L.-33004/99 The Gazette of India CG-DL-E-18062026-273590 EXTRAORDINARY PART II—Section 3—Sub-section (i) PUBLISHED BY AUTHORITY No. 443] NEW DELHI, THURSDAY, JUNE 18, 2026/JYAISTHA 28, 1948 MINISTRY OF COMMUNICATIONS (Department of Telecommunications) NOTIFICATION New Delhi, the 17th June, 2026 G.S.R. 494(E).—The following draft rules, which the Central Government proposes to make in exercise of the powers conferred by sub-section (3) of section 4 and sub-section (2) of section 8 read with sub-section (1) and clauses (g) and (m) to sub-section (2) of section 56 of the Telecommunications Act, 2023 (44 of 2023), are hereby published for the information of all persons likely to be affected thereby and notice is hereby given that the said draft rules shall be taken into consideration after expiry of a period of thirty days from the date on which copies of this notification as published in the Official Gazette, are made available to the public: Objections or suggestions, if any, may be addressed to the Joint Secretary (Telecommunications), Department of Telecommunications, Ministry of Communications, Government of India, Sanchar Bhawan, 20, Ashoka Road, New Delhi- 110001: The objection or suggestion which may be received from any person with respect to the said draft rules before the expiry of the aforesaid period shall be taken into consideration by the Central Government. CHAPTER I PRELIMINARY 1. Short title and commencement.—(1) These rules may be called the Telecommunications (Spectrum Assignment by Administrative Process) Rules, 2026. (2) They shall come into force on such date as the Central Government may specify by notification in the Official Gazette. 2. Definitions.—(1) In these rules, unless the context otherwise requires,— (a) “Act” means the Telecommunications Act, 2023 (44 of 2023); (b) “letter of intent” means the letter issued under sub-rule (1) of rule 6; (c) “portal” means the portal referred to in rule 14; (d) “spectrum assignment” means the permission issued under sub-rule (4) of rule 6, for use of spectrum by a radio station; and (e) “spectrum charge” means the spectrum fees and the fees for the radio station or radio equipment, specified in the relevant annexure to Schedule II. (2) Words and expressions used in these rules and not defined herein but defined in the Act, the rules made thereunder or the National Frequency Allocation Plan published by the Central Government shall have the meanings respectively assigned to them in the Act, the said rules or the said plan. 3. Scope and applicability.—(1) These rules prescribe the terms and conditions of spectrum assignment by administrative process, in respect of the entries listed in the First Schedule to the Act. (2) Schedule I to these rules specifies persons who may apply for spectrum assignment by administrative process in respect of entries of the First Schedule to the Act, the specific usages for such entries, along with the annexures of Schedule II applicable to such entries, and Schedule II to these rules and the annexures thereto specify terms and conditions of spectrum assignment that are specific to each annexure, and methodology for determination of spectrum charges. 4. Eligibility Conditions.—(1) Any person applying for spectrum assignment under these rules shall meet the eligibility criteria specified in this rule and in the relevant entry of Schedule I. (2) If the person applying for spectrum assignment is a person other than the Central Government, State Government, agency designated by such government, a statutory body established under law, then it shall satisfy the following eligibility criteria, namely:— (a) If such person is a company, the foreign direct investment, if any, in such company, shall be in conformity with the extant laws and policies of India; and (b) If such person is a company, the key managerial personnel in such company shall fulfil such security related criteria as the Central Government may specify on the portal. Explanation.—For the purposes of these rules, the expression— (a) “licence” means a licence, registration or permission, by whatever name called, granted under the Indian Telegraph Act, 1885 (13 of 1885); and (b) “foreign direct investment” shall have the same meaning as is assigned to it in the rules made in respect of non-debt instruments under the Foreign Exchange Management Act, 1999 (42 of 1999). (3) The persons specified under sub-rules (1) to (2) shall also comply with any other criteria as may be specified by the Central Government on the portal for the purposes of spectrum assignment under the relevant entry of the First Schedule to the Act. CHAPTER II APPLICATION AND GRANT OF SPECTRUM ASSIGNMENT 5. Application.