Detailed Summary

S.O. 2770(E), issued by the SEZ Section, Department of Commerce, Ministry of Commerce and Industry on 15 July 2024, records that M/s. Manyata Promoters Private Limited had proposed, under Section 3 of the Special Economic Zones Act, 2005 (28 of 2005), an Information Technology and Information Technology Enabled Services (including Electronic Hardware and Software) SEZ at villages Rachenahalli, Nagavara and Tanisandra, District Bangalore, Karnataka. The Central Government had originally notified 22.348 hectares for this SEZ vide Notification S.O. 1980(E) dated 16 November 2006 under Section 4(1) of the Act read with Rule 8 of the Special Economic Zones Rules, 2006, subsequently adding areas (1.8600 and 5.0917 hectares, vide S.O. 388(E) dated 6 March 2012 and S.O. 3842(E) dated 29 August 2023 respectively) and de-notifying partial areas (3.0980 and 2.10 hectares) at the same times. Manyata Promoters Private Limited has now proposed de-notification of a further 4.9026 hectares; the Government of Karnataka approved this via letter No. CI 377 SPI 2023 dated 25 January 2024, and the Development Commissioner, Cochin SEZ recommended it. Exercising powers under the second proviso to Section 4(1) of the Act and Rule 8 of the 2006 Rules, the Central Government de-notifies 4.9026 hectares (comprising Survey Nos. 17(P), 18(P), 19(P), 22(P) and 23(P) in Rachenahalli totalling 4.1842 hectares, and Survey Nos. 58(P) and 59(P) in Tanisandra totalling 0.7184 hectares), leaving a resultant notified SEZ area of 19.1991 hectares. Manyata Promoters Private Limited, a private organisation, had proposed under section 3 of the Special Economic Zones Act, 2005 (28 of 2005), (hereinafter referred to as the said Act) to set up an Information Technology and Information Technology Enabled Services (including Electronic Hardware and Software) Special Economic Zone at Villages Rachenahalli, Nagavara and Tanisandra, District Bangalore, in the State of Karnataka; AND, WHEREAS, the Central Government in exercise of the powers conferred by sub-section (1) of section 4 of the said Act read with rule 8 of the Special Economic Zones Rules 2006, had notified an area of 22.348 hectares at the above Special Economic Zone vide Ministry of Commerce and Industry Notification Number S.O. 1980(E) dated 16th November, 2006. Subsequently, vide Ministry of Commerce and Industry Notification S.O. 388(E) dated 06th March, 2012 and S.O. 3842 (E) dated 29.08.2023 two additional areas (1.8600 hectares and 5.0917 hectares) were notified and two partial area (3.0980 hectares and 2.10 hectares) were de-notified at the above Special Economic Zone, respectively; AND, WHEREAS, M/s. Manyata Promoters Private Limited has now proposed for de-notification of 4.9026 hectares from the above Special Economic Zone; AND, WHEREAS, the State Government of Karnataka has given its approval to the proposal vide letter No. CI 377 SPI 2023 dated 25th January, 2024; AND, WHEREAS, the Development Commissioner, Cochin SEZ has recommended the proposal for de- notification of an area of 4.9026 hectares of the Special Economic Zone; AND, WHEREAS, the Central Government is satisfied that the requirements under sub-section (8) of section 3 of the said Act and other related requirements are fulfilled; NOW, THEREFORE, in exercise of the powers conferred by second proviso to sub-section (1) of section 4 of the Special Economic Zones Act, 2005 and in pursuance of rule 8 of the Special Economic Zones Rules, 2006, the Central Government hereby de-notifies an area of 4.9026 hectares, thereby making resultant area as 19.1991 hectares.
