NATIONAL COMMISSION FOR HOMOEO PATHY NOTIFICATION New Delhi, the 12th March, 2024 F.No. 3-35/2021/NCH/HEB/MSR.C. –In exercise of the powers conferred by sub -section (1) and clauses (r) and (za) of sub-section (2) of Section 55 of the National Commission for Homoeopathy Act, 2020 (15 of 2020) , and in supersession of the Establishment of New Medical College, (Opening of New or Higher Course of Study or Training and Increase of Admissions Capacity by a Medical College) Regulations, 2011, except as respects things done or omitted to be done befo re such supersession the National Commission for Homoeopathy hereby makes the following regulations, namely: - 1. Short title and commencement. - (1) These regulations may be called the Establishment of New Homoeopathic Medical Institution (Opening of New or H igher Course of Study or Training and Increase of Intake Capacity by a Medical Institution), Regulations -2024. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Definitions. - (1) In these regulations, unless the context otherwise requires, - (a) “Act” means the National Commission for Homoeopathy Act, 2020 (15 of 2020); (b) “attached hospital” means a teaching Homoeopathic Collegiate Hospital attached to the medical institution; (c) “Course” means the courses of study in Homoeopa thy, namely: - (i) Bachelor of Homoeopathic Medicine and Surgery, means an Undergraduate qualification in Homoeopathy recognised as per the provisions of the Act; (ii) “Doctor of Medicine in Homoeopathy” means a Post Graduate qualification in Homoeopathy recognised as per the provisions of the Act; (iii) any other course with medical qualification recognised by Homoeopathy Education Board and shall also include trainings or fellowship in Homoeopathy above graduate level. (d) “Form” means a Form annexed to these regulations; (e) “Scheme” means an organised plan of furnishing information about the Colleges or Institution for achieving permission and rating. (2) The words and expression used herein and not defined, but defined in the Act shall have the same meanings as respectively assigned to them in the Act. 3. Permission for establishment of a college, opening of new or higher course of study or training and increase of intake capacity. - Any person intending to establish a medical institution or intending to open a new or higher course of study or training or intending to increase intake capacity in any course of study or training shall follow the procedures and criteria mentioned in regulations 4 to 6 and submit a scheme to the Medical Assessment and Rating Board for Homoeopathy along with an application in the Form specified in regulation 4. 4. Application and Scheme. - (1) Any person intending to establish a medical institution shall submit the scheme along with an application in Form -1 to the President, Medical Assessment and Rating Bo ard for Homoeopathy as per schedule declared by the Medical Assessment and Rating Board for Homoeopathy along with processing fee for assessment as specified in National Commission for Homoeopathy (Assessment and Rating of Medical Institution) Regulations, 2024. (2) Any college intending to open a new or higher course of study or training shall submit the scheme along with an application in Form -2 to the President, Medical Assessment and Rating Board for Homoeopathy as per schedule declared by the Medical A ssessment and Rating Board for Homoeopathy along with processing fee for assessment as specified in National Commission for Homoeopathy (Assessment and Rating of Medical Institution) Regulations, 2024. (3) Any college intending to increase its intake capac ity in any course of study or training of the proposed college shall submit the scheme along with an application in Form -3 to the President, Medical Assessment and Rating Board for Homoeopathy as per schedule declared by the Medical Assessment and R ating Board for Homoeopathy along with processing fee for assessment as specified in National Commission for Homoeopathy (Assessment and Rating of Medical Institution) Regulations, 2024. 5. Eligibility for making an application. - (1) For making an application under sub-regulation (1) of regulation 4, a person or a institute shall be eligible if, - (a) his one of the objectives is to impart quality education about Homoeopathy; (b) has obtained ‘No Objection Certificate’ from the concerned State Governme nt for establishing a new homoeopathic medical institution at the proposed site in Form -4; (c) No objection certificate for opening new medical institution shall be obtained from the Secretary, Department of AYUSH or Health of the state; (d) the No objection certi ficate should clearly specify the academic year of starting of the medical institution and the approved courses; (e) concerned officials from Department of AYUSH or Health should visit the proposed site