It mandates that specified goods conform to corresponding Indian Standards and bear the BIS Standard Mark under licence per Scheme-I of Schedule-II of the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018, with implementation from 1st April 2025 (1st October 2025 for micro enterprises, 1st July 2025 for small enterprises) for IS 14756:2022 (Stainless Steel Utensils), alongside IS 1660:2009 (Wrought Aluminium Utensils), IS 13983:1994 (Stainless Steel Sinks for Domestic Purposes), IS 9396 (Part 1):1987 (Round Open Top Sanitary Cans) and IS 14407:1996 (Aluminium cans for beverages). Exemptions apply to goods manufactured for export, to micro/small enterprises registered under the Udyam portal with investment up to twenty-five lakh rupees and turnover up to two crore rupees, to declared pre-implementation stock (sellable up to six months post-implementation), to goods imported filled with solid/liquid/gas material, and to up to two hundred units imported annually for research and development. No. P-29026/14/2023–LEI] MINISTRY OF COMMERCE AND INDUSTRY (Department For Promotion Of Industry And Internal Trade) ORDER New Delhi, the 11th October, 2024 S.O. 4494(E).—In exercise of the powers conferred by section 16 read with section 17 and sub- section (3) of section 25 of the Bureau of Indian Standards Act, 2016 (11 of 2016) and in supersession of the Cookware, Utensils and Cans for foods and beverages (Quality Control) Order 2024, except as respects things done or omitted to be done before such supersession, the Central Government, after consulting the Bureau of Indian Standards, is of the opinion that it is necessary or expedient so to do in the public interest, hereby makes the following order, namely:- 1. Short title and commencement. – (1) This Order may be called the Cookware, Utensils and Cans for Foods and Beverages (Quality Control) Order, 2024. (2) Save as otherwise provided in this order, it shall come into force on the date of its publication in the official Gazette. 2. Compulsory use of Standard Mark.- Goods or articles specified in Column (2) of the Table shall conform to the corresponding Indian Standard specified in Column (3) of the Table and shall bear the Standard Mark under a license from the Bureau as per Scheme-1 of Schedule-II of the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018: Provided that nothing in this order shall apply to goods or articles manufactured domestically for export: Provided further that the micro enterprise and small enterprise, as defined under the Micro, Small and Medium Enterprises Development Act, 2006 (27 of 2006) shall conform to such Indian Standards from the date specified in the corresponding entry under columns (6) and (7) of the Table respectively: Provided also that nothing in this order shall apply to goods or articles manufactured domestically by an enterprise, registered under "Udyam portal" of the Ministry of Micro, Small and Medium Enterprises, wherein the investment in plant and machinery or equipment at original cost does not exceed twenty-five lakh rupees and the turnover does not exceed two crore rupees for the previous financial year as certified by a Chartered Accountant: Provided also that nothing in this order shall apply to goods or articles domestically manufactured or imported before the date of implementation specified in the Table of this order by the manufacturer certified by the Bureau or manufacturer who has applied to the Bureau for certification or by the importer for the relevant goods and articles and such manufacturer or importer shall be permitted to sell or display or offer to sell such declared stock up to six months from the date of implementation specified in the Table of this Order, subject to the condition that such manufacturer or importer shall make a declaration to this effect certified by a Chartered account to the Bureau: Provided also that nothing in this order shall apply to goods or articles filled with material in any form solid, liquid or gas, when imported into India: Provided also that nothing in this order shall apply for two hundred numbers of goods or articles imported for the purpose of research and development by manufacturers of Cookware, Utensils and Cans for Food and Beverages per year with the condition that such imported goods and articles shall not be sold commercially and shall be disposed of as a scrap and the manufacturer shall maintain a year-wise record of such goods and articles and furnish to the Central Government. 3. Certification and enforcement authority.- The Bureau shall be the certifying and enforcing authority for the goods or articles specified in Column (2) of the Table. 4. Penalty for contravention.- Any person who contravenes the provisions of this Order shall be punishable under the provisions of the Bureau of Indian Standards Act, 2016.
