O. No. 2289 (E) Dated -08 May-2023 published in the Gazette of the India Gazette No .2195 dated - 25 May-2023 under sub -section (1) of section 3 of the Pet roleum and Minerals Pipelines (Acqu isition of Right of User in Land) Act, 1962 (50 of 1962), (hereinafter referred to as the said Act) the Central Government declared its intention to acquire the right of user in the land specified in the Schedule appended to that notification for the purpo se of laying “Kandla -Gorakhpur LPG Pipeline” for the transportation of LPG in Tehsil - Kerakat , District -Jaunpur in the state of Uttar Pradesh by IHB Limited. And whereas copies of the said Gazette notification were made available to the public up to 24 Jun e-2023 and whereas Shri Rakesh Kumar Competent Authority has under sub -section (1) of section 6 of the said Act submitted report to the Central Government; And w hereas the Central Government, after considering the said report and on being satisfied that th e said land is required for laying the pipeline, has decided to acquire right of user therein; Now, therefore, in exercise of the powers conferred by sub -section (1) of section 6 of the said Act, the Central Government hereby declares that the right of use r in the land specified in the Schedule appended to this notification is hereby acquired for laying the pipeline. And further, in exercise of the powers conferre d by sub -section (4) of section 6 of the said Act, the Central Government hereby directs that t he right of use r in the said land for laying the pipeline shall instead of vesting in the Central Government, vests on the date of publication of this declaratio n in IHB Limited, free from all encumbrances. IHB Limited shall be exclusively liable for any c ompensation in terms of Section 10 of the P&MP Act, 1962 and no suit, claim or legal proceeding would be against the Central Government on any matter relating to the pipeline.