—(1) Any person intending to obtain spectrum assignment under these rules shall submit an application, in such form and manner and accompanied by payment of non-refundable application fees of one thousand rupees and such information and documents as the Central Government may specify on the portal, including— (a) specified usage of spectrum; (b) type of authorisation or licence held by the applicant, if applicable; (c) proof of successful demonstration of the lawful interception systems, lawful interception monitoring facilities and any other additional functional requirement that the Central Government may specify, if applicable; (d) the geographical area of operation; (e) estimated type and quantity of radio equipment required, along with technical data sheet of such equipment; (f) frequency range and transmission parameters, including bandwidth, mode, emission designator, transmit power, EIRP levels required for usage of spectrum, and the information of the satellite network used, along with its orbital parameters and radiocommunication service, if applicable; (g) proposed duration for which spectrum assignment is sought; and (h) permissions under applicable law, relevant to the sector for which assignment is sought, if applicable. Provided that where such equipment is equipment that blocks telecommunication, the person seeking assignment in respect of the same shall, along with such application, submit the permission obtained under section 48 of the Act. (2) If the applicant under sub-rule (1) intends to install radio equipment at a fixed site, it shall apply to obtain the applicable clearance, in such form and manner along with applicable fees, as the Central Government may specify on the portal: Provided that if the Central Government rejects the application under this sub-rule, the applicant may apply afresh for such clearance, specifying an alternate site for installation of radio equipment: Provided further that applicants seeking spectrum assignment in respect of the following entries of the First Schedule to the Act may apply for such clearance after the grant of spectrum assignment, namely:— (a) Entry 1: National security and defence; (b) Entry 2: Law enforcement and crime prevention; (c) Entry 11: Public Mobile Radio Trunking Services; (d) Entry 12: Radio backhaul for telecommunication services; and (e) Entry 18: Bharat Sanchar Nigam Limited (BSNL) and Mahanagar Telephone Nigam Limited (MTNL). Explanation.—For removal of doubts, it is clarified that there shall be no installation of radio equipment at a fixed site without obtaining prior applicable clearance under sub-rule (2). 6. Grant of spectrum assignment.—(1) The Central Government shall, after making such inquiry as it deems fit, require the applicant to furnish such information as it may call for and may, subject to obtaining the applicable clearance under sub-rule (3) of rule 5, and subject to the availability of spectrum and relevant security clearances, where applicable, issue a letter of intent: Provided that the Central Government may, in public interest, issue a letter of intent prior to obtaining such applicable clearance, in respect of entries of the First Schedule to the Act other than those specified in the second proviso of sub-rule (3) of rule 5. (2) The letter of intent issued under sub-rule (1) shall specify the following, namely:— (a) The relevant entry of First Schedule to the Act and specific usages of spectrum assignment, along with the applicable annexures of Schedule II; (b) Applicable spectrum charges and timelines for payment of such charges; (c) Frequency range and transmission parameters, including bandwidth, mode, emission designator, transmit power, EIRP levels required for usage of spectrum, and the information of the satellite network used, along with its orbital parameters and radiocommunication service, if applicable; (d) Geographical area of operation; (e) Relevant radio stations and location of such stations; and (f) Type and quantity of radio equipment. (3) The recipient of the letter of intent shall, within the timelines as specified in such letter,— (a) make payment of the component of spectrum charges as specified in such letter; and (b) procure the relevant radio equipment. (4) On being satisfied that the requirements specified in the letter of intent are fulfilled by the applicant, the Central Government shall grant spectrum assignment through the portal, specifying, among other things, the following, namely:— (a) details as specified in the letter of intent; and (b) effective date and duration of spectrum assignment. Provided that if the Central Government has issued a letter of intent prior to obtaining the applicable clearance for the installation of radio equipment, the spectrum assignment shall be granted, after such clearance has been obtained. Explanation.— For the removal of doubts, it is clarified that if the duration for which spectrum assignment is granted is less than a period of one calendar month, the spectrum charges for the entire calendar month shall apply. (5) An assignee may possess radio equipment as specified in its spectrum assignment, without requiring a separate authorisation under clause (c) of sub-section (1) of section 3 of the Act. (6) The Central Government may specify on the portal, the maximum duration of spectrum assignment and limits on the number of spectrum assignments that may be granted under these rules in respect of one or more entries of the First Schedule to the Act. 7. General terms and conditions.