The Central Motor Vehicles (Second Amendment) Rules, 2024, notified vide G.S.R. 38(E) dated 15th January 2024 by the Ministry of Road Transport and Highways under section 110 of the Motor Vehicles Act, 1988 (59 of 1988) - following a draft published as G.S.R. 723(E) dated 5th October 2023 which drew no objections - amend the Central Motor Vehicles Rules, 1989 by replacing references to 'rear-view mirror', 'rear view mirror' and 'driving mirror' with 'rear-view mirror or device for indirect vision' throughout rules 15, 31, 62, 93, 124, 125, 125A, 125C and 128, Form 22B, and the Motor Vehicles (Driving) Regulations, 2017; new provisos are inserted in rule 125(2) prescribing that, from twelve months after commencement, indirect-vision devices for L5-category three-wheeled vehicles, M and N category vehicles, and L7-category vehicles must conform to AIS-001 (Part 1) (Rev. 2): 2023 and AIS-002 (Part 1) (Rev. 2): 2023, and for agricultural tractors must conform to AIS-001 (Part 1) (Rev. 2): 2023 and AIS:114-2009, pending notification of corresponding specifications under the Bureau of Indian Standards Act, 2016 (11 of 2016); issued under No. RT-11036/48/2023-MVL and signed by Mahmood Ahmed, Additional Secretary; the principal rules (G.S.R. 590(E) dated 2nd June 1989) were last amended vide G.S.R. 27(E) dated 5th January 2024.

L.-33004/99 The Gazette of India CG-DL-E-16012024-251363 EXTRAORDINARY PART II—Section 3—Sub-section (i) PUBLISHED BY AUTHORITY No. 33] NEW DELHI, MONDAY, JANUARY 15, 2024/PAUSHA 25, 1945 MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 15th January, 2024 G.S.R.38(E).-Whereas the draft rules further to amend the Central Motor Vehicles Rules, 1989, were published, as required by sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988), vide notification of the Government of India in the Ministry of Road Transport and Highways number G.S.R. 723(E), dated the 5th October, 2023, in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (i), dated the 6th October, 2023 inviting objections and suggestions from all persons likely to be affected thereby before the expiry of the period of thirty days from the date on which copies of the Gazette containing the said notification were made available to the public; And whereas copies of the said notification were made available to the public on the 6th October, 2023; And whereas no objections and suggestions were received from the public in respect of the said draft rules; Now, therefore, in exercise of the powers conferred by section 110 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely:- 1. (1) These rules may be called the Central Motor Vehicles (Second Amendment) Rules, 2024. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Central Motor Vehicles Rules, 1989(hereinafter referred to as the said rules), in rule 15, in sub-rule(3),- (a) in clause (a), for the words "rear-view mirror", the words " rear-view mirror or device for indirect vision " shall be substituted; (b) in clause (f), for the words "rear-view mirror", the words " rear-view mirror or device for indirect vision " shall be substituted; (c) in clause (r), for the words "rear-view mirror", the words " rear-view mirror or device for indirect vision " shall be substituted; (d) in clause (v), in sub-clause (ii), for the words "rear-view mirror", the words " rear-view mirror or device for indirect vision " shall be substituted. 3. In rule 31 of the said rules, in sub-rule (1), under the heading "A. DRIVING THEORY-I", against serial number 2, for the words "Rear-view mirror", the words "Rear-view mirror or device for indirect vision " shall be substituted. 4. In rule 62 of the said rules, in sub-rule (1), in the first proviso, in Table, against serial number (6), in column 2, for the words "Rear View Mirror", the words " Rear view mirror or device for indirect vision " shall be substituted. 