The Ministry of Road Transport and Highways issued S.O. 4961(E), notification dated 13th November 2024 (published 19th November 2024), recounting that under earlier notifications S.O. 393(E) dated 12th May 1998 and S.O. 1097(E) dated 4th August 2005, issued under section 11 of the National Highways Authority of India Act, 1988 (68 of 1988), the Central Government had entrusted to the National Highways Authority of India (NHAI) the Chennai Bypass Phase-I stretch (from km 27.800 of NH-45/new NH-32 to km 13.800 of NH-4/new NH-48) and Chennai Bypass Phase-II stretch (from km 13.800 of NH-4/new NH-48 to km 12.600 of NH-5/new NH-16), Tamil Nadu; now, in exercise of powers under section 7 of the National Highways Act, 1956 (48 of 1956) read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008, and in supersession of notification S.O. 2342(E) dated 26th July 2017, the Central Government levies fees at base rates for the base year 2007-08 (Table-1, ranging from Rs.0.65/km for cars to Rs.4.20/km for oversized vehicles) applicable to the four-lane bypass stretches totalling 43.10 km equivalent length (28.290 km of bypass road at 150% of base rate, plus 4.31 km equivalent length from structures over 60m using a 10x equalisation factor at 100% of base rate), payable at two fee plazas: Km 6.500 near Tiruneermalai, Chengalpattu District (18.375 km chargeable, Chennai Bypass Phase-I) and Km 28.600 near Surapattu, Tiruvallur District (9.915 km chargeable, Chennai Bypass Phase-II); NHAI is authorised to collect the fees either directly or through a contractor. NH-16) (Chennai Bypass) in the State of Tamil Nadu to the National Highways Authority of India (hereinafter referred to as the Authority); Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 and amended from time to time (hereinafter referred to as the "said Rules"), and in supersession of the notification number S.O. 2342 (E) dated 26.07.2017, except as respects things done or omitted to be done before such supersession, the Central Government hereby levies the fee at the base rate specified in column (2) of the Table 1 for equivalent structure length (having length more than 60 metre) of 43.10 kilometre (having length of 4.31 kilometre, Table-3) and at one and one half times the base rate for bypasses having length of 28.290 kilometre (Table-2) costing rupees ten crore or more on the type of vehicles specified in column (1) of the Table 1 below for the use of four lane stretch taking off from km 29.151 of NH-45 ( new No.NH-32) and joining at km 13.800 of NH-4 (new No.NH-48) (Chennai Bypass Phase-I) and taking off from km 13.800 of NH-4 (new no. NH-48) and joining at km 12.600 of NH-5 (new no. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometres from the fee plaza is Rs 340.000 (Rupees Three Hundred and Forty Only) for the year 2024-25 and is subject to revision every year as per the provisions of the said rules. 4. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the specified rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles. 6. The driver or owner or a person in charge of a mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collecting agency, equal to the fee specified in sub-rule 1A of rule 10 of the said rules, and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle. 7. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road, etc. shall be as per definitions specified in the said rules. 8. The fee rates shall be displayed for information of the users in accordance with rule 12 of the said rules. 9. Based on the base rate of fee per kilometer for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper in English and vernacular language. 10. The capital cost of the project is Rupees 958.95 Crores. [The capital cost is subject to variation as the activities of land acquisition, utility shifting, tree cutting etc. are yet to be completed].
