By notification S.O. 224(E) dated 17th January 2024, the Ministry of Road Transport and Highways records that pursuant to notification 2075 dated 03/05/2023 (issued under sub-section (1) of section 3A of the National Highway Act, 1956 (48 of 1956)) the Central Government had declared its intention to acquire land for building (widening/four-laning etc.), maintenance, management and operation of NH52 in the stretch from Km. 320.64 to Km. 376 (B-23 near Kamgar Chowk N4 CIDCO Aurangabad), district Aurangabad, state Maharashtra; the substance of that notification was published in “Lokmat” and “Times of India” on 02/06/2023 under sub-section (3) of section 3A; objections filed under section 3-C were considered and settled by the Competent Authority, which submitted its report to the Central Government under sub-section (1) of section 3D; the Central Government, exercising powers under sub-section (1) of section 3D, now declares the land in the Schedule should be acquired, and under sub-section (2) of section 3D declares that on publication the land vests absolutely in the Central Government free from encumbrances; the Schedule lists 0.12 hectares total across three agricultural plots in Taluk Khuldabad -- Survey No. 170 and 175 in Village Verul (owners Golden Farm, a partnership through Sadashiv Murlidhar Bombale, and Shankar Kisan Shelke/Mahadu Kondaji Shelke) and Survey No. 3 in Village Malkapur (owners Aanand Shripatrao Patil and Prafull Premji Patel); filed under F. Whereas by the notification of the Government of India in the Ministry of Road Transport and Highways, 2075 Dated:03/05/2023, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii) issued under sub-section (1) of section 3A of the National Highway Act, 1956 (48 of 1956) (hereinafter referred to as the said Act), the Central Government declared its intension to acquire the land specified in the Schedule annexed to the said notification for building (widening/four-laning, etc.), maintenance, management and operation of NH52 in the stretch of land from Km. 320.64 to Km. 376 (B-23 Near Kamgar Chowk N4 CIDCO Aurangabad) in the district of AURANGABAD in the state of MAHARASHTRA And whereas the substance of the said notification has been published in "Lokmat” and “Times of India" both dated 02/06/2023; under sub-section (3) of section 3A of the said Act; And whereas the Competent Authority has received objections filed under Section 3-C, considered and settled the same appropriately; And whereas, in pursuance of sub-section (1) of section 3D of the said Act, the competent authority has submitted its report to the Central Government; Now, therefore, upon receipt of the said report of the competent authority and in exercise of the powers conferred by the sub-section (1) of section 3D of the said Act, the Central Government hereby declares that the land specified in the said Schedule should be acquired for the aforesaid purpose; And further, in pursuance of sub-section (2) of section 3D of the said Act, the Central Government hereby declares that on publication of this notification in the Official Gazette, the land specified in the said Schedule shall vest absolutely in the Central Government, free from all encumbrances.