5. In rule 93 of the said rules,- (a) in sub-rule (1), in clause B,- (i) in sub-clause (i), for the words "rear-view mirror", the words " rear view mirror or device for indirect vision " shall be substituted; (ii) in sub-clause (iii), in item number (b), in Explanation III, in Note, for the words "Rear view mirrors", the words " device for indirect vision " shall be substituted; (b) in sub-rule (2), in clause (2), in first Explanation, in item (A), in sub-item(viii), in first proviso, in paragraph (b), for the words "rear view mirror", the words " device for indirect vision " shall be substituted; (c) in sub-rule (3), for the words " a driving mirror ", the words " device for indirect vision" shall be substituted; (d) in sub-rule (4), for the words " a driving mirror ", the words " device for indirect vision" shall be substituted. 6. In rule 124 of the said rules, in sub-rule (4), in Table, against serial number 8, in column (2), for the words "Rear view mirror", the words "device for indirect vision" shall be substituted. 7. In rule 125 of the said rules, in sub-rule(2),- (a) for the words "with rear view mirror", the words "with rear view mirror or device for indirect vision " shall be substituted; (b) in the first proviso,- (i) after clause (b), the following clause shall be inserted, namely:- "(b-1) for L5 category (three wheeled vehicles) with body work manufactured on and after the twelve months from the date of commencement of the Central Motor Vehicles (Second Amendment) Rules, 2024, the device for indirect vision specification and installation requirements shall be as specified in AIS-001 (Part 1) (Rev. 2): 2023 and AIS-002 (Part 1) (Rev. 2): 2023 standard respectively, as amended from time to time, till such time corresponding BIS specifications are notified under the Bureau of Indian Standards Act, 2016 (11 of 2016);"; (ii) after clause (c), the following clause shall be inserted, namely:- "(c-1) for M and N category vehicles manufactured on and after the twelve months from the date of commencement of the Central Motor Vehicles (Second Amendment) Rules, 2024, the devices for indirect vision specification and installation requirements shall be as specified in AIS-001 (Part 1) (Rev. 2): 2023 and AIS-002 (Part 1) (Rev. 2): 2023 standard respectively, as amended from time to time, till such time corresponding BIS specifications are notified under the Bureau of Indian Standards Act, 2016 (11 of 2016):”; (c) after the second proviso, the following proviso shall be inserted, namely:- "Provided further that, for L7 category vehicles manufactured on and after the twelve months from the date of commencement of the Central Motor Vehicles (Second Amendment) Rules, 2024, the devices for indirect vision specification and installation requirements shall be as specified in AIS-001 (Part 1) (Rev. 2): 2023 and AIS-002 (Part 1) (Rev.2): 2023 standard respectively, as amended from time to time, till such time corresponding BIS specifications are notified under the Bureau of Indian Standards Act, 2016 (11 of 2016):"; (d) after the fourth proviso, the following proviso shall be inserted, namely:- "Provided also that for agricultural tractors manufactured on and after the twelve months from the date of commencement of the Central Motor Vehicles (Second Amendment) Rules, 2024, the devices for indirect vision specifications and installation requirements shall conform to AIS-001(Part 1) (Rev.2): 2023 and AIS:114-2009 standards respectively as amended from time to time, till the corresponding BIS specifications are notified under the Bureau of Indian Standards Act, 2016 (11 of 2016):". 8. In rule 125A of the said rules, for the words "rear view mirror", in both the places where they occur, the words, "rear view mirror or device for indirect vision" shall be substituted. 9. In rule 125C of the said rules, in sub-rule (3), in TABLE 1, against serial number 22, in column (2), for the words "Rear view mirror", the words " Rear view mirror or device for indirect vision " shall be substituted. 10. In rule 128 of the said rules, in clause (13), in sub-clause (i), for the words "rear-view mirrors", the words "rear view mirror or device for indirect vision" shall be substituted. 11. In Form 22B of the said rules, in PART A, against serial number 6.22, for the words "rear view mirrors", the words "rear view mirror or device for indirect vision" shall be substituted. 12. In Motor Vehicles (Driving) Regulations, 2017 for the words "rear view mirror", wherever they occur, the words "rear view mirror or devices for indirect vision" shall be substituted.
