Detailed Summary

The Ministry of Road Transport and Highways, through G.S.R. 834(E) dated 11th November, 2025, has published the Central Motor Vehicles (Sixth Amendment) Rules, 2025, in exercise of powers conferred by section 110 of the Motor Vehicles Act, 1988 (59 of 1988). These rules amend the Central Motor Vehicles Rules, 1989, following consideration of public objections and suggestions to draft rules published as G.S.R 184(E) dated 20th March, 2025, under section 212(1) of the Motor Vehicles Act, 1988. Key amendments include the insertion of definitions for 'new model' and 'existing model' of motor vehicles in rule 2. Rule 93 is amended to clarify that devices such as rear-view mirrors, indirect vision devices, guard rails, direction indicator rub-rails (max 20mm), side foot steps, or sensors for advanced driver assistance systems (like Blind Spot Information System, Moving off Information System) are not considered in measuring overall vehicle width, provided they conform to respective standards. Rule 96 is significantly amended to introduce requirements for braking systems: non-Anti-Lock Braking for M2, M3, N1, N2, N3, and Quadricycle categories must conform to Indian Standard IS:11852:2019 from 1st January, 2027 (new models) and 1st October, 2027 (all models); Endurance Braking System Test (Type-II A Test) compliance for applicable categories from 1st January, 2027 (new models) and 1st October, 2027 (all models); M2, M3, N3, and N2 (excluding certain tractor-trailer combinations) categories must be fitted with Anti-Lock Braking System conforming to IS 11852:2019 from 1st January, 2027 (new models) and 1st October, 2027 (all models); and M2, M3, N2, N3 categories must be fitted with Advanced Emergency Braking Systems conforming to AIS-162 from 1st January, 2027 (new models) and 1st October, 2027 (all models), until BIS specifications are notified under the Bureau of Indian Standards Act, 1986 (63 of 1986). Rule 98 is amended to mandate Lane Departure Warning Systems conforming to AIS-188 for M2, M3, N2, N3 categories from 1st October, 2027 (new models) and 1st January, 2028 (existing models). Rule 125C is amended to insert '1st October 2026 (for school buses)' against Serial number 6 in TABLE I. A new Rule 125Q is inserted, mandating Driver Drowsiness and Attention Warning Systems (AIS-184), Blind Spot Information Systems (AIS-186), and Moving off Information Systems (AIS-187) for M2, M3, N2, N3 categories from 1st October, 2027 (new models) and 1st January, 2028 (existing models), pending BIS specifications. L.-33004/99 The Gazette of India CG-DL-E-13112025-267610 EXTRAORDINARY PART II-Section 3-Sub-section (i) PUBLISHED BY AUTHORITY No. 748] NEW DELHI, WEDNESDAY, NOVEMBER 12, 2025/KARTIKA 21, 1947 MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 11th November, 2025 G.S.R. 834(E). - Whereas, the draft rules further to amend the Central Motor Vehicles Rules, 1989 were published, as required under sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988), vide notification of the Government of India in the Ministry of Road Transport and Highways vide number G.S.R 184(E), dated the 20th March, 2025, in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i), inviting objections and suggestions from all persons likely to be affected thereby before the expiry of the period of thirty days from the date of which copies of the Gazette containing the said notification were made available to the public; And whereas, copies of the said Gazette notification were made available to the public on 20th March, 2025; And whereas, the objections and suggestions received from the public in respect of the said draft rules have been considered by the Central Government; Now, therefore, in exercise of the powers conferred by section 110 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely: - 1. Short title and commencement - (1) These rules may be called as the Central Motor Vehicles (Sixth Amendment) Rules, 2025. (2) Save as otherwise provided in these rules, they shall come into force on the date of their publication in the Official Gazette. 2. In the Central Motor Vehicle Rules, 1989 (hereinafter referred as the said rules), in rule 2, after clause (zd), following clauses shall be inserted, namely: - "(ze) "new model” of a motor vehicle means a vehicle model which obtains the Type Approval Certificate from any of the test agency notified under rule 126 or after the date of commencement of any new rule for which separate date is given for the new model and which shall conform to the requirements of that new rule. (zf) "existing model” of a motor vehicle means a vehicle model which has already been Type Approved prior to the earliest date of implementation of the new rule and those "existing models" shall be allowed to meet the requirements of the new rule on and from a different date, as notified in the new rule for existing models.". 