Following its earlier notification S.O. 131(E) dated 10 January 2024, issued by the Ministry of Shipping, Road Transport and Highways, Department of Road Transport and Highways under sub-section (1) of section 3A of the National Highways Act, 1956 (48 of 1956), declaring intention to acquire land for building (widening/four-laning etc.), maintenance, management and operation of the Harpalpur Bypass on National Highway No. 76 (starting at Km 91/8 and ending at Km 92/10, Design Chainage 0+00 to 9+630) in the states of Madhya Pradesh and Uttar Pradesh, with the substance of that notification published in "Amar Ujala" and "Rashtriya Sahara" (dated 14 March 2024) under sub-section (3) of section 3A, and after the Competent Authority received and settled objections filed under section 3C and submitted its report under sub-section (1) of section 3D, the Ministry of Road Transport and Highways issued S.O. 2377(E) dated 20 June 2024. Exercising powers under sub-section (1) of section 3D, the Central Government declared that the scheduled land should be acquired for the stated purpose, and under sub-section (2) of section 3D, declared that upon publication of the notification the land vests absolutely in the Central Government, free from all encumbrances. The Schedule lists two private irrigated land parcels (both Survey No. 1) in Bagrauni village, Kulpahad taluk, Mahoba district, Uttar Pradesh, owned by Shri Deepak Kumar and others (0.532 hectares) and Shri Saurabh Kumar and others (0.113 hectares), totaling 0.645 hectares. L.-33004/99 The Gazette of India CG-DL-E-21062024-254839 EXTRAORDINARY PART II—Section 3—Sub-section (ii) PUBLISHED BY AUTHORITY No. 2257] NEW DELHI, THURSDAY, JUNE 20, 2024/JYAISHTHA 30, 1946 3660 GI/2024 MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 20th June, 2024 S.O. 2377(E).—Whereas by the notification of the Government of India in the Ministry of Shipping, Road Transport and Highways, Department of Road Transport and Highways number S.O. 131(E) dated – 10 January 2024, published in Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii) issued under sub-section (1) of section 3A of the National Highways Act, 1956 (48 of 1956) (hereinafter referred to as the said Act), the Central Government declared its intention to acquire the land specified in the Schedule annexed to the said notification for building (widening / four-laning, etc.), maintenance, management and operation of Harpalpur Bypass on National Highway No. 76 (starting at Km 91/8 and ending at Km 92/10) Design CH. 0+00 to CH. 9+630 in the State of Madhya Pradesh & Uttar Pradesh. And whereas the substance of the said notification has been published in "Amar Ujala” dated the and "Rashtriya Sahara” dated 14/03/2024; under sub-section (3) of section 3A of the said Act; And whereas the Competent Authority has received objections filed under Section 3-C, considered and settled the same appropriately; And whereas, in pursuance of sub-section (1) of section 3D of the said Act, the competent authority has submitted its report to the Central Government; Now, therefore, upon receipt of the said report of the competent authority and in exercise of the powers conferred by sub-section (1) of section 3D of the said Act, the Central Government hereby declares that the land specified in the said Schedule should be acquired for the aforesaid purpose; And further, in pursuance of sub-section (2) of section 3D of the said Act, the Central Government hereby declares that on publication of this notification in the Official Gazette, the land specified in the said Schedule shall vest absolutely in the Central Government, free from all encumbrances.
