L. -33004/99 EXTRAORDINARY PART II —Section 3 —Sub-section ( ii) PUBLISHED BY AUTHORITY No. 3894] NEW DELHI, WEDN ESDAY , SEPTEMBER 13, 2023/ BHADRA 22, 1945 CG-DL-E-14092023-248717 दकलोमीटर 84.500) पर। 42.446 15.544(vi) 41.666 23.344(vi) क ु ल 2334.400 MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 12th September , 2023 S.O. 4056(E).—Whereas in the exercise of the powers conferred by section 8A of NH Act, 1956 (48 of 1956) read with rule 3 of NH Fee Rules, 2008, Central Government vide Gazette Notification bearing number S.O. 3319 (E) dated 30th December, 2014 has authorised the M/s Agra -Gwalior Pathways Private Limited (hereinafter referred to as the “Con cessionaire”) for levying/collecting user fee at the fee plaza at Km 84.000 (existing Km. 84.500) on NH -3, near village Choundha in District Morena in the State of Madhya Pradesh. And whereas, in the running OMT contract, National Highways Authority of In dia (hereinafter referred to as the ‘Authority’) at its own additional cost has developed a flyover in Morena town with viaduct length of 780 m on the National Highway number 3 in the State of Madhya Pradesh. A supplementary agreement dated 05.07.2022 and its amendment dated 14.07.2023 has been signed between Authority and Concessionaire for the modalities of fee collection for the said flyover and to enable the concessionaire to collect the fee on behalf of the Authority. Now, in the exercise of the po wers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules 2008, the Central Government, having regard to the aforesaid agreement entered into bet ween the authority and the concessionaire, hereby authorises the Concessionaire to collect the fee for use of flyover in Morena town with a viaduct having the length of 780 m on behalf of the Authority and makes the following amendments in the notification published in Gazette of India, Extraordinary, Part -II, Section 3, Sub -section (ii) vide S.O. 3319 (E) dated 30th December, 2014: - 1. In Poi nt No. 6, the follo wing shall be inserted, namely: — “The fee for the afore -mentioned vehicles shall be equal to the fee specified in sub -rule 1A of rule 10 of the said rules [GSR 920(E) dated 25th September 2018] for the New Flyover of length 780m at Ch. 8 0.742.” 4. In Point No. 10, the phrase ‘The Capital Cost of the project yet to be recovered from the date of COD is Rs. 1019.86 Crore (Rupees One Thousand Nineteen Crore & Eighty Six Lakh Only).’ shall be substituted with the following: “The Capital Cost of the project yet to be recovered from the date of COD is Rs. 1127.86 Crore (Rupees Eleven Hundred Twenty Seven Crore & Eighty Six Lakh Only).” [F.