3. In the said rules, in rule 93, in sub-rule (1), in clause B, for item (i), following item shall be substituted, namely: - "(i) A rear-view mirror, or devices for indirect vision, or guard rail or a direction indicator rub-rail (rubber beading) having maximum thickness of 20 millimetre on each side of the body or side foot step, or sensors along with their casing used for advanced driver assistance systems such as Blind Spot Information System, Moving off Information System, etc., shall not be taken into consideration in measuring the overall width of a motor vehicle and the above devices shall be within the prescribed dimension if so specified in the respective standards.". 4. In the said rules, in rule 96, in sub-rule (4), in item (ii)- (a) after the third proviso following proviso shall be inserted, namely: - "Provided also that Braking system other than Anti-Lock Braking for M2, M3, N1, N2, N3 and Quadricycle categories of vehicles manufactured, on and after the 1st day of January, 2027 in case of new models and the 1st day of October, 2027 in case of all models shall conform to the Indian Standard IS:11852:2019, as amended from time to time:"; (b) after the fourth proviso following proviso shall be inserted, namely: - "Provided also that motor vehicle categories for which Endurance Braking System Test (Type-II A Test) is applicable as per IS:11852:2019 and manufactured on and after 1st day of January, 2027 in case of new models and the 1st day of October, 2027 shall comply with the Endurance Braking System Test (Type-II A test) as specified in Indian Standard IS:11852:2019, as amended from time to time:"; (c) after the fifth proviso following proviso shall be inserted, namely: - "Provided also that Braking system other than Anti-Lock Braking for N1 category of vehicles manufactured on and after 1st day of January, 2027 in case of new models and 1st day of October, 2027 in case of existing models, shall comply with the requirements of Indian Standard IS:11852:2019, as amended from time to time." 5. In the said rules, in rule 96- (a) in sub-rule (4B), after first proviso following proviso shall be inserted, namely: - "Provided further that vehicles of category M2 manufactured on and after the 1st day of January, 2027 in case of new models and 1st day of October, 2027 in case of all models, shall be fitted with Anti-Lock Braking System conforming to the Indian Standard IS 11852:2019, as amended from time to time. (b) in sub-rule (9), after first proviso following proviso shall be inserted, namely: - "Provided further that vehicles of category M3, N3 and N2 other than tractor-trailer combination meant for carrying hazardous goods and liquid petroleum gas, manufactured on and after the 1st day of January, 2027 in case of new models and 1st day of October, 2027 in case of all models, shall be fitted with Anti-Lock Braking System conforming to the Indian Standard IS:11852:2019, as amended from time to time." (c) after sub-rule (11), following sub-rule shall be inserted, namely: - “(12) M2, M3, N2 and N3 categories of vehicles, manufactured on and after the 1st day of January, 2027 in the case of new models and 1st day of October, 2027 in case of all models, shall be fitted with Advanced Emergency Braking Systems, conforming to AIS-162, as amended from time to time, till the corresponding BIS specifications are notified under the Bureau of Indian Standards Act, 1986 (63 of 1986).”. 6. In the said rules, in rule 98, after sub-rule (5) following sub-rule shall be inserted namely: - "(6) On and after the, 1st day of October, 2027 in case of new models and 1st day of January, 2028 in case of existing models, vehicles of categories M2, M3, N2 and N3 shall be fitted with Lane Departure Warning System, which shall conform to AIS-188, as amended from time to time, till the corresponding BIS specifications are notified under the Bureau of Indian Standards Act, 1986 (63 of 1986)." 7. In the said rules, in rule 125C, in sub-rule (7), in clause (b), in TABLE I, against Serial number 6, in column (4), after the words and figures "1st April 2023", the words, brackets and figures "1st October 2026 (for school buses)” shall be inserted. 8. In the said rules, after rule 125P, following rule shall be inserted, namely: - "125Q. Advance Driver Assistance Systems.- (1) Vehicles of categories M2, M3, N2 and N3 manufactured on and after the 1st day of October, 2027 in the case of new models and 1st day of January, 2028 in case of existing models, shall be fitted with Driver Drowsiness and Attention Warning Systems as specified in AIS- 184, as amended from time to time, till the corresponding BIS specifications are notified under the Bureau of Indian Standards Act, 1986 (63 of 1986). (2) Vehicles of categories M2, M3, N2 and N3 manufactured on and after the 1st day of October, 2027, in case of new models and 1st day of January 2028 in case of existing models, shall be fitted with Blind Spot Information Systems as specified in AIS-186, as amended from time to time, till the corresponding BIS specifications are notified under the Bureau of Indian Standards Act, 1986 (63 of 1986). (3) Vehicles of categories M2, M3, N2 and N3 manufactured on and after the 1st day of October, 2027 in case of new models and 1st day of January 2028 in case of existing models, shall be fitted with Moving off Information Systems as specified in AIS-187, as amended from time to time, till the corresponding BIS specifications are notified under the Bureau of Indian Standards Act, 1986 (63 of 1986).".
