Detailed Summary

The Ministry of Road Transport and Highways, vide S.O. 3612(E) dated 10 August 2023, recited that the Bellary-Hiriyur section (Km 254.800 to Km 409.000) of NH-150A in Karnataka had earlier been entrusted to the National Highways Authority of India ("the Authority") vide notification S.O. 3512(E) dated 23 November 2016 under section 11 of the National Highways Authority of India Act, 1988 (68 of 1988). In exercise of powers under section 7 of the National Highways Act, 1956 (48 of 1956) read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008, the Central Government levied a user fee on mechanical vehicles for the four-lane Challakere to Hiriyur section of NH-150A (Existing Chainage Km 359.120 to Km 411.560; Design Chainage Km 358.500 to Km 414.205), covering a net road length of 32.755 km, equivalent structure length of 2.380 km, and bypasses totalling 22.712 km (costing Rs.10 crore or more) at 150% of the base rate, and authorised the Authority to collect the fee directly or through a contractor. Base-year (2007-08) fee rates per km range from Rs.0.65 for cars/jeeps/vans/light motor vehicles up to Rs.4.20 for oversized vehicles (seven or more axles), payable at the Fee Plaza at Design/Existing Chainage 397.400 near Balenahalli village, Chitradurga district. Additional 150% bypass fees apply for the Challakere Bypass (Km 359.100-369.900, length 10.682 km, cost Rs.221.86 crore) and Hiriyur Bypass (Km 401.200-413.350, length 12.03 km, cost Rs.249.86 crore); structures over 60m (a Road Over Bridge at Km 367.502-367.620 and a Major Bridge at Km 407.885-408.005, totalling 0.238 km) are charged at 100% of the base rate after conversion to 2.380 km equivalent road length using an equalisation factor of 10. A monthly local-resident pass (within 20 km of the plaza, non-commercial vehicles) is fixed at Rs.330 for 2023-24, subject to annual revision. Multiple-journey passes are also prescribed (1.5x single-journey fee for two journeys valid 24 hours; two-thirds of the 50-journey fee valid one month), and commercial vehicles registered in the plaza district get a 50% discount where no alternative road exists. Overloaded vehicles are liable for additional fees under Rule 10(1A). The estimated capital cost of the project is Rs.1658.42 crore, subject to variation, and the fee is to be reduced to 40% of the notified rates after recovery of capital cost. Issued under F. No 3512(E) dated 23rd November 2016 issued under section 11 of the National Highways Authority of India Act, 1988 (68 of 1988), the Central Government has entrusted the Bellary to Hiriyur section from kilometer 254.800 to kilometer 409.000 of National Highway Number 150 A in the State of Karnataka to the National Highways Authority of India (hereinafter referred to as the “Authority”); Now, therefore, in exercise of the powers conferred by section 7 of the National Highway s Act, 1956 (48 of 1956), read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 (hereinafter referred to as the “rules”), the Central Government hereby levies the fee on mechanical vehicles at 100% of the base ra te specified in column (2) of the Table 1 for net road section length of 32.755 Km and for equivalent structure length (having length more than 60m) of 2.380 km (having length of 0.238 km) and at one and one half times the base rate for bypasses having le ngth of 22.712 Km costing rupees ten crore or more on the type of vehicles specified in column (1) of Table 1 below for use of four lane section of Challakere to Hiriyur from Existing Chainage Km. 359.120 to Km. 411.560 (Design Chainage Km. 358.500 to Km. 414.205) of NH -150A in the State of Karnataka and authorises the Authority to collect, either through its officials or through a contractor, the said fee, namely: - Table 1 Type of vehicle Base