Detailed Summary

The Unique Identification Authority of India (UIDAI), exercising powers under sub-sections (1) and (2) of section 54 of the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016 (18 of 2016), published the Aadhaar (Enrolment and Update) Second Amendment Regulations, 2025, on August 22, 2025, vide F. No. HQ-16021/2/2021-EU-II-HQ (E-6538). These regulations amend the Aadhaar (Enrolment and Update) Regulations, 2016 (principal regulations). Key amendments include inserting sub-regulation (4) into regulation 27, mandating the omission of an Aadhaar number if biometric information is mixed with another individual's. Regulation 28 is amended to include sub-clause (ca) for Aadhaar holders aged five or above enrolled without core biometrics and later updated, and sub-clause (ea) for deactivating Aadhaar numbers upon verified information of the holder's death, allowing UIDAI to seek information from the Registrar General of India, Chief Registrar for a State (under the Registration of Births and Deaths Act, 1969), other Aadhaar ecosystem entities, or individuals. Additionally, the word "temporarily" is omitted from sub-regulation (2) of regulation 28. A new proviso is inserted into sub-regulation (1) of regulation 30, exempting deactivation of a deceased person's Aadhaar under clause (ea) of regulation 28(1) from certain requirements. Schedule I, Form V, is substituted with "FORM 5: Aadhaar Enrolment and Update" for Resident Indian and Non-Resident Indian children below 5 years, detailing requirements for demographic information, basis of enrolment (document or Head of Family), supporting documents (POI, POA, PDB, POR), and specific instructions including the sole acceptance of a birth certificate as PDB for children born on or after October 1, 2023. The fee structure for services at Enrolment Centres is also specified: enrolment is free; biometric updates cost ₹100 unless done once between ages 5-7 or 15-17 (which are free); demographic updates cost ₹50 if separate, or free if combined with a biometric update; and POI/POA document updates cost ₹50. No. HQ-16021/2/2021-EU-II-HQ (E-6538).—In exercise of the powers conferred by sub-sections (1) and (2) of section 54 of the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016 (18 of 2016), the Unique Identification Authority of India hereby makes the following regulations to further amend the Aadhaar (Enrolment and Update) Regulations, 2016, namely:— 1. Short title and commencement.—(1) These regulations may be called the Aadhaar (Enrolment and Update) Second Amendment Regulations, 2025. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Aadhaar (Enrolment and Update) Regulations, 2016 (hereinafter referred to as the principal regulations), in regulation 27, a sub-regulation (4) shall be inserted after sub-regulation (3), namely:- "(4) Where the Authority is satisfied that the biometric information captured at the time of enrolment for Aadhaar or at the time of biometric update, is mixed with the biometric information of another individual, such Aadhaar number shall be omitted in the manner as specified by the Authority." 3. In the principal regulations, in regulation 28,— (a) in sub-regulation (1), a sub-clause (ca) shall be inserted after sub-clause (c), namely:— "(ca) Aadhaar number holder was aged five years or above but was enrolled without capturing core biometric information and later biometric update has also been carried out." (b) in sub-regulation (1), a sub-clause (ea) shall be inserted after sub-clause (e), namely:— "(ea) (i) Where the Authority receives information regarding the death of an Aadhaar number holder including the Aadhaar number of the deceased individual, wherever available, the said information shall be verified in a manner as prescribed by the Authority, and upon such verification, the Aadhaar number shall be deactivated. (ii) In order to ensure continued accuracy of information in the CIDR or to verify the information pertaining to the death of the Aadhar number holder received under sub-regulation (i), the Authority: A. shall seek information from the Registrar General of India or Chief Registrar for a State appointed under the Registration of Births and Deaths Act, 1969; or B. may seek information from any other entity in the Aadhaar ecosystem; or C. may receive information from any individual." (c) in sub-regulation (2), the word “temporarily”, wherever it occurs, shall be omitted. 4. In the principal regulations, in regulation 30, in sub-regulation (1), a proviso shall be inserted after the second proviso, namely: "Provided further that the same shall not be required in case of deactivation of Aadhaar number of a deceased person under clause (ea) of sub-Regulation (1) of regulation 28." 5.
