                Detailed Summary
            

            
The Ministry of Petroleum and Natural Gas issued notification S.O. 1209(E) dated 7 March 2024, under sub-section (1) of section 6 of the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962). It recites that by prior notification S.O. 377(E) dated 19.01.2023, issued under sub-section (1) of section 3 of the Act, the Central Government had declared its intention to acquire the Right of User in land for laying a natural gas pipeline named "Ennore-Tiruvallur-Bengaluru-Puducherry-Nagapattinam-Madurai-Tuticorin" in the State of Tamil Nadu, to be laid by Indian Oil Corporation Limited; that copies of the notification were made available to the public from 25.01.2023; and that the Competent Authority submitted its report under section 6(1). The Central Government now declares the Right of User in the land specified in the Schedule acquired for laying the pipeline, and, in exercise of powers under sub-section (4) of section 6, directs that the Right of User shall vest, from the date of publication, in Indian Oil Corporation Limited (rather than the Central Government), free from all encumbrances. Indian Oil Corporation Limited is stated to be exclusively liable for compensation under section 10 of the Act, and no suit, claim or legal proceeding lies against the Central Government relating to the pipeline. The Schedule lists affected survey numbers, sub-divisions and areas in Thiruvarur district, Tamil Nadu, across villages in Nannilam taluk including Kovilthirumalam, Pandaravadai, Kottur, Panangattangudi, Kaduvangudi and Polakudi. The notification (F. NOTIFICATION
New Delhi, the 7th March, 2024
S.O. 120 9(E).—Whereas, by the notification of the Government of India in the Ministry of Petroleum and
Natural Gas number S.O.No.  377(E) da ted: 19.01.2023  issued under sub section (1) of section 3 of the Petroleum and
Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962), (herein after referred to as the said
Act) the Central Government declared its intention to acq uire the Right of User in the Lands specified in the Schedule
appended to that notification for the purpose of laying pipeline for the transportation of Natural Gas, a pipeline
“Ennore - Tiruvallur -Bengaluru -Puducherry -Nagapattinam –Madurai - Tuticorin” s hould be laid in the State of Tamil
Nadu  by Indian Oil Corporation Limited.
And whereas, copies of the said notifications were made available to the public from 25.01.2023.
And whereas, the Competent Authority in pursuance of sub -section (1) of section 6 of the said Act has
submitted his re port to the Central Government;
And whereas, the Central Government, after considering the said report is satisfied that the Right of User in
the Land specified in the Schedule appended to this n otification should be acq uired;
Now, therefore, in exercise of the powers conferred by sub -section (1) of section 6 of the said Act, the
Central Government hereby declares that the Right of User in the said Land specified in the Schedule appended to this
notification is hereby ac quired for laying the pipeline;

And further, in exercise of the powers conferred by sub -section (4) of section 6 of the said Act, the Central
Government hereby directs that the Right of User in the said Land shall instead of vesting in the Central Governmen t,
vest from the date of publication of this declaration, in the Indian Oil Corporation Limited free from all encumbrances.
Indian Oil Corporation Limited shall be exclusively liable for any compensation in terms of section 10 of the
P & M P Act, 1962 and  no suit, claim or legal proceeding would lie against the Central Government on any matter
relating to pipeline.
