By S.O. 4596(E) dated 17th October 2023, the Ministry of Commerce and Industry (Department for Promotion of Industry and Internal Trade), acting under Section 16 of the Bureau of Indian Standards Act, 2016 (11 of 2016) after consulting the Bureau of Indian Standards, makes the Drums and Tins (Quality Control) Order, 2023, requiring goods listed in the Table -- including Drums, Large Open Top (IS 13997:2014), Drums Large Fixed Ends Grade A and Grade B (IS 1783 Parts 1 and 2:2014), Steel Drums Galvanized and Ungalvanized (IS 2552:1989), Bitumen Drums (IS 3575:1993), Square Tins for Solid Products (IS 916:2000), and Square Tins for Ghee, Vanaspati, Edible Oils and Bakery Shortenings (IS 10325:2000) -- to conform to the corresponding Indian Standards and bear the Standard Mark under a Bureau of Indian Standards license per Scheme-1 of Schedule-II to the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018; the Order takes effect six months after publication in the Official Gazette, extended to twelve months for micro enterprises and nine months for small enterprises as defined under the Micro, Small and Medium Enterprises Development Act, 2006 (27 of 2006), exempts goods manufactured domestically for export, designates the Bureau of Indian Standards as certifying and enforcing authority, and makes contravention punishable under the Bureau of Indian Standards Act, 2016; it is issued under File No. P-29026/12/2023-LEI and signed by Sanjiv, Joint Secretary.

Short title and commencement. - (1) This Order may be called the Drums and Tins (Quality Control) Order, 2023. (2) It shall come into force on the expiry of six months from the date of publication of this notification in the Official Gazette: 2. Conformity to standard and compulsory use of Standard Mark. - Goods or ar ticles specified in column (1) of the Table shall conform to the corresponding Indian Standard mentioned in column (2) of the Table and shall bear the Standard Mark under a license from the Bureau of Indian Standards as per Scheme -1 of Schedule -II to the B ureau of Indian Standards (Conformity Assessment) Regulations, 2018: Provided that nothing in this Order shall apply to goods or articles manufactured domestically for export. Provided further that nothing in this Order shall apply to goods or articles f illed with material in powder or semi -solid or liquid form, when imported into India. Provided also that in relation to micro enterprises, as defined under clauses (h) and (m), respectively of Section 2 of the Micro, Small and Medium Enterprises Developmen t Act, 2006 (27 of 2006), it shall come into force on the expiry of twelve months from the date of publication of this notification. Provided also that in relation to small enterprises, as defined under clauses (h) and (m), respectively of Section 2 of the Micro, Small and Medium Enterprises Development Act, 2006 (27 of 2006), it shall come into force on the expiry of nine months from the date of publication of this notification. 3. Certification and enforcement authority. - The Bureau of Indian Standards shall be the certifying and enforcing authority for the goods or articles specified in the Table. 4. Penalty for contravention. - Any person who contravenes the provisions of this Order shall be punishable under the provisions of the Bureau of Indian Sta ndards Act, 2016.