and verify the required details and accordingly decision for issuing the No objection certificate may be taken; (f) the No Objection Certificate should contain the period of validity not exceeding three years from the date of issuing No objection certificate; (g) has obtained a ‘Consent of Affiliation’ for establishing a new medical institution from a University established under any Central or State statute which shall be valid for two years, in Form -5; (h) has not already admitted students in any class or standard or course or training of the proposed college; (i) owns and manages a functional homoeopathic hospital in accordance with the provisions of the Second Schedule of the National Commission for Homoeopathy (Minimum Essential Standards for Homoeopathic Colleges and Attached Hospitals) Regulations, 2024 from last one year; (j) in a position to provide performance bank guarantee from a Scheduled Bank or Security amount valid for a period equivalent to the duration of course in favour of the National Commission for Homoeopathy, New Delhi ; (k) college with capacity up to hundred seats - Bank guarantee of rupees two crores and fifty lakhs in favour of the National Commission for Homoeopathy which will be refunded without interest after a period equivalent to the duration of course: Provided that it shall not apply to the colleges gover ned by the State Government or Union territory Administration, if they give an undertaking to provide funds in their plan budget regularly till the requisite facilities are fully provided as per the time bound programme indicated by them. (l) is in a position to establish infrastructure and manpower in phased manner in accordance to the provision specified in the National Commission for Homoeopathy (Minimum Essential Standards for Homoeopathic Colleges and Attached Hospitals) Regulations, 2024 from last one yea r. (2) For making an application under sub-regulation (2) of regulation 4, a person or an institute shall be eligible if, - (a) has obtained ‘No Objection Certificate’ from the concerned State Government for opening a new or higher course of study or training in Form -4; (b) No objection certificate for opening new or higher course of study or training shall be obtained from the Secretary, Department of AYUSH or Health of the state. (c) The No objection certificate should clearly specify the academic year of starting of t he new course. Concerned officials from the Department of AYUSH or Health should visit the proposed site and verify the required details and accordingly decision for issuing the No objection certificate may be taken. (d) The No Objection Certificate should con tain the period of validity not exceeding three years from the date of issuing No objection certificate. (e) has obtained a ‘Consent or Continuance of Affiliation’ of the University established under Central or State Statute in Form -5; (f) is able to produce docu mentary evidence in support of additional financial resources, staff, space, equipment and other infrastructure as specified in the National Commission for Homoeopathy (Minimum Essential Standards for Homoeopathic Colleges and Attached Hospitals) Regulatio ns, 2024; (g) is recognised by the Central Government or the Commission for running undergraduate or post-graduate course in Homoeopathy for at least five and a half years and three years respectively; (h) is exempted by the Central government for being owned or m anaged by the Central Government or the State Government from fulfilling the criteria specified in sub -clause (d); (i) the nomenclature of post -graduate degree or course, guide -student ratio shall be as laid down in the National Commission for Homoeopathy (Hom oeopathy Post -Graduate Degree Course - Doctor of Medicine in Homoeopathy), Regulations, 2024; (j) is able to establish infrastructure and manpower in accordance with the provisions of the National Commission for (Homoeopathy Post -Graduate Degree Course - Doctor of Medicine in Homoeopathy), Regulations, 2024; (k) the college provides an undertaking to furnish a bank guarantee or security amount in favor of the National Commission for Homoeopathy, New Delhi, from a Scheduled bank for a period equivalent to the duration of the course for providing additional infrastructure facilities ; (l) post-graduate Course - Bank guarantee of rupees fifty lakh per subject upto seven seats in favor of the National Commission for Homoeopathy which will be refunded without interest after a per iod equivalent to the duration of course: Provided that it shall not apply to the colleges governed by the State Government or Union territory Administration, if they give an undertaking to provide funds in their plan budget regularly till the requisite facilities are fully provided as per the time bound programme indicated by them. (3) For making an application