**1. Short Title & Commencement:** This notification may be called the "Telecom Regulatory Authority of India (Regulation of Telecom Services relating to Satellite Telephony including Satellite-based Internet Services) Regulations, 2024". They shall come into force on the date of their final publication in the Official Gazette. **2. Definitions:** In these regulations, unless the context otherwise requires,— (a) “Act” means the Telecom Regulatory Authority of India Act, 1997 (24 of 1997); (b) “Authority” means the Telecom Regulatory Authority of India established under sub-section (1) of section 3 of the Act; (c) “Cabinet Secretariat” means the Cabinet Secretariat, Government of India; (d) “Department of Space” means the Department of Space, Government of India; (e) “Department of Telecommunications” means the Department of Telecommunications, Ministry of Communications, Government of India; (f) “Indian Space Research Organisation” means the Indian Space Research Organisation, Department of Space, Government of India; (g) “Landing Rights Station” means a station established in India by an Indian entity and authorised by the Department of Telecommunications under the existing licensing framework for reception of signals from a foreign satellite and their integration into the Indian telecom network; (h) “licensee” means any person licensed under sub-section (1) of section 4 of the Indian Telegraph Act, 1885 (13 of 1885) for providing satellite telephony including satellite-based Internet services; (i) “National Security Council Secretariat” means the National Security Council Secretariat, Cabinet Secretariat, Government of India; (j) “satellite telephony including satellite-based Internet services” means the telecom services provided through satellite network, which facilitate two-way voice, data, video or multimedia communication, including Internet services; (k) “telecom network” means the network used for providing telecom services, and includes— (i) any equipment, apparatus, system, device or component thereof, as well as any software, including its upgrades, whether embedded or otherwise, that is— (A) used for providing telecom services; or (B) purposed for being used for providing telecom services; or (C) installed or connected for providing telecom services; (ii) equipment, apparatus, system, device or component thereof, as well as any software, including its upgrades, whether embedded or otherwise, for— (A) broadcasting services; or (B) electronic mail; or (C) voice mail; or (D) voice, data and video services; or (E) information technology services; or (F) Internet of Things devices; or (G) over-the-top (OTT) communication services; or (H) any other service specified in this behalf by the Central Government; (iii) any cable, wire, radio or optical fibre used for transmitting telecom services; (iv) any equipment or infrastructure (including telecommunication tower) required for setting up, maintaining or working of the telecom network; (v) any other equipment or infrastructure which is integral to the functioning of the telecom network: Provided that the expression “telecom network” shall not include any equipment, apparatus, system, device or component thereof, as well as any software, including its upgrades, whether embedded or otherwise, that is used by a person to whom no licence is granted under sub-section (1) of section 4 of the Indian Telegraph Act, 1885 (13 of 1885), exclusively for providing any broadcasting services or electronic mail or voice mail or voice, data and video services or information technology services or Internet of Things devices or over-the-top (OTT) communication services, or any other service specified in this behalf by the Central Government, to the extent the services are not provided through the telecom network of a licensee; (l) “telecom services” means services of any description provided by means of a telecom network and includes, broadcasting services, electronic mail, voice mail, voice, data and video services, Internet of Things (IoT) devices, over-the-top (OTT) communication services, and such other services as may be specified by the Central Government by notification, but does not include broadcasting services to the extent they are regulated under the Broadcasting Services (Regulation) Bill, 2023. (2) Words and expressions used and not defined in these regulations but defined in the Act, or in the Indian Telegraph Act, 1885 (13 of 1885), or in the rules and regulations made thereunder, shall have the same meanings respectively assigned to them in those Acts or rules and regulations. **3. Eligibility for satellite telephony including satellite-based Internet services:** (1) Any entity providing satellite telephony including satellite-based Internet services in India shall be an Indian entity and shall obtain a license from the Department of Telecommunications under the existing licensing framework. (2) The licensee shall obtain necessary approvals or clearances from the Department of Space/Indian Space Research Organisation/National Security Council Secretariat/Cabinet Secretariat, as may be required, from time to time, for providing satellite telephony including satellite-based Internet services. **4. Obligation to comply with all applicable laws:** The licensee shall comply with all applicable laws, rules, regulations, directions, orders and guidelines, issued by the Central Government or the Authority or any other authority from time to time. **5. Monitoring of quality of service parameters:** (1) The Authority may, from time to time, monitor and evaluate the quality of service parameters of satellite telephony including satellite-based Internet services. (2) The Authority may issue appropriate directions to the licensees for improving the quality of service for satellite telephony including satellite-based Internet services. **6. Directions:** The Authority may, from time to time, issue directions to the licensees for the effective implementation of these regulations. **7. Power to remove difficulties:** If any difficulty arises in giving effect to the provisions of these regulations, the Authority may issue such directions, not inconsistent with the provisions of the Act, as may be necessary to remove such difficulty: Provided that no such direction shall be issued after the expiry of a period of two years from the date of commencement of these regulations. **8. Repeal and Savings:** (1) The Regulations on Licensing Framework for Satellite-based Global Mobile Personal Communication by Satellite (GMPCS) Services, 2009 (10 of 2009) are hereby repealed. (2) Notwithstanding such repeal, anything done or any action taken or any proceeding initiated under the repealed regulations shall be deemed to have been done or taken or initiated under the corresponding provisions of these regulations.
