A new proviso is inserted in regulation 4(7) to exclude time taken by the Commitment Applicant or any other party for furnishing information, clarification, or response from the stipulated period, and to resume inquiry under section 26 of the Act if commitment proceedings are not concluded within this adjusted period. Regulation 5(2) is amended by omitting the words "filed by the concerned parties" and modifying clause (a) to replace "the concerned party and its" with "such person and their". Furthermore, regulations 9, 11(3), 13(1), 13(2), 14(1), and the proviso to 14(1) are updated to substitute references to the "CCI (General) Regulations, 2009" with "CCI (General) Regulations, 2024", with specific regulation number changes in 11(3) (35 to 36) and 14(1) (37 and 50 to 38 and 51). The regulations come into force on their publication date in the Official Gazette.

L.-33004/99 The Gazette of India CG-DL-E-19082026-275557 EXTRAORDINARY PART III—Section 4 PUBLISHED BY AUTHORITY No. 514] NEW DELHI, TUESDAY, AUGUST 18, 2026/SHRAVAN 27, 1948 THE COMPETITION COMMISSION OF INDIA NOTIFICATION New Delhi, the 18th August, 2026 Competition Commission of India (Commitment) Amendment Regulations, 2026 (No. 01 of 2026) No. CCI/Reg-C.R. (Amdt.)/2026.— In exercise of the powers conferred by sections 36 and 64 of the Competition Act, 2002 (12 of 2003), the Competition Commission of India hereby makes the following regulations to further amend the Competition Commission of India (Commitment) Regulations, 2024, namely:— 1. Short title and commencement. (1) These regulations may be called the Competition Commission of India (Commitment) Amendment Regulations,2026. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Competition Commission of India (Commitment) Regulations, 2024, in regulation 3, in sub-regulation (3), the words "45 (forty-five)" shall be substituted with the words "60 (sixty)". 3. In the Competition Commission of India (Commitment) Regulations, 2024, in regulation 3, in sub-regulation (4), the words "the Commitment Applicant may be asked to remove such defect(s) or furnish the required information including document(s). The Commitment Applicant shall rectify such defects or furnish the required information including document(s) within ten (10) working days of the receipt of communication or such other period as may be specified by the Commission, failing which the Commitment Application may be treated as invalid" shall be substituted by the following sub-clauses, namely: "(a) the same shall be returned to the applicant, indicating the defects or deficiencies to be rectified. (b) the applicant shall, within ten (10) working days from the date of receipt of such communication, refile the application after curing the defects and ensuring compliance with these regulations (c) the fee paid for the original application shall be adjusted against the fee payable upon refiling in accordance with regulation 3(4)(b) (d) In case of failure to remove the defects, within the time as specified in regulation 3 (4) (b), the Commitment Application shall be considered invalid". 4. In the Competition Commission of India (Commitment) Regulations, 2024, in regulation 4, in sub-regulation (1), the word "7 (seven)” shall be substituted with the word "15 (fifteen)". 5. In the Competition Commission of India (Commitment) Regulations, 2024, in regulation 4, in sub-regulation (7), the words "130 (one hundred and thirty)" shall be substituted with the words “180 (one hundred and eighty)". 6. In the Competition Commission of India (Commitment) Regulations, 2024, in regulation 4, in sub-regulation (7), before the existing proviso, the following proviso shall be inserted: "Provided that, for the purpose of computing the said period, any time taken or extension availed by the Commitment Applicant or any other party in furnishing the requisite information, clarification, or response shall stand excluded. In case the commitment proceedings are not concluded within the stipulated period, after excluding such time, the inquiry under section 26 of the Act against the Commitment Applicant shall stand resumed." 7. In the Competition Commission of India (Commitment) Regulations, 2024, in regulation 4, in the existing proviso to sub-regulation (7), after the word “Provided", the word "further” shall be inserted. 8. In the Competition Commission of India (Commitment) Regulations, 2024, in regulation 4, in the existing proviso to sub-regulation (7), the words "130 (one hundred and thirty)" shall be substituted with the words "180 (one hundred and eighty)". 9. In the Competition Commission of India (Commitment) Regulations, 2024, in regulation 5, in sub-regulation (2), the words "filed by the concerned parties" shall be omitted. 10. In the Competition Commission of India (Commitment) Regulations, 2024, in Regulation 5, in sub-regulation (2), in clause (a), the words “the concerned party and its" shall be substituted by the words “such person and their” 11. In the Competition Commission of India (Commitment) Regulations, 2024, in regulation 9, the words "CCI (General) Regulations, 2009" shall be substituted by the words “CCI (General) Regulations, 2024". 12. In the Competition Commission of India (Commitment) Regulations, 2024, in regulation 11, in sub-regulation (3), the words "regulation 35 of the CCI (General) Regulations, 2009” shall be substituted by the words “regulation 36 of the CCI (General) Regulations, 2024". 13. In the Competition Commission of India (Commitment) Regulations, 2024, in regulation 13, in sub-regulation (1), the words "CCI (General) Regulations, 2009" shall be substituted by the words “CCI (General) Regulations, 2024". 14. In the Competition Commission of India (Commitment) Regulations, 2024, in regulation 13, in sub-regulation (2), the words "CCI (General) Regulations, 2009" shall be substituted by the words “CCI (General) Regulations, 2024". 15. In the Competition Commission of India (Commitment) Regulations, 2024, in regulation 14, in sub-regulation (1), the words “regulation 37 and regulation 50 of the CCI (General) Regulations, 2009” shall be substituted by the words "regulation 38 and regulation 51 of the CCI (General) Regulations, 2024”. 16. In the Competition Commission of India (Commitment) Regulations, 2024, in regulation 14, in the proviso to sub-regulation (1), the words "regulation 35 of the CCI (General) Regulations, 2009" shall be substituted by the words "regulation 36 of the CCI (General) Regulations, 2024".