under sub-regulation 3 of regulation 4, a person or a medical institution shall be eligible if, - (a) has obtained ‘No Objection Certificate’ from the concerned State Government for increasing intake capacity of Homoeopathic medical college in Form -4; (b) No Objection Certificate for increasing the intake capacity shall be obtained from the Secretary, Department of AYUSH or Health of the state. (c) The No Objection Certificate should clearly specify the academic year of increasing the intake capacity and the approved courses. (d) Concerned officials from the Department of AYUSH or Health should visit the proposed site and verify all the required details for incre ase in intake capacity and accordingly decision for issuing the No Objection Certificate may be taken. (e) has obtained a ‘Consent or Continuance of Affiliation’ of the University established under Central or State Statute in Form 5; (f) has produced documentary e vidence in support of additional financial resources, staff, space, equipment and other infrastructure as specified in the National Commission for Homoeopathy (Minimum Essential Standards for Homoeopathic Colleges and attached hospitals) Regulations, 2024; (g) has completed a period of five and half years in case of undergraduate course and three years in case of post-graduate course and degree included in the Second Schedule of Homoeopathy Central Council Act or listed in Medical Qualification Recognition List maintained by the National Commission for Homoeopathy; (h) recognised by the Central Government or Commission for running undergraduate or post - graduate or any other recognised course; (i) the maximum number of admissions in undergraduate course does not exceed one hundred ; (j) the ratio of Guide and students is maintained as laid down in the National Commission for Homoeopathy (Homoeopathy Post -Graduate Degree Course - Doctor of Medicine in Homoeopathy), Regulations, 2024; (k) college provides a bank guarantee or securit y amount in favor of the National Commission for Homoeopathy, New Delhi, from a Scheduled bank for additional infrastructure facilities for each course or discipline as follows: - (i) Post-graduate Course per seat- Bank guarantee of rupees five lakh. (ii) For under graduate course, Bank guarantee of rupees four lakhs per ten seats but limited up to one hundred seats only. provided that it shall not apply to the colleges governed by the State Governmen t or Union territory Administration, if they give an undertaking to provide fund s in their plan budget regularly till the requisite facilities are fully provided as pe r the time boun d programm e indicate d by them. (4) The annual intake capacity in post -graduate course shall be maximum ten seats but first permission shall be granted for maximum seven seats in a specialty subject. A medical institution may apply for increase in intake capacity above sixty in undergraduate course or above seven in post -graduate course or starting of post-graduate course only after completi on of first batch of its undergraduate course or post -graduate course, as the case may be. 6. Requirement of land. - (a) The total built up area required for adequate infrastructure including medical institution, hospital and other infrastructure required under these regulations is made available in a single piece of land, not less than 3.5 acres, in rural areas, or 2.5 acres in urban and hilly areas. The plot, if separated by a road or canal or rivulet but connected with a bridge, will be treated as one piece of land. A certificate from the Jila panchayat or local municipal authority certifying or approving the construction plan of the proposed buildings having the required construction area as per the First Schedule and the Second Schedule of the National Commission for Homoeopathy (Minimum Essential Standards for Homoeopathic Colleges and Attached Hospitals) Regulations, 2024, which can be accommodated in the piece of land, must be provided at the time of applying for permission of the Commission. (b) Ther e can be a separate building or interconnected building for the college and hospital as per the requirements mentioned in the First Schedule and the Second Schedule of the National Commission for Homoeopathy (Minimum Essential Standards for Homoeopathic Co lleges and Attached Hospitals) Regulations, 2024 . The land should be owned by the person or possessed on lease of not less than thirty years or maximum permissible period as per State regulations. Renewal of permission shall, however, must be obtained one year prior to expiry of lease. However, for new college establishments, the land in the name of person can be considered for grant of permission, provided there is a resolution of irrevocable authority for use of land only for homoeopathic medical i nstitution and attached hospital. The resolution