The Ministry of Road Transport and Highways, through notification G.S.R. 28(E) dated 13th January, 2026, has published the Central Motor Vehicles (Second Amendment) Rules, 2026. These rules amend the Central Motor Vehicles Rules, 1989, exercising powers conferred by clauses (h), (i), (k), (n) and (p) of section 64 and sub-clause (v) of clause (b) of sub-section (14) of section 88 of the Motor Vehicles Act, 1988 (59 of 1988). The draft rules were previously published vide notification G.S.R 467(E), dated 11th July, 2025, inviting objections and suggestions, which were considered by the Central Government. Key amendments include the insertion of clause (ze) in rule 2, defining "unpaid user fee" as the fee payable for National Highway use where Electronic Toll Collection Infrastructure recorded passage but didn't receive the applicable fee levied under section 7 of the National Highways Act, 1956 (48 of 1956). Rule 55(2) is amended to include "No objection certificate in Form 28" as a requirement. Rule 58 is amended to allow electronic issuance of Part-III on the Portal and to mandate that the registering authority shall not grant a no-objection certificate until any unpaid user fee is paid. Similarly, rule 62(1) is amended to prevent renewal or generation of a certificate of fitness until unpaid user fee is paid. Rule 90 now includes that a vehicle shall not have any unpaid user fee. FORM 28 is also updated to include a query about pending unpaid user fees. The principal rules were published vide G.S.R. 590(E), dated 2nd June, 1989, and were last amended vide G.S.R. 7 (E) dated 2nd January, 2026.

L.-33004/99 The Gazette of India CG-DL-E-14012026-269342 EXTRAORDINARY PART II—Section 3—Sub-section (i) PUBLISHED BY AUTHORITY No. 28] NEW DELHI, WEDNESDAY, JANUARY 14, 2026/PAUSHA 24, 1947 288 GI/2026 MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 13th January, 2026 G.S.R. 28(E).—Whereas, the draft rules further to amend the Central Motor Vehicles Rules, 1989 were published, as required under sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988), vide notification of the Government of India in the Ministry of Road Transport and Highways vide number G.S.R 467(E), dated the 11th July, 2025, in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i), inviting objections and suggestions from all persons likely to be affected thereby before the expiry of the period of thirty days from the date on which copies of the Gazette containing the said notification were made available to the public; And whereas, copies of the said Gazette notification was made available to the public on 14th July, 2025; And whereas, the objections and suggestions received from the public in respect of the said draft rules have been considered by the Central Government; Now, therefore, in exercise of the powers conferred by clauses (h), (i), (k), (n) and (p) of section 64 and sub-clause (v) of clause (b) of sub-section (14) of section 88 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely: - 1. Short title and commencement - (1) These rules may be called as the Central Motor Vehicles (Second Amendment) Rules, 2026. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Central Motor Vehicle Rules, 1989 (hereinafter referred as the said rules), in rule 2,- (a) in clause (zd), for the words "transport.", the words "transport;" shall be inserted; (b) after clause (zd), the following clause shall be inserted, namely: – '(ze) "unpaid user fee" means the user fee payable by a motor vehicle for use of a section of a National Highway, where the Electronic Toll Collection Infrastructure has recorded the passage of such vehicle but has not received the applicable user fee levied under the provisions of section 7 of the National Highways Act, 1956 (48 of 1956) and rules made thereunder.'. 3. In the said rules, in rule 55, in sub-rule (2), after clause (iv), the following clause shall be inserted, namely: - "(v) No objection certificate in Form 28.". 4. In the said rules, in rule 58, (a) in sub-rule (3), after the words "applicant duly signed", the words and letters “or issue the filled in Part-III electronically on the Portal" shall be inserted; (b) in sub-rule (4), for the word "thereof.”, the word "thereof:" shall be substituted; (c) after sub-rule (4), the following proviso shall be inserted, namely: "Provided that the registering authority shall not grant the no-objection certificate until unpaid user fee is paid by the applicant.". 5. In the said rules, in rule 62, in sub-rule (1), – (a) in the fifth proviso, for the words "date of registration.", the words "date of registration:" shall be substituted; (b) after fifth proviso, the following proviso shall be inserted, namely: "Provided also that a certificate of fitness shall not be renewed or generated until unpaid user fee is paid by the applicant.". 6. In the said rules, in rule 90, after clause (6), the following clause shall be inserted, namely: "(7) The vehicle shall not have any unpaid user fee.". 7. In the said rules, in FORM 28, under the heading ‘PART I – APPLICATION', after serial number 10. and entries relating thereto, the following serial number and entries shall be inserted, namely: "10A.