— An assignee shall adhere to the following terms and conditions, namely:— (a) Maintain an updated inventory of permitted radio equipment and ensure its secure custody and operation only by authorised personnel; (b) Adhere to the eligibility conditions specified in rule 4 throughout the duration of spectrum assignment; (c) Ensure that its radio stations are operated only for the specific usages for which spectrum assignment has been granted; (d) Take all necessary measures to ensure that its telecommunication network shall not cause interference to other permitted telecommunication network; (e) Not connect its telecommunication network with public telecommunication networks including public switched telephone network, public land mobile network, global mobile personal communication by satellite, or internet, unless permitted by Central Government; (f) Ensure that its telecommunication network is in conformity with standards, as applicable, that the Central Government may specify, including those notified under section 19 of the Act; (g) Not assign or transfer its spectrum assignment without the prior written approval of the Central Government; (h) Comply with any security-related directions issued by the Central Government in the interest of national security, public safety, sovereignty and integrity of India; (i) Forthwith report any instance of unauthorised access, interception, spoofing, cloning, jamming or other security incident affecting its telecommunication network, on the portal, in such form and manner as may be specified thereon in this behalf; (j) Extend all necessary assistance and cooperation to the Central Government and any agency authorised by it, for— (i) matters relating to misuse, compromise or unlawful operation of its radio equipment; and (ii) monitoring and enforcement, to ensure adherence to terms and conditions of spectrum utilisation and enable interference-free use of the assigned spectrum; and (k) Forthwith report any instance of loss, theft, loss of possession or suspected misuse of its radio equipment, on the portal, in such form and manner as may be specified thereon in this behalf. 8. Modification or variation of terms and conditions of spectrum assignment.—(1) An assignee seeking any change in the particulars of the radio stations, the frequency or any other technical parameters, from those specified in the spectrum assignment, shall submit an application on the portal, along with non-refundable fees of one thousand rupees, in such form as the Central Government may specify on the portal. (2) The Central Government may, upon examination of an application under sub-rule (1) and subject to the availability of spectrum, relevant security clearances where applicable, and payment of applicable spectrum charges, approve such application and grant an updated spectrum assignment. (3) The Central Government may also, suo motu, modify, vary or make technical adjustments to the terms and conditions of assignment, including by making changes to the usage of frequency bands, power or types of emission, if it is satisfied that it is expedient to do so, having regard to— (a) the provisions of the National Frequency Allocation Plan; (b) the need for enforcement of better technical standards to promote efficient spectrum utilisation in respect of equipment; (c) the national and international radio interference mitigation requirements; and (d) any rules in respect of re-farming, harmonisation or optimal utilisation of spectrum, that the Central Government may prescribe. (4) The Central Government shall, pursuant to any modification or variation under sub-rule (3), grant an updated spectrum assignment to the relevant assignee. (5) The assignee shall implement any modification or variation under this rule within the timelines as specified by the Central Government on the portal. (6) Any modification or variation of the spectrum assignment under this rule shall not affect the duration specified in the spectrum assignment originally issued to the assignee. CHAPTER III RENEWAL AND SURRENDER 9. Renewal—(1) An assignee holding spectrum assignment in respect of any entry of the First Schedule to the Act other than entry 18, namely, Bharat Sanchar Nigam Limited (BSNL) and Mahanagar Telephone Nigam Limited (MTNL), may submit an application for renewal of spectrum assignment, at least one month prior to the date of its expiry, in such form and manner and along with such spectrum charges as the Central Government may specify on the portal. (2) On receipt of a written request from an assignee, the Central Government may permit an application after the period specified in sub-rule (1), if it is satisfied that there was sufficient cause for not making such application within such period, subject to payment of such late fees as the Central Government may specify in response to such request. (3) Any application under sub-rule (1) for renewal of spectrum assignment, issued in respect of trial or experimental under entry 19 of the First Schedule to the Act, shall be accompanied by supporting documents evidencing the outcome of such trial or experiment, and the reasons for seeking such renewal. (4) The Central Government may, in its discretion, on receipt of an application under sub-rules (1) or (2), renew the spectrum assignment for such period as may be decided by the Central Government, subject to these rules and adherence to law and policy applicable at the time of such renewal. (5) Spectrum assignment in respect of entry 18 of the First Schedule to the Act, namely, Bharat Sanchar Nigam Limited (BSNL) and Mahanagar Telephone Nigam Limited (MTNL), shall not be eligible for renewal and the relevant assignee may submit a fresh application under rule 5 to obtain spectrum assignment. 