Detailed Summary

The Ministry of Road Transport and Highways, by S.O. 3467(E) dated 14th August, 2024, records that pursuant to its earlier notification dated 01/09/2023 issued under sub-section (1) of section 3A of the National Highway Act, 1956 (48 of 1956), the Central Government had declared its intention to acquire land for construction, maintenance, management and operation of NH219 from Km. 0 to Km. 44.6 (District Land Acquisition Officer, Kaimur (Bhabua)) in Kaimur (Bhabua) district, Bihar. The substance of that notification was published in 'Dainik Bhaskar, Patna' on 20.09.2023 and 'Hindustan, Gaya' on 21.09.2023 under sub-section (3) of section 3A. Objections received were considered and disallowed by the Competent Authority, and the Competent Authority submitted its report under sub-section (1) of section 3D. In exercise of powers under sub-section (1) of section 3D, the Central Government declares the land in the annexed Schedule shall be acquired, and under sub-section (2) of section 3D, that the land vests absolutely in the Central Government, free from all encumbrances, upon publication of this notification. The accompanying Schedule lists survey/plot numbers, land type, nature, area, and named owners for land in Taluk Chand, Village Majhgain, Kaimur (Bhabua) district, Bihar, totalling 0.31921 hectares. No. RW/PAT/NH/219/Bhabhua & Chand Bypass/2020/3D] ABHAY JAIN, Director MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 14th August, 2024 S.O. 3467(E).- Whereas by the notification of the Government of India in the Ministry of Road Transport and Highways, 3873 Dated:01/09/2023, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii) issued under sub-section (1) of section 3A of the National Highway Act, 1956 (48 of 1956) (hereinafter referred to as the said Act), the Central Government declared its intention to acquire the land specified in the Schedule annexed to the said notification for construction of Road Maintenance, management and operation of NH219 in the stretch of land from Km. 0 to Km. 44.6 (District Land Aquisition Officer, Room No- 14,Collectorate, Kaimur (BHABUA )) in the district of KAIMUR (BHABUA ) in the state of BIHAR. And whereas the substance of the said notification has been published in “Dainik Bhaskar, Patna” dated "20.09.2023" and "Hindustan, Gaya" dated "21.09.2023" under sub-section (3) of section 3A of the said Act; And whereas objections have been received and the same have been considered and disallowed by the Competent Authority; And whereas, in pursuance of sub-section (1) of section 3D of the said Act, the competent authority has submitted its report to the Central Government; Now, therefore, upon receipt of the said report of the competent authority and in exercise of the powers conferred by the sub-section (1) of section 3D of the said Act, the Central Government hereby declares that the land specified in the said Schedule should be acquired for the aforesaid purpose; And further, in pursuance of sub-section (2) of section 3D of the said Act, the Central Government hereby declares that on publication of this notification in the Official Gazette, the land specified in the said Schedule shall vest absolutely in the Central Government, free from all encumbrances.
