No. 3 -41/2022/NCH/HEB/Regulation -DRL -Pt. .—In exercise of the powers conferred by sub -section (1) and clauses (zk), (zl), (zm), (zn), (zo) and (zp) of sub -section (2) of section 55 of the National Commission for Homoeopathy Act, 2020 (15 of 2020), the National Commission for Homoeopathy hereby makes the following regulations, namely: - 1. Short title and commencement. - (1) These regulations may be called the National Commission for Homoeopathy (Recognition of Qualifications of Homoeopathy) Regulations, 2023. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Definitions. - (1) In these regulations, unless the context otherwise requires, - (a) “Act” means the Nationa l Commission for Homoeopathy Act, 2020 (15 of 2020); (b) “Annexure” means an Annexure appended to these regulations; (c) “Board” means the Homoeopathy Education Board; (d) “Course” means the course of study in Homoeopathy, namely: - (i) Bachelor of Homoeo pathic Medicine and Surgery (B.H.M.S), an undergraduate qualification in Homoeopathy listed and maintained by the Board; (ii) M.D (Homoeopathy) or Post Graduation in Homoeopathy, a postgraduate qualification in Homoeopathy listed and maintained by the Board; (e) “Digital Code” means the code given to the recognised medical qualification. (f) “Form” means a form appended to these regulations; (g) “medical qualification” means Diploma, undergraduate Degree, postgraduate Degree, super - specialty in Homoeopathy o r any other such qualification as recommended by the Board in Homoeopathy medical systems awarded by approved Medical Institutions or Universities, as the case may be; (2) Words and expressions used herein and not defined but defined in the Act shall hav e the meanings respectively assigned to them in the Act. 3. Recognition of medical qualifications awarded by Universities or medical institutions in India. – (1) The Board shall, for including a medical qualification awarded by Universities or medical ins titutions in India, list and maintain in the following manner, namely: - (i) the list of recognised medical qualification given in Annexure -I shall be displayed on Commission’s web portal ; (ii) while including the recognised medical qualification in the li st, the validity period of such recognition shall be mentioned as specified in Annexure -VII; (iii) the Board shall communicate the details of recognised medical qualification to the respective State or Union territories Medical Councils for Homoeopat hy in the given format as specified in Annexure - VII; (iv) for the purpose of inclusion and listing of medical qualification, a Digital Code shall be generated which shall be a combination of the abbreviated name of the State or Union territory, Universit y code, medical institution code followed by qualification abbreviation code and amendments, if any, wherein, - (a) State or Union territory shall be denoted by the abbreviated name of the State or Union territory as the case may be, in which the University is located as specified in Annexure -II; (b) University shall be denoted by the abbreviated name of the University, in which the medical institution is affiliated as specified in Annexure -III; (c) medical institution shall be denoted by the abbreviated name of the me dical institution, as allotted by the Commission as specified in Annexure -IV; (d) medical qualification Codes shall denote qualifications as specified in Annexure -V. (2) The Board shall list and maintain all medical qualifications recognised and included in t he Second Schedule to the Homoeopathy Central Council Act, 1973 (59 of 1973) as specified in Annexure - VI and the list shall be displayed on Commission’s web portal. (3) The Board shall list and maintain all medical qualifications as specified in Annexure - VII and these medical qualifications shall be recognised medical qualification for the purposes of the Act . (4) All the Universities or medical institutions after the notification of this regulation shall apply for further continuation of recognition of the qualification in the medical qualification recognition list in the prescribed Form A or Form B as the case may be, in the manner and procedure as mentioned in regulation 4. (5) The Board may inspect or appoint inspectors to inspect the University or medical institution if required before deciding on grant of recognition of the medical qualification to examine academic training and examinations conducted in medical institution. 4. Examination of application. - (1) For the grant of recognition of medica l qualifications of Homoeopathy, the Board shall examine the following eligibility criteria, namely: - (a) (i) the medical institution or University shall be located in India; (ii) the medical institution or University shall be duly permitted by Commission or Central Government or erstwhile Central Council for Homoeopathy; (iii) nomenclature of medical qualification awarded by medical institution or University shall be approved by the Commission or Central Government or erstwhile Central Council for Homoeopathy; (iv) duration of the Course of medical qualification awarded by medical institution or University shall be such as laid down by the Commission or Central Government or erstwhile Central Council for Homoeopathy; (v) syllabus or curriculum adopted for the Course shall be such as laid down by the Commission or Central