10. Surrender of spectrum.—(1) An assignee seeking to surrender spectrum shall submit an application, in such form and manner as the Central Government may specify on the portal, at least thirty days prior to the proposed date of surrender, accompanied by proof of payment of spectrum charges or any other applicable dues payable by it till the date of the application, and such other information in such form as the Central Government may specify on the portal. (2) The Central Government may approve or reject an application under sub-rule (1), and if approved, the effective date of surrender shall be the thirty-first day from the date of receipt of such application, or the proposed date of surrender, whichever is later. (3) After the surrender of spectrum, if the Central Government determines that there are any balance amounts after settlement of all dues payable by the assignee, it may either adjust such amounts pending against other active assignments of the assignee or refund such amount to the assignee. (4) Every assignee surrendering its spectrum under this rule shall pay all amounts due and payable to the Central Government including spectrum charges, payable till the effective date of surrender as referred to in sub-rule (2). (5) Surrender of spectrum in respect of entry 18 of the First Schedule to the Act shall be done in accordance with the Telecommunications (Spectrum Assignment through Auction) Rules, 2026. 11. CHAPTER IV MISCELLANEOUS 12. Powers of Central Government.—(1) The Central Government may specify on the portal the restrictions on use of spectrum by the assignee in restricted areas falling near the international borders of the territory of India, the Line of Control, the Line of Actual Control of India, or any other area as the Central Government may specify on the portal. (2) The Central Government may, for the purpose of giving effect to these rules, issue orders, directions or guidelines not inconsistent with the Act or these rules, which shall constitute the terms and conditions applicable to every assignee. (3) The Central Government may, by notification in the Official Gazette, amend the Schedules to these rules. 13. Breach.—(1) A breach of terms and conditions under these rules by an assignee shall constitute a breach as referred to in section 32 of the Act. (2) The Central Government may, after due consideration of the recommendations received under clause (b) of sub-section (1) of section 32 of the Act and giving an opportunity of being heard to the assignee, issue an order of suspension, revocation or curtailment of spectrum assignment under sub-section (2) of section 32 of the Act. (3) Every order under sub-rule (2) shall be published by the Central Government on the portal, and be effective immediately from the date of publishing of such order: Provided that the suspension of assignment, authorisation or licence shall not be a cause or ground for extension of the duration of the assignment. (4) The assignee shall not be entitled to refund of fees or any other charges paid in respect of an assignment which is the subject matter of suspension, revocation, curtailment, modification or variation. 14. Digital implementation.—The Central Government may, in furtherance of section 53 of the Act, notify one or more portals for the digital implementation of these rules, including publication of any form, manner, order, direction or guideline to be specified under these rules. This annexure shall apply to assignment of spectrum for Land Mobile Service in LF/MF/HF/VHF/UHF bands, having bandwidth up to 375 kHz in respect of entries 1, 2, 4, 5, 6, 7, 8, 9, 10 and 17 of Schedule I. 2. This annexure comprises of the following: (a) Table A1 read with Tables A2 and A3 specifying the annual spectrum fees for fixed-site networks, including: (i) small area applications such as industrial units, factories and municipalities; and (ii) one or more base stations, mobile stations, or any combinations thereof, where area of a district is small enough to be covered by four base or repeater stations; (b) Table B specifying the spectrum fees for UHF Short Range Radio (USR); (c) Table C specifying the annual spectrum fees for Area-based Operation in VHF/UHF band for Land Mobile Stations, including telecommunication network having coverage beyond the fixed-site category, where area users are those which operate over larger area of operations such as: (i) Pan-India users, like: Indian Railways, Defence, Central Paramilitary Forces (CPMFs), oil marketing companies and airports authority; (ii) State-wide users, such as: state police organizations, disaster management authorities, state forest departments, electricity boards and water resources departments; (iii) District-wide users, such as: public transport, district authorities; and (iv) Base stations, mobile stations, and any combination thereof; (d) Table D specifying the annual spectrum fees for Land Mobile Service in LF/MF/HF bands per 3 kHz bandwidth; and (e) Table E specifying the annual radio station fees applicable to Annexure II. (f) Table F specifying the radio equipment fees applicable to equipment that blocks telecommunication. 