G.S.R. 594(E). In exercise of the powers conferred by clause (a) of sub-section (1), clauses (c) and (ze) of sub-section (2) of section 113 read with clause (c) of sub-section (1) of section 58 of the Merchant Shipping Act, 2025 (24 of 2025) and in supersession of the Merchant Shipping (Continuous Discharge Certificate) Rules, 2017, except as respect things done or omitted to be done before such supersession, the Central Government hereby makes the following rules, namely:
1. Short title and commencement. — (1) These rules may be called the Merchant Shipping (Continuous Discharge Certificate) Rules, 2026.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Application. — These rules shall apply to citizens of India, who fulfil the eligibility conditions specified in rule 4.
3. Definitions. —
(1) In these rules, unless the context otherwise requires, —
(a)"Act" means the Merchant Shipping Act, 2025 (24 of 2025);
(b)“continuous discharge certificate” means continuous discharge certificate issued under these rules;
(c)"continuous discharge certificate e-module" means a web-based system set up and maintained by the Director-General for—

(i) facilitating submission of applications for issuance, renewal and replacement of continuous discharge certificates and facilitating other processes under these rules; and
(ii)preserving, retaining and granting access to secure electronic records relating to such applications and certificates;
(d)“Form” means a form appended to these rules;
(e)"issuing authority” means the shipping master as defined in clause (61) of section 3 of the Act; and
(f) "Schedule" means the schedule appended to these rules.
(2) Words and expressions used in these rules and not defined but defined in the Act shall have the meanings respectively assigned to them in the Act.
4. Eligibility criteria for obtaining a continuous discharge certificate. — Any applicant desirous of obtaining a continuous discharge certificate shall fulfil all the following eligibility criteria, namely: —
(a) The applicant shall be a citizen of India;
(b) The applicant shall possess a valid medical certificate issued in accordance with the applicable rules made under the Act;
(c) The applicant shall possess the following valid certificates from an approved maritime training institute, namely: —
(i) Personal Survival Techniques;
(ii) Fire Prevention and Fire Fighting;
(iii) Elementary First Aid;
(iv) Personal Safety and Social Responsibility; and
(v) Security Training for Seafarers with Designated Security Duties;
(d) The applicant shall not be less than sixteen years of age;
(e) The applicant shall have passed tenth standard from a Board of School Education established or recognised by the Central Government or any State Government or hold an equivalent qualification from any foreign institution.
Explanation. - For the purposes of this clause, the expression “equivalent qualification” means a qualification equivalent to Indian standards as certified by any Government body authorised by the Ministry of Education to grant equivalence to foreign school certificates in India; and
(f) The applicant shall fulfil such other eligibility criteria as may be specified by the Director-General.
5. Application for issuance of a continuous discharge certificate. — (1) An applicant desirous of obtaining a continuous discharge certificate shall apply to the issuing authority in the Form-I through the continuous discharge certificate e-module and pay the fee as specified in the Schedule.

(2) Where the issuing authority is satisfied that the applicant fulfils all the eligibility conditions provided in rule 4, the issuing authority shall issue the continuous discharge certificate in Form-II within thirty days from the date of receipt of application.
(3) The continuous discharge certificate shall be dispatched to the address provided by the applicant in their application through expeditious means:
Provided that in urgent cases, the issuing authority may deliver the continuous discharge certificate to the applicant in person, upon production of documentary proof of urgency or vessel joining requirements from the ship owner.
(4) If the continuous discharge certificate is returned undelivered to the office of the issuing authority, the applicant may collect the same in person from the office of the issuing authority with proper identification or documentation.
(5) In case, an applicant does not receive the continuous discharge certificate within a period of one year from the date of issuance, the issued continuous discharge certificate shall be cancelled by the issuing authority.
(6) If an applicant submits any false or fraudulent document or information for the purpose of obtaining a continuous discharge certificate, such application shall be rejected forthwith.
(7) Where any application for continuous discharge certificate is rejected on any grounds, the reasons for rejection of the application shall be intimated to the applicant.
6. Period of validity. — (1) A continuous discharge certificate issued under these rules shall be valid for a period of ten years from the date of its issuance or renewal.
(2) In case the period of validity of continuous discharge certificate expires during a voyage, it shall continue to be valid until the end of such voyage.
7. Renewal. - (1) An application for renewal of continuous discharge certificate may be made in Form-III through the continuous discharge certificate e-module along with fees as specified in the Schedule, within eighteen months prior to the date of expiry or at any time after the date of its expiry.
(2) Where the issuing authority is satisfied that the continuous discharge certificate holder fulfils all the eligibility conditions provided in rule 4, the issuing authority shall renew the continuous discharge certificate, within thirty days from the date of receipt of application:
Provided that corresponding advanced training certificates, if any, in lieu of the certificates specified in clause (c) of rule 4, shall be accepted.
8. Issuance of a duplicate continuous discharge certificate. — (1) Where a continuous discharge certificate is lost in India, the continuous discharge certificate holder may apply to the concerned issuing authority in Form-IV through the continuous discharge certificate e-module along with a copy of the police compliant and fee as specified in the Schedule for issuance of a duplicate copy of continuous discharge certificate.
(2) Where a continuous discharge certificate is lost onboard vessel, the continuous discharge certificate holder may apply to the concerned issuing authority as per Form-IV through the

