Detailed Summary

The Ministry of Road Transport and Highways, through Notification G.S.R. 388(E) dated 17th June, 2025, has exercised powers conferred by section 9 of the National Highways Act, 1956 (48 of 1956), to introduce the National Highways Fee (Determination of Rates and Collection) (Amendment) Rules, 2025. These amendment rules, which come into force on 15th August, 2025, further amend the National Highways Fee (Determination of Rates and Collection) Rules, 2008. Specifically, new sub-rules (3B) and (3C) are inserted after sub-rule (3A) in rule 9. Sub-rule (3B) stipulates that a person owning a mechanical vehicle registered for non-commercial purposes, having a valid and functional Fastag, is eligible to obtain a pass upon payment of rupees three thousand, which shall be valid for one year or for two hundred crossings through any fee plaza on a national highway, whichever is earlier, irrespective of the fee leviable at each fee plaza. It further clarifies that in a closed user fee collection system, entry and exit of a mechanical vehicle through a fee plaza shall be considered as a single crossing. Sub-rule (3C) provides for the annual revision of the fee payable under sub-rule (3B) with effect from 1st April of every year, in accordance with rule 5. The principal rules were originally published via notification number G.S.R. 838 (E) dated 5th December, 2008, and were last amended by notification number G.S.R. 556 (E) dated 9th September, 2024.

(1) These rules may be called the National Highways Fee (Determination of Rates and Collection) (Amendment) Rules, 2025. (2) They shall come into force on the 15th day of August, 2025. 2. In the National Highways Fee (Determination of Rates and Collection) Rules, 2008, in rule 9, after sub-rule (3A), the following sub-rules shall be inserted, namely:— "(3B) A person who owns a mechanical vehicle registered for non-commercial purpose, having a valid and functional Fastag, shall be eligible to obtain a pass on payment of fee of rupees three thousand which shall be valid for one year or for two hundred crossings through any fee plaza on a national highway, whichever is earlier, irrespective of the fee leviable at each fee plaza; Provided that in a closed user fee collection system, entry and exit of a mechanical vehicle through a fee plaza shall be considered as a single crossing.