3. In order to promote efficient use of radio frequencies in respect of assignment of spectrum under this annexure, the following provisions shall apply: (a) The letter of intent issued under rule 5 and spectrum assignment letter issued under rule sub-rule (3) of rule 5, shall specify the frequency range of operation limited to a maximum extent of 10 simplex frequencies or 2 duplex frequencies. (b) An assignee may subsequently, based on its requirements, request for additional frequencies, by submitting an application in the form as specified on the portal, along with justification for the same. (c) Any grant of additional frequencies by the Central Government shall be recorded as a modification of the spectrum assignment letter. 4. The following conditions shall apply for levy of spectrum fees in respect of assignment of spectrum under this annexure: (a) The spectrum fees for LF/MF/HF/VHF bands shall be levied for channel bandwidth and not for the occupied bandwidth. (b) The spectrum fees as specified in Table A1 shall be subject to the following conditions: (i) Half of the fees specified in Table A1 shall apply for bandwidths of 6.25 kHz or less, and for bandwidths greater than 12.5 kHz, the spectrum fees shall be charged in multiples of 12.5 kHz, and any fractional bandwidth shall be rounded up to the next multiple of 12.5 kHz. (ii) In case of a telecommunication network spread across population categories across two locations, i.e., different class of cities, the charging of higher population category shall be applicable. (iii) Annual spectrum fees for frequency assignments that are in the sea (offshore), sub-surface use, such as, tunnel-radio, shall be charged at the minimum charging rate, in the respective band and population category. (iv) If antenna of radio equipment is used indoors or underground or is a down-fire, leaky feeder or radiating cable type, it will fall within Category 1 of the respective band and population category. (v) Annual spectrum fees in Table A1 shall be applicable for the first 10 simplex frequencies or 2 duplex frequencies. (vi) Beyond the quantity of frequencies, an incremental additional charge of 30% higher for the next 5 simplex frequencies or 2 duplex frequencies, and 50% higher charges on number of frequencies exceeding beyond 15 simplex or 4 duplex frequencies shall be applicable. (vii) No spectrum fee shall be applicable for equipment that blocks telecommunication. (b) Public entities that are engaged in Ports and Search and Rescue (SAR) shall be assigned the requested number of frequencies on an exclusive basis. (c) Annual spectrum fees for LF/MF/HF/VHF bands and which exceed 30 MHz, shall be levied for the channel bandwidth and not for the occupied bandwidth. (d) The transmitting frequencies in the VHF maritime mobile band will be in accordance with Appendix 18 of Radio Regulation of ITU-R, as may be updated from time to time. (e) In the frequency band VHF (AIS/ATON2 ), there will be a minimum assignment of two frequencies. 4. The spectrum charges shall not be applicable for frequencies as determined by the Central Government in respect of: (a) Distress Urgency and Safety Communications, and (b) Inter-Ship Safety Communications. Aeronautical Service shall include aeronautical mobile (route) service, aeronautical mobile (off-route) service, and aeronautical radio navigation service, as defined in the NFAP. 3. This annexure comprises of: (a) Table A specifying the annual spectrum fees; and (b) Table B specifying the radio station fees. 4. For the purpose of this annexure – (a) “Aeronautical Mobile Service” or “AMS” means a mobile service between aeronautical stations and aircraft stations, or between aircraft stations, in which survival craft stations may participate; emergency position-indicating radiobeacon stations may also participate in this service on designated distress and emergency frequencies; (b) “Aeronautical Radionavigation Service” or “ARNS” means a radionavigation service intended for the benefit and for the safe operation of aircraft. 5. Assignment of spectrum under this annexure shall be based on the following conditions: (a) Frequency assignments in respect of this annexure shall be made on an exclusive basis. The following condition shall apply to assignment of spectrum under this annexure: (a) The frequency band for Table A and Table B shall be determined based on the necessary bandwidth, in the manner specified in Table C; and (b) The spectrum fees under Table A and Table B shall be calculated based on the necessary bandwidth (20 dB bandwidth) as specified in Table C and shall be independent of the coverage distance. If such information is not contained in the technical details submitted under rule 4, the following formula shall be used: (a) For a non-FM radar: BN = 1.79/√t ∗ tr or 6.36/t ; whichever is less (b) For FM pulse radar: BN = 1.79/√t ∗ tr + 2Bc (c) For FM pulse radar (with frequency hopping): BN = 1.79/√t ∗ tr + 2Bc; (d) For frequency hopping radars using non-FM pulses (including spread spectrum or coded pulses): BN = 1.79/√t ∗ tr + Bs; (e) For FM/CW radars: BN = 2Bd; Where: BN = necessary bandwidth in MHz; Bc = bandwidth of the frequency deviation (the total frequency shift during the pulse duration) in MHz; Bd = bandwidth of the frequency