associated TEC GR/IR, the procuring entity must specify the relevant TEC GR/IR as the minimum requirement. 11. The condition of prior turnover and prior experience may be relaxed for Start-ups (registered by Department for Promotion of Industry and Internal Trade), provided that the Start-up meet the necessary quality & technical specifications. 12. To support and promote indigenous technologies, Proof of Concept (PoC) may be included in tenders and RFPs as a substitute for qualifying experience, wherever applicable. 13. It is noted that 5G products with indigenous technology are presently being tested in the country. Table-A shall be reviewed from time to time and addition of 5G products/virtual routers shall be considered based on manufacturing capacity. Domestic manufacturers and their associations are encouraged to pro-actively provide evidence of manufacturing capacity from time to time to DoT to enable inclusion of such products by email to [email protected]. 14. The bidders offering imported products will fall under the category of non-local suppliers. They can not claim themselves as Class-I local suppliers/Class-II local suppliers by claiming the services such as transportation, insurance, installation, commissioning, training and after sales service support like AMC/CMC etc. as local value addition. 15. This Notification comes into effect from the date of notification. It is clarified that, except specific conditions contained in this notification, all the other conditions of the Public Procurement (Preference to Make in India) Order 2017 as amended from time to time shall prevail and are to be followed strictly. That the LC for all inputs which constitute the said Telecom Product/Services/Works has been verified by me and I am responsible for the correctness of the claims made therein. That in the event of the LC of the Telecom Product/Services/Works mentioned herein is found to be incorrect and not meeting the prescribed LC norms, based on the assessment of an authority so nominated by the Department of Telecommunications, Government of India, I and my Statutory auditor or cost auditor (if applicable) will be liable for actions as specified in Clause (9) of the DPIIT PPP-MII Order dated 19.07.2024 for all incorrect/false facts and figures. I agree to maintain detailed breakup / information (separately for each product) to substantiate my claim for LC in the Company's record for a period of 2 years and shall make this available for verification to any authority. I shall also maintain records of local content pertaining to items bought from other domestic manufacturers / traders.