continuous discharge certificate e-module along with the enquiry report, official logbook entries and fee as specified in the Schedule for the issuance of a duplicate copy of continuous discharge certificate.
(3) Where a continuous discharge certificate is lost under extraordinary circumstances and the logbook entry or other required documents are not available due to circumstances which are beyond the control of the concerned seafarer or master of the vessel, the continuous discharge certificate holder may apply to the concerned issuing authority in Form-IV through the continuous discharge certificate e-module along with the documentary evidence submitted by the Flag State or by the ship owner and the fee as specified in the Schedule for the issuance of a duplicate copy of continuous discharge certificate:
Provided that in case of loss of a certificate due to fire onboard a vessel or due to any other marine peril, no such fee shall be charged.
9. Issuance of a replacement continuous discharge certificate. — (1) Where a continuous discharge certificate is destroyed, defaced or mutilated or torn or the pages of the continuous discharge certificate are exhausted, the holder may apply to the issuing authority as per Form-V through the continuous discharge certificate e-module along with a fee as specified in the Schedule for issuance of a replacement continuous discharge certificate.
(2) An application for alteration or modification of any particulars in the existing continuous discharge certificate shall be made to the issuing authority in Form-V through the continuous discharge certificate e-module along with a fee as specified in the Schedule, accompanied by a valid passport and any other relevant document issued by the Central Government or State Government.
(3) The applicant shall submit the existing continuous discharge certificate prior to the issuance of the replacement continuous discharge certificate.
10. Cancellation, withdrawal or suspension of a continuous discharge certificate. —
(1) The Director-General may, under sub-section (5) of section 62 of the Act, suspend or withdraw any continuous discharge certificate, for such period as may be specified in the order.
(2) The Director-General may, under sub-section (3) of section 99 of the Act, suspend or cancel any continuous discharge certificate for such period as may be specified in the order, during the course of the hearing or legal proceeding for any offence specified in sub-section (1) of section 99 of the Act.
(3) The Director-General may, under sub-section (3) of section 98 of the Act, direct the issuing authority to withhold the continuous discharge certificate for such period as may be specified in such direction.
(4) Where a seafarer is convicted of an offence under sub-section (1) of section 100 of the Act, in case of smuggling of goods, the Director-General may direct the issuing authority that the continuous discharge certificate of such seafarer be cancelled or suspended, as the case may be, for such period as may be specified in the direction.

(5) If the issuing authority is satisfied that a continuous discharge certificate holder has obtained the continuous discharge certificate based on any false or fraudulent document or information, the issuing authority may cancel such continuous discharge certificate.
(6) In case of any report of death or disappearance of a continuous discharge certificate holder, the continuous discharge certificate may be cancelled by the concerned issuing authority.
(7) Every order for cancellation, withdrawal or suspension shall be a reasoned order in writing and sent by the issuing authority to the continuous discharge certificate holder and intimated to all other Issuing Authorities in India and the Director-General.
(8) No order under this rule shall be passed unless the continuous discharge certificate holder has been given an opportunity of being heard.
(9) A person whose continuous discharge certificate is cancelled shall be debarred from applying for renewal of continuous discharge certificate for such period as may be specified by the issuing authority in the order for cancellation.
11. Surrender of a continuous discharge certificate. — (1) Any continuous discharge certificate holder, who has acquired citizenship of a country other than India, shall surrender the continuous discharge certificate to the issuing authority immediately, after which the issuing authority shall cancel the same by way of endorsement and return such cancelled continuous discharge certificate to such person.
(2) In case of permanent disablement, the continuous discharge certificate holder shall surrender their continuous discharge certificate to the issuing authority immediately upon the payment of compensation, after which the issuing authority shall cancel the same by way of endorsement and return such cancelled continuous discharge certificate to such person.
(3) If a continuous discharge certificate holder wishes to discontinue the sea-going service and requests for cancellation of their continuous discharge certificate, the holder shall surrender their continuous discharge certificate to the issuing authority, after which the issuing authority shall cancel the same by way of endorsement and return such cancelled continuous discharge certificate to such person.
12. Fee. — (1) The fees payable under these rules shall be such as specified in the Schedule or such other fees as the Central Government may, by notification, specify.
(2) Fees shall be payable to the issuing authority through the continuous discharge certificate e-module.
13. Appeal. — (1) Any person aggrieved by any order of the issuing authority under these rules, may, within a period of sixty days from the date of receipt of such order, prefer an appeal to the jurisdictional principal officer.
(2) The principal officer shall dispose of such appeal within a period of thirty days from the date of receipt of the appeal.
(3) No order shall be passed under this rule unless the parties have been given a reasonable opportunity of being heard.
(4) Every appeal made under this rule shall be accompanied by a copy of the order appealed against.