Government or erstwhile Central Council for Homoeopathy; (vi) evaluation system for the Course shall be such as laid down by the Commission or Central Government or erstwhile Central Council for Homoeopathy; (b) The details of nomenclature and duration of approved medical qualifications for Homoeopathy shall be provided as specified in Annexure –I. (2) (a) University or medical institution fulfilling the eligibility criteria as specified in s ub-regulation (1), shall submit duly filled application form offline or online addressed to the President, Board, - (i) for undergraduate Course or any other medical qualification in Homoeopathy as recommended by the Board, application shall be submitted as per the given format specified under Form – A within forty -five days of completions of undergraduate internship. (ii) for postgraduate Course application shall be submitted as per the given format specified under Form – B within forty -five days of comple tions of postgraduate Course: Provided that newly established medical institution of undergraduate Course with due approval by Medical Assessment and Rating Board for Homoeopathy or the Central Government, may initiate the process for applying for g rant of recognition of qualification through the degree awarding University, when the students enter internship: Provided further, that if the established medical institution started a new Course or Higher Course in Homoeopathy with due approval by Medical Assessment and Rating Board for Homoeopathy, may initiate the process for applying for grant of recognition of qualification through the degree awarding University, when the students are in final year of the respective course. (b) the Board shall e xamine and process the received applications as per the criteria specified in sub -regulation (1). (c) after processing of the application by the Board, an order either to grant recognition or denial of recognition shall be communicated to the applicant wit hin a period of six months from the date of receipt of such application. (d) in case, the Board finds any deficiency, an opportunity to rectify such deficiency shall be given to the applicant and if the applicant fails to rectify such deficiency, the appl ication shall be rejected and order with the reasons shall be communicated to the applicant. 5. Appeal to the Commission for grant of recognition of medical qualifications. – (1) The applicant whose application under sub - regulation (2) of regulation 4 has been rejected may prefer an appeal against the order to the Commission addressed to the Chairperson, National Commission for Homoeopathy within a period of sixty days from the date of communication of such order. (2) The applicant may appeal offlin e or online in the specified Form -C duly filled for undergraduate Degree Course or postgraduate Degree Course. (3) The Commission shall examine such appeal as per the eligibility criteria as specified in sub - regulation (1) of regulation 4 within a period of two months and if the Commission decides that recognition may be granted to such medical qualification, the Commission may direct the Homoeopathy Education Board to grant recognition and include such qualifications as per sub - regulation (1) of regulat ion 3. (4) In case, if the deficiencies are found then an opportunity to rectify such deficiency shall be given to the appellant and if the appellant fails to rectify such deficiency, the appeal shall be rejected and order with the reasons shall be comm unicated to the appellant. (5) In case of refusal of grant of recognition of medical qualification by the Commission or the Commission fails to decide the appeal within a period of two months, the appellant may prefer second appeal to the Central Governme nt addressed to the Secretary to the Government of India, Ministry of Ayush within a period of thirty days from the date of communication of the order under sub -section (4) or lapse of the said period of two months. (6) The Central Government shall examin e such appeal as per the eligibility criteria as specified in sub - regulation (1) of regulation 4 and if the Central Government decides that recognition may be granted to such medical qualification, the Central Government may direct the Commission to grant recognition and include such qualifications as per sub - regulation (1) of regulation 3. (7) If the Central Government decides that recognition may not be granted to such medical qualification, the Central Government may reject and dispose such appeal: Provided that before rejecting such appeal, if the deficiencies are found then an opportunity to rectify such deficiencies shall be given to the appellant and if the appellant fails to rectify such deficiency, the appeal shall be rejected and order with th e reasons shall be communicated to the appellant. 6. Recognition of medical qualifications of Homoeopathy awarded by medical institutions outside India. – (1) The Board shall list and maintain all qualifications recognised and included in the Third Schedul e to the Homoeopathy Central Council Act, 1973 (59 of 1973) as per Annexure - IX and the list shall be displayed on Commission’s web portal. (2) The Board shall list and maintain all medical qualifications as specified in Annexure - VIII and these medical q ualifications shall be recognised as medical qualifications for the purposes of the Act.
