These regulations amend the Aadhaar (Payment of Fees for Performance of Authentication) Regulations, 2023, which were originally published vide Notification F. No. HQ 13073/1/2020-AUTH.II-HQ(E) dated 29th September, 2023 (published on 3rd October, 2023), with a further amendment notified vide F. No. HQ-13073/1/2020-AUTH.II(E) dated 31st January 2024. The amendments, effective upon publication in the Official Gazette, introduce a new sub-regulation 2A in regulation 3. This sub-regulation mandates a fee, as specified in sub-regulation (2), for requesting entities that have an existing Memorandum of Understanding or agreement with the Authority for performing authentication, for every update provided by the Authority regarding the status (omitted, deactivated, or re-activated) of previously submitted Aadhaar numbers. However, no such fee is chargeable if the requesting entity provides information relevant for Aadhaar number deactivation. Furthermore, the Authority may waive such fees, wholly or partly, by order, if the update is in the interest of its functions, including maintaining the Central Identities Data Repository (CIDR), updating details for accuracy, processing information, or inquiring into CIDR. Additionally, sub-regulation 3 of regulation 3 is modified to reference sub-regulations (1), (2), and (2A), and sub-regulations 4 and 5 of regulation 3 are omitted. The notification bears F. No. 12972(E).—In exercise of the powers conferred by sub-sections (1) and (2) of section 54 of the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016 (18 of 2016), the Unique Identification Authority of India hereby makes the following regulations to amend the Aadhaar (Payment of Fees for Performance of Authentication) Regulations, 2023, namely:— 1. Short title and commencement.—(1) These regulations may be called the Aadhaar (Payment of Fees for Performance of Authentication) Amendment Regulations, 2025. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the principal regulations, in regulation 3, the following shall be amended, namely- 2.1 add sub-regulation 2A of after sub-regulation 2 of regulation 3 as — Where a requesting entity has entered into a Memorandum of Understanding or agreement with the Authority for performing authentication with update regarding the status as to whether any Aadhaar number previously submitted has been subsequently omitted or deactivated or re- activated, for any response subsequently made by the Authority by way of such update in respect of performance of authentication of Aadhaar numbers, a fee as specified in sub regulation (2) shall be chargeable to such requesting entity for every such update: Provided that no such fee shall be charged, where the requesting entity provides such information to the Authority which is relevant for deactivation of Aadhaar numbers. Provided further that the Authority may, where such update is in the interests of performance of its functions and exercise of its powers, including the maintenance of information of Aadhaar number holders in CIDR, updating of their current details for continued accuracy in CIDR, processing of information of Aadhaar numbers and inquiry into CIDR, by order, waive such fee, to such extent as such order may specify". 2.2 sub-regulation 3 of regulation 3 may be read as The fee specified in sub-regulations (1), (2) and (2A) ................................... 2.3 sub-regulation 4 omitted. 2.4 sub-regulation 5 omitted.