deviation (peak difference between instantaneous frequency of the modulated wave and the carrier frequency for FM/CW radar systems) in MHz; Bs = maximum range in MHz over which the carrier frequency will be shifted for a frequency hopping radar; t = emitted pulse duration in µ sec at 50% amplitude (voltage) points. This annexure shall apply to assignment of spectrum for Satellite based Services (including Fixed Satellite Services (FSS), Broadcasting Satellite Services (BSS), Mobile Satellite Services (MSS) and Earth Exploration Satellite Services (EESS)/ Meteorological Satellite Service) in respect of entries 1, 2, 4, 5, 6, 7, 8, 9, 10, 15, 16(a), 16(b), 16(c), 16(d), 16(e), 16(f)(1) (limited to captive VSAT), 16(g), 16(h) and 17 of Schedule I, and does not apply to Satellite-based Commercial Communication Services. 2. This annexure comprises of: (a) Part I read with Table 1 specifying the spectrum fees; and (b) Part II read with Table 2 specifying the radio station fees for earth stations operating under Satellite Services. 3. For the purpose of this annexure, “IoT” means internet of things, which comprises M2M communication over the internet. Part I: Condition applicable to spectrum fees 1. The spectrum fees shall be payable on the total bandwidth assigned, including any guard bands, and in respect of frequencies transmitted from or into the territory of India. 2. For the purpose of calculation of spectrum fee in respect of Earth Exploration Satellite Service / Meteorological Satellite Service, only one remote terminal shall be taken into account, irrespective of the number of remote users or connections in the telecommunication network. 3. The spectrum fees in respect of Digital Satellite News Gathering (DSNG) /Satellite News Gathering (SNG), shall be payable for the frequencies used on both uplinks and downlinks. 4. In case the same frequency carrier is used from more than one DSNG van of the assignee, the following shall apply: (a) for the first DSNG van, the annual spectrum fees specified in this annexure shall be charged; and (b) for each additional DSNG van, spectrum fee at the rate of 25% of the annual spectrum fee specified in this annexure, shall be charged. Provided that, no spectrum fees shall be charged for such additional DSNG vans, deployed within the same venue. 5. Annual spectrum fees for Space Operation Services )TTC operation) shall be payable at the rate of Rs 1,50,000/- per earth station. 6. The spectrum fees shall not be applicable on remote terminals of data collection platforms, and IoT terminals used for providing location, and other data in MSS. 7. Radio station fees shall not be payable for IoT and IoT devices in Aggregator or Direct-to-Satellite mode. This annexure comprises of: (a) Part A specifying the annual spectrum fees; and (b) Part B specifying the radio station fees. PART A: Annual spectrum fees The assignee shall pay annual spectrum fees by exercising one of the following options: Option 1: Annual Payment of spectrum fees 1. Rs. 1200/- (Rupees One Thousand Two Hundred Only) per annum per 6.25 kHz channel for link distances up to 30 km in the city within the same service area. 2. Rs. 2400/- (Rupees Two Thousand Four Hundred Only) per annum per 6.25 kHz channel for link distances up to 60 km in the city within the same service area. Option 2: One-Time Upfront Payment of spectrum fees One-time upfront payment of spectrum fees for a period of five as follows: 1. Rs. 5,000 (Rupees Five Thousand Only) per 6.25 kHz channel for link distances up to 30 km in the city within the same service area. 2. Rs. 10,000 (Rupees Ten Thousand Only) per 6.25 kHz channel for link distances up to 60 km in the city within the same service area. PART B: Radio station fees The radio station fees shall be one percent of AGR, and shall be payable in accordance with the Telecommunications (Authorisation for provision of Miscellaneous Telecommunication Services) Rules, 2026. Annexure IX: Satellite-based Commercial Communication Services 1. This annexure shall apply to assignment of spectrum for Satellite-based Commercial Communication Services in respect of entries 16(f)(2) (limited to VSAT Commercial) and 16(i) of Schedule I. 2. This annexure shall apply to spectrum assignment for: (a) Bharat Sanchar Nigam Limited (BSNL) and Mahanagar Telephone Nigam Limited (MTNL) in respect of entry 18 of Schedule I; (b) a duration not exceeding three months in respect of entry 4 of Schedule I; and (c) safety and operations of metro and regional rail systems under entry 6 of Schedule I. 2. Assignment of access spectrum through administrative process, in the frequency bands or parts thereof as the Central Government may specify on the portal, as identified for implementation of International Mobile Telecommunication in the National Frequency Allocation Plan, shall be on the basis of market price. Explanation—For the purposes of this Annexure, the expression “market price” shall mean the reserve price or the price of access spectrum, determined through auction held pursuant to the last NIA published prior to the effective date of spectrum assignment, whichever is higher: Provided that where such auction was held more than twelve months prior to the effective date of spectrum assignment, such reserve price or price