so passed shall have to be concurrently submitted to or approved by the registering authority with which applicant is registered. The property shall be exclusively demarcated for homoeopathy educational institution only. (c) Medical institutions shall submit the possession certificate for land from tehsildar while submitting application. (d) The building plan with departmental measurements must be certified by local authority of the Central Government or the State Government after verifying facilities as specified in these regulations. (e) The buildings of the Homoeopathic medical Institute and hospital shall conform to the prevailing building codes and local building byelaws or norms. The hospitals should hav e fire -safety measures, including patient evacuation plans as per local byelaws and regulations. They must also comply with the requirements for providing access and facilities to those who are disabled. The buildings of the institute and hospital shall me et the requirements for the numbers of students to be admitted as specified. 7. Intake capacity .- The application in homoeopathic degree course, namely, Bachelor of Homoeopathic Medicine and Surgery shall be considered up to one hundred seats. 8. PO WER TO CALL FOR INFORMATION AND RETURNS. - (A) THE NATIONAL COM MISSION FOR HOMOEOPATHY AND ITS AUTONOMOUS BOARD S SHALL HAVE THE POW ER TO CALL FOR SUCH INFORMATION AND RETURNS AS IT MAY DE EM FIT. THE UNIVERSI TY AND MEDICAL INSTITUTION SHALL FU RNISH THE SAID INFORMATION AS REQUI RED BY THE NATIONAL COMMISSION FOR HOMOEOPATHY: Provided that if the medical institution fails to provide the information and return to Commission within time - limit as notified by the Commission from time to time, the Commission shall recommend for action against the medical institution under clause (f) of sub -section (1) of section 28 of the Act assuming that the medical institution is not complying with the provisions of regulation. (b) Every medical institution shall provide all neces sary information, documents and records to the inspectors appointed by the Medical Assessment and Rating Board or Commission to discharge their functions demanded by them during the inspection or assessment. 9. Failure to comply. - If any medical institutio n and attached hospital fails to comply with minimum essential standards, the Commission shall recommend for action against such institutions or hospitals under clause (f) of sub - section (1) of section 28 of the Act . 10. REQUIREMENT OF MEDICAL INSTITUTION AND ATTACHED HOSPITAL .- (A) EVERY MEDICAL INSTITUTION SHALL HAVE THE REQUI RED AREAS, INFRASTRU CTURE, STAFFS, EQUIPMENT AS MENTIONED IN THE FIR ST SCHEDULE AND ATTA CHED HOSPITAL SHALL HAVE THE REQUIRED AR EAS, INFRASTRUCTURE, STAFFS AND EQUIPMENT AS GIVEN IN THE SECOND SCHEDULE, AND QUALIFICATION OF THE STAFF MENTIONED IN THE THIRD SCHEDULE OF THE NATI ONAL COMMISSION FOR HOMOEOPATHY (MINIMUM ESSENTIAL STANDARDS FOR HOMOEO PATHIC COLLEGES AND ATTACHED HOSPITALS) REGULATIONS, 2024. (b) However, all the existing medical institutions with intake capacity of one hundred seats, established prior to the date of notification of these regulations, shall fulfill the requirements of built up or constructed area, as laid down in these regulations within a period of five ye ars from the date of notification of these regulations. (c) All the existing medical institutions with intake capacity of one hundred seats, established prior to date of notification of these regulations, shall fulfill the specified department wise require ments, as laid down in these regulations within a period of one year from the date of notification of these regulations. 11. Requirements of the Homoeopathic medical institution. - (1) General - (a) The medical institution shall provide adequate built -up spa ce to accommodate various teaching areas (both in the medical institution and the attached hospital), library, administrative areas, rooms for teaching and non -teaching staff, student amenities, and other provisions as specified in various sections of the First Schedule of the National Commission for Homoeopathy (Minimum Essential Standards for Homoeopathic Colleges and Attached Hospitals) Regulations, 2024. (b) Every medical institution shall have the attached hospital and hostel facility for the students and interns, with or without the residential area for faculty and other staff of medical institution or hospital. Provided that medical college shall follow the ratio of hundred Bachelor of Homoeopathic Medicine and Surgery seats for ten lakh population in that State Government or Union territory Administration. (2) COLLEGE COUNCIL. – (A) EVERY MEDICAL IN STITUTION SHALL HAVE A COLLEGE COUNCIL COMPRISING O F THE HEAD OF ALL THE DEPARTMENTS OR FACULTY SPECIFIED FOR MEDICAL EDUCATION TECHNOLOGY UNIT AS MEMBERS AND PRINCIPAL OR DIRECTOR AS CHAIRPERSON. (b) The council shall meet at least four times in a year to draw up the details of curriculum and training programme, enforcement of discipline and other academic matters. Minutes of all the meetings shall be maint ained properly. (c) The council shall also organize inter-departmental meetings like grand rounds, statistical meetings and clinical meetings including periodical research review in the institution regularly. (3) Phase wise specific requirement of new medi cal institutions. - A homoeopathic medical institution seeking permission for starting Bachelor of Homoeopathic Medicine and Surgery course under sub -section (1) of 29 shall establish infrastructure and manpower in phased manner as per the provision and Sch edules (Schedule in this sub -regulation correspond to the National Commission for Homoeopathy (Minimum Essential Standards for Homoeopathic Colleges and attached hospitals) Regulations, 2024, mentioned below: (i) Before the admission of the first batch of students, the medical institution shall have - (a) at the time of submission of application, there should be a fully developed hospital building with functional homoeopathic hospital at least for one year before the date of making application; having appropriate nu mber of beds, bed occupancy and Out Patient Department attendance corresponding to the annual students intake capacity specified in sub -regulation (A) & sub -regulation (B) of regulation (10) in the land earmarked for college and attached hospital as per the Second Schedule. (b) all teachers with the requisite qualifications as specified in the First Schedule and the Third Schedule required for first professional year teaching should be available. (c) At least one specialist doctor or clinical teacher, each of Surg ery, Gynecology and Obstetrics and Practice of Medicine departments as specified in the Second Schedule, appointed for operating the hospital. (d) A library with three thousand books, seating capacity of one hundred students and two librarian and peon. (e) A prope rly furnished and well equipped two lecture halls, teaching departments, laboratories and museums, essential for the first professional year teaching as specified in the First Schedule. (f) A medicinal plants garden covering five hundred square meters of land with plantation of at least hundred species of medicinal plants in premises. (g) Hundred percent of paramedical, supporting and other hospital staff on the posts sanctioned for the purpose, on regular or contractual basis as specified in the First Schedule and the Second Schedule. (h) Assured round the clock availability of medical services including medicines, doctors and emergency management in the hospital. (i) Fully functional pharmacy. (ii) The medical institution shall be visited at least s i x months before the admissi on of the Second batch of students and at that time the institution shall have - (a) All teachers with the requisite qualification as specified in the First Schedule and the Third Schedule and non-teaching staff required for the first and the second professiona l years teaching and training should be appointed; (b) a library with three thousand books; (c) A properly furnished and well -equipped three lecture halls, teaching departments, laboratories and museums, essential for first and second professional years teaching as specified in the First Schedule. (iii) The medical institution shall be visited at least six months before the admission of third batch of students and that time the institutions shall have — (a) All teachers with the requisite qualification as prescribed in the Fi rst Schedule and the Third Schedule and non-teaching staff required for the first, second and third professional year teaching and training should be appointed; (b) A properly furnished and well equipped four lecture halls, teaching departments, laboratories a nd museums, essential for first, second and third professional years teaching as specified in the First Schedule. (iv) The medical institution shall be visited at least six months before the admission of the fourth batch of students, the institution shall have - (a) All teachers with the requisite qualification as prescribed in the First Schedule and the Third Schedule in the concerned subject and non -teaching staff required for the first, second, third, and fourth professional years teaching and training; (b) Fully functional laboratories. (v) List of equipment, machinery, etc. To ensure proper provision of teaching and training material to the students, the medical institution shall possess all the required equipment, machinery etc., in the teaching departments, hospital, laboratories and dissection hall, library, pharmacy and other units of the institution in sufficient numbers, as specified under the First Schedule and the Second Schedule.
