Draft Rules: 1. Short title and commencement – (1) These rules may be called as the Central Motor Vehicles (.............Amendment) Rules, 2025. (2) They shall come into force from the date of their final publication in the Official Gazette. 2. In the Central Motor Vehicles Rules, 1989 (hereinafter referred to as the said rules), in rule 2,- (i) in clause (zd), for the words "transport.", the words "transport;" shall be inserted; (ii) after clause (zd), the following clauses shall be inserted, namely,- "(ze) "unpaid user fee" means the user fee legally payable by a vehicle for use of a section of a National Highway, where the Electronic Toll Collection Infrastructure has duly recorded the vehicle passage but has failed to realize the applicable user fee as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules, 2008, for whatsoever reason including due to the vehicle not being affixed with a valid, functional FASTag, and an electronic notice has been issued for the same intimating the details of the passage of the vehicle and the corresponding user fee to be paid." 3. In the said rules, in rule 51B, in sub-rule (3),- (i) in the fourth proviso, for the words "paid.", the words "paid:" shall be substituted; (ii) after the fourth proviso, the following proviso shall be inserted, namely,- "PROVIDED also that the registering authority shall not grant the request for depositing motor vehicle tax or recording transfer of ownership in the certificate of registration or issue of no objection certificate or conversion of registration mark from BH series to regular registration series until unpaid user fee is paid; PROVIDED further that the authorised insurer shall confirm through an online process through the National Register of Motor Vehicles maintained under section 62B of the Act, that the unpaid user fees before issuing the certificate of insurance in pursuance of section 137 of the Act.". 4. In the said rules, in rule 52, in sub-rule (2),- (i) in the third proviso, for the words "Act.", the words "Act:" shall be substituted; (ii) after third proviso, the following proviso shall be inserted, namely,- "PROVIDED also that the registering authority shall not process the application for renewal of certificate of registration until unpaid user fee is paid.". 5. In the said rules, in rule 53, after sub-rule (2),- (i) for the word and figures "rule 81.", the words and figures "rule 81:" shall be substituted; (ii) the following proviso shall be inserted, namely,- "PROVIDED that the registering authority shall not process the application for issue of a duplicate certificate of registration until unpaid user fee is paid by the applicant.". 6. In the said rules, in rule 55, in sub-rule (2), after clause (iv), the following clause shall be inserted, namely,- "(v) No objection certificate in Form 28.". 7. In the said rules, in rule 58,- (i) in sub-rule (3), after the words, letters and figures "fill Part-III of Form 28 and return that part to the applicant duly signed", the words and letters "or issue filled in Part-III electronically on the Portal" shall be inserted; (ii) in sub-rule (4), for the word "thereof.", the words "thereof:" shall be substituted, and the following proviso shall be inserted, namely,- "PROVIDED that the registering authority shall not grant the no-objection certificate until unpaid user fee is paid by the applicant.". 8. In the said rules, in rule 62, in sub-rule (1),- (i) in the fifth proviso, for the word "registration.", the word "registration:" shall be substituted; (ii) after fifth proviso, the following proviso shall be inserted, namely,- “PROVIDED also that a certificate of fitness shall not be renewed or generated until unpaid user fee is paid by the applicant.". 9. In the said rules, in rule 90, after Serial Number (6), the following clause shall be inserted, namely,- "(7) The vehicle shall not have any unpaid user fee.". 10. In the said rules, in FORM 28, in PART I-APPLICATION, after Serial Number 10 and the entries relating thereto, the following shall be inserted, namely,- "10A.
