Core Purpose

The Central Government proposes draft rules, titled the Drugs (... Amendment) Rules, 2025, to amend Schedule K of the Drugs Rules, 1945, concerning the exemption conditions for liquid antiseptics, and invites public objections and suggestions.

Detailed Summary

The Ministry of Health and Family Welfare (Department of Health and Family Welfare) issued G.S.R. 759(E) on October 16, 2025, publishing draft rules under sections 12 and 33 of the Drugs and Cosmetics Act, 1940 (23 of 1940), after consulting the Drugs Technical Advisory Board. These draft rules, titled the Drugs (... Amendment) Rules, 2025, propose to amend the Drugs Rules, 1945, specifically by substituting Serial No. 39 in Schedule K. The amendment introduces new exemptions and conditions for 'Liquid Antiseptics for household use' (new entry 39) and 'Liquid Antiseptics for Hospital and other than household use' (new entry 39A) from the sale license requirements of Chapter IV of the Act. For household use antiseptics, conditions include manufacture by licensed entities, absence of Schedule G, H, H1, or X substances, sale in original unopened containers, and labeling with 'For household use'. For hospital and non-household use antiseptics, similar conditions apply, with an additional requirement for purchase from a licensed wholesaler or manufacturer and labeling with 'For hospital and other than household use'. The Central Government invites objections and suggestions from affected persons within thirty days of the Gazette's public availability, to be addressed to the Director (Drugs regulation) at the Ministry or via email at drugsdiv-mohfw@gov.in. The principal Drugs Rules, 1945, were originally published vide notification No. F. 28-10/45-H(1) dated 21st December, 1945.