determined under the auction, as the case may be, shall be arrived at by using the relevant marginal cost of funds based lending rate (MCLR) of the State Bank of India as notified on the website of State Bank of India. Annexure-XII: Testing, trial, experimental, demonstration purposes for enabling implementation of new technologies, including for creation of one or more Regulatory Sandboxes 1. This annexure shall apply to assignment of spectrum for testing, trial, experimental, demonstration purposes for enabling implementation of new technologies, including for creation of one or more Regulatory Sandboxes in respect of entry 19 of Schedule I. 2. The assignee shall, in respect of spectrum assignment under this annexure,— (a) ensure that any testing, trial, experimental, demonstration does not cause interference to any telecommunication equipment, telecommunication network or telecommunication service of any other authorised entity or assignee; and (b) not claim protection from interference caused by any telecommunication equipment, telecommunication network or telecommunication service of any other authorised entity or assignee. Explanation.—In this provision, the expression “interference” shall mean the effect of unwanted energy due to one or a combination of emissions, radiations or induction on reception in a radio communication system, manifested by any performance degradation, misinterpretation or loss of information that could have been extracted in the absence of such unwanted energy. 3. Any assignment of spectrum under this annexure shall be made on a non-interference and non- protection basis, and shall not be used for regular use or for providing telecommunication services to users. 4. The conditions as applicable to assignment of spectrum under this annexure are as follows: (a) Testing: (i) Testing means the temporary conduct of radio frequency tests of wireless telecommunication equipment or systems, including but not limited to product testing, compliance testing, performance testing, field testing, network testing, and regulatory testing, for the purpose of technical evaluation, validation, or certification, and not for commercial operation or delivery of telecommunication services. (ii) The assignment of spectrum in respect of testing shall be made for indoor and outdoor environment, in radiating mode, where EIRP is more than 100 mW. (iii) Testing in indoor and outdoor environment, in radiating mode, where EIRP is less than 100 mW, is exempt from the requirement of assignment of spectrum. (iv) The assignee undertaking testing shall ensure that the associated technologies, products, processes or business models undergoing testing, shall not be made commercially available in the market during the period of such testing. (b) Trial: (i) The assignment of spectrum shall be made for trials, undertaken prior to the commercial launch of telecommunication services, for the purpose of demonstration of technology and capability, product stabilisation, ecosystem development, and other similar purposes. (ii) The assignee undertaking trial shall ensure that the associated technologies, products, processes or business models undergoing trial, shall not be made commercially available in the market during the period of such trial. (iii) On completion of trial, the assignee shall submit a report to the Central Government containing the outcome and creation of any intellectual property rights as a result of such trial. (c) Experimentation: (i) Experimentation means utilisation of radio waves in experiments for the development of science and technology, and for educational purposes. (ii) The assignment of spectrum in respect of experimentation shall be made for indoor and outdoor environment, in radiating mode, where EIRP is more than 100 mW. (iii) Experimentation in indoor and outdoor environment, in radiating mode, where EIRP is less than 100 mW, is exempt from the requirement of assignment of spectrum. (iv) An assignee undertaking experimentation shall ensure that the associated technologies, products, processes or business models undergoing experimentation, shall not be made commercially available in the market during the period of such experimentation. (v) An assignee undertaking experimentation shall ensure that there shall be no communication between the experimental wireless station in India and such similar station located in any country outside India, without the prior approval of the Central Government in this regard. (vi) On completion of experimentation, the assignee shall submit a report to the Central Government containing the outcome and creation of any intellectual property rights as a result of such experiment. (d) Demonstration: (i) Demonstration includes the technical display, exhibition, proof of concept, evaluation, and demonstration for sale, at specified locations, for a limited duration, without the provision of any telecommunication service or without any generation of revenue. (ii) The assignment of spectrum in respect of demonstration shall be made for outdoor environment, in radiating mode, where EIRP is more than 100 mW. (iii) Demonstration in indoor and outdoor environment, in radiating mode, where EIRP is less than 100 mW, is exempt from the requirement of assignment of spectrum. 5.
