Via S.O. 4504(E) dated 13th October 2023, the Ministry of Road Transport and Highways, referencing prior notification S.O. 2219(E) dated 14th July 2017 (which entrusted NH-544E in Andhra Pradesh to the State Government under section 5 of the National Highways Act, 1956 (48 of 1956)), exercised powers under section 7 of the same Act read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008, to levy user fees for the two-lane paved-shoulder Madakasira to Sira section (design km 56.803 to km 99.179, AP/Karnataka border) of NH-544E: 60% of the Table 1 base rates for the 26.968 km main road section and 90% for bypasses totaling 15.408 km costing Rs. 10 crore or more, and authorized the National Highways Authority of India (NHAI) to collect these fees, directly or through a contractor, at a Fee Plaza at Km 80.400 near Rolla Village, Anantapuramu District. Base-year (2007-08) rates per km range from Rs. 0.65 for cars/jeeps/light motor vehicles to Rs. 4.20 for oversized vehicles (7+ axles). The notification sets a monthly pass fee of Rs. 330 for non-commercial vehicle owners residing within 20 km of the plaza for 2023-24, prescribes discounted multi-journey pass rates, a 50% fee reduction for locally registered commercial vehicles absent an alternative road, and penalty fees under sub-rule 1A of rule 10 for overloaded vehicles. The estimated capital cost of the project is Rs. 185.84 crore, with the fee to be reduced to 40% of rates once NHAI recovers this capital cost through collections, subject to annual revision. Now, th erefore, in exercise of th e powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 (hereinafter referred to as the “rules”), the Centr al Government hereby levie s the fee at 60% of the base rate specified in column (2) of the Table 1 for net road section length of 26.968 km and at 90% of the base rate for bypasses having a length of 15.408 km costing rupees ten crore or more on the type o f vehicles specified in co lumn (1) of the Table 1 below for use of two lane with paved shoulder of Madakasira to Sira section (till AP/Knt/border) from design km 56.803 to km 99.179 of National Highway No. 544E in the State of Andhra Pradesh and authorises the National Highway Auth ority of India to collect, either through its officials or through a contractor, the said fee namely: - Table 1 Category of Vehicle Base Rates of fee per km for the base year 2007 -08 (in Rupees) 1 2 Car, Jeep, Van or Light Motor Vehicle 0.65 Light Comm ercial Vehicle, Light Goods Vehicle or Minibus 1.05 Bus or Truck (2 Axles) 2.20 Three Axle Commercial Vehicles 2.40 Heavy Construction Machinery (HCM) or Earth Moving Equipment (EME) or Multi Axle Vehicle (MAV) (Four to Six Axles) 3.45 Oversized Vehicl es (7 or More Axles) 4.20 1. The rate of monthly pass for a person who owns a mechanical vehicle registered for non -commercial purposes and resides within a distance of twenty kilometers from the fee plaza is Rs.330/ - (Rupees Three Hund red and Thirty only) for the year 2023 -24 and is subject to revision every year as per the provisions of the said rules. 4. For multiple journeys on the highway section, passes shall be issued at the following rates, namely: - Table -4 Amount Payable Maximum n umber of one way journeys allowed Period of val idity One and half times the fee for one way journey Two Twenty -four hours from the time of payment Two-third of amount of the fee payable for fifty single journeys Fifty One month from the date of payment 5. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the specified rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehi cles. 6. The driver or owner or a person in charge of a Mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Hig hway to the fee collecting agency, equal to the fee specified in sub -rule 1A of rule 10 of the said rules, and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle. 7. All definitions in cluding category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road, etc., shall be as per definitions specified in the said rules. 8. The fee rates shall be displayed for information of the users in ac cordance with ru le 12 of the said rules. 9. Based on the Base rate of Fee per km for the base year 2007 -2008 as mentioned in Table -1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Nationa l Highways Autho rity of India on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper, each in English and vernacular language. 10. The e stimated capital cost of the project is Rupees 185.84 Crore (The capital cost is subject to variation as the activities of land acquisition, utility shifting, tree cutting etc). The National Highways Authority of India shall maintain a record of the recove ry of capital co st through user fee realised and after recovery of the capital cost; the fee leviable shall be reduced to 40% of the rates and shall be revised annually in accordance with the said rules.
