Short title and commencement. -(1) These rules may be called the Ministry of Road Transport and Highways (Group C Posts) Recruitme nt Rules, 2023. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Application. -These rules shall apply to the posts specified in column (1) of the Schedule annexed to these rules. 3. Numbe r of posts, classification, Level in pay matrix. -The number of said posts, their classification and the scale of pay matrix attached thereto, shall be as specified in columns (2) to (4) of the said Schedule. 4. Method of recruitment, age -limit, qualif ications, etc. -The method of recruitment age -limit, qualifications and other matters relating to the said posts shall be as specified in columns (5) to (13) of the aforesaid Schedule. 5. Disqualification. - No person, — (a) who has entered into or contracte d a marriage with a person having a spouse livin g; (b) who, having a spouse living, has entered into or contracted a marriage with any person, Shall be eligible for appointment to the said posts: Provided that the Central Government may, if satisfie d that such marriage is permissible under the pe rsonal law applicable to such person and other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule. 6. Power to relax. - Where the Central Government is of the opinion that it is necess ary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons or posts. 7. Savings. - Nothing in these rules shall affect reservation, relaxation of age -limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex -servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard. Deputation or absorption: From amongst officials of the Central Government: (i)holding analogous post on a r egular basis; or (ii)with 8 years regular service in the grade of Lower Div ision Clerk or equivalent. Note 1: The period of deputation including period of deputation held against another ex -cadre post immediately preceding this appointment in the same or some other organisation or department of the central government shall ordina rily not exceed three years. Note 2: Departmental candidates who are in direct line of promotion shall not be considered for deputation. Similarly, deputationist shall not be el igible for consideration by promotion. (ii)10% of the vacancies shall be filled from amongst the Group ‘C’ Staff in the pay Level -1 and who possess 12th Class pass or equivalent qualification and have rendered 3 years regular service in the grade, on the basis of department qualifying examination. The maximum age limit for eligibility for examination is 45 years . (50 years of age for the SC or ST). Note : If more of such employees than the number o f vacancies available under Clause (ii) qualified at the examination, such excess number of employees shall be considered for filling the vacancies arising in the subs equent years so that the employees qualifying at an earlier examination are considered be fore those who qualify at a later examination. As stated under Column (10) (iii)5% of the vacancies shall be filled on seniority -cum-fitness basis from Group ‘C’ employees who have 3 years regular service in posts with pay Level -1.
