The Ministry of Road Transport and Highways, through notification S.O. 4161(E) dated 12th September, 2025, in exercise of powers under section 7 of the National Highways Act, 1956 (48 of 1956) read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008, has levied a fee for the use of the four-lane Madurai - Tuticorin Section, spanning Km. 138+800 to 266+865, a total length of 128.065 Km, of National Highway Number 45B (New NH-38) in Tamil Nadu. This notification supersedes S.O. 1415(E) dated 16.06.2011. The Central Government had previously entrusted these stretches to the National Highways Authority of India (NHAI) via S.O. 1399(E) dated 27th September, 2005, under section 11 of the National Highways Authority of India Act, 1988 (68 of 1988). The fee is based on a net road section length of 92.653 Km, an equivalent structure length of 7.20 Km (derived from 0.720 km actual length), and bypasses totaling 34.692 Km that cost rupees ten crore or more. Base rates for the year 2007-08 range from Rs. 0.65/Km for cars to Rs. 4.20/Km for oversized vehicles. Fees are payable at fee plazas near Eliyarpathy Village (Madurai District) and Pudhurpandiyapuram Village (Tuticorin District). Bypasses costing Rs. 10 crore or more, including Karipatti, Kallkurichy, Aruppukottai Old, Pandalgudi, Ettayapuram, and Tuticorin Bypasses, incur a fee at one and a half times the base rate. Structures having lengths more than 60m are converted to an equivalent highway length by multiplying by an equalization factor of 10. A monthly pass for non-commercial vehicles residing within 20 km of a fee plaza is Rs. 350/- for 2025-26. Special rates apply for multiple journeys and commercial vehicles registered in the district. Overloaded vehicles are liable to pay a fee as per sub-rule 1A of rule 10 of the rules. The estimated capital cost of the project is Rs. 1877.95 crore, subject to variation. The fee rates will be revised annually as per rule 5 of the said rules and published in English and vernacular newspapers.

(Table-4) and at one and one half times the base rate for bypasses having length of 34.692 Km. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometers from the fee plaza is Rs.350/- (Rupees Three Hundred Fifty only) for the year 2025-26 and is subject to revision every year as per the provisions of the said rules. 5. Fee for commercial vehicles (excluding vehicles plying under a National permit) registered in the district where the fee plaza falls shall be 50% of the specified rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles. 7. The driver or owner or a person in-charge of a mechanical vehicle which is loaded nexcess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collecting agency, equal to the fee specified in sub-rule 1A of rule 10 of the said rules, and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle. 8. All definitions including the category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road, etc. shall be as per definitions specified in the said rules. 9. The fee rates shall be displayed for the information of the users in accordance with rule 12 of the said rules. 10. Based on the base rate of fee per kilometer for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper in English and vernacular language. 11. The estimated capital cost of the project is Rs.1877.95 crore. The capital cost is subject to variation as the activities of land acquisition, utility shifting, tree cutting, etc. are yet to be completed.
