F. No. 6/17/2023-DGTR.—Having regard to the Customs Tariff Act, 1975 as amended from time to time (hereinafter referred to as the 'Act') and the Customs Tariff (Identification, Assessment and Collection of Duty or Additional Duty on Dumped Articles and for Determination of Injury) Rules, 1995 (hereinafter referred to as the Rules), as amended from time to time, thereof, the Designated Authority (hereinafter referred to as the 'Authority') has issued the Preliminary Finding Notification No. 6/17/2023 dated 26.04.2024 in respect of the anti-dumping investigation concerning imports of “Poly Vinyl Chloride Paste Resin” (hereinafter referred to as the ‘product under consideration' or the ‘PUC' or the 'subject goods') originating in or exported from China PR, Korea RP, Malaysia, Norway, Taiwan & Thailand (hereinafter referred to as the 'subject countries') The Authority notes that, in the Duty Table appended in paragraph 146, the use of the word 'Any' in Row numbers 4, 7, 10, 13, 16 and 18 against the Column no. 4 (Country of origin) could lead to ambiguous interpretation. Also, the specific exclusions from the product under consideration (PUC), as mentioned in Paragraph 14 of the said findings, were inadvertently left out from being mentioned below the said Duty Table. In view of the above, the paragraph 146 of the Preliminary Finding Notification No. 6/17/2023 dated 26.04.2024 stands substituted as mentioned below: 146. In terms of provision contained in Rule 12 and Rule 13 read with Rule 4(d) of the Rules, the Authority recommends imposition of provisional anti-dumping duty equal to the lesser of margin of dumping and the margin of injury, so as to remove the injury to the domestic industry. Accordingly, the Authority recommends imposition of provisional anti-dumping duty on the imports of subject goods, originating in or exported from the subject countries, from the date of notification to be issued in this regard by the Central Government, equal to the amount mentioned in Col. 7 of the duty table appended below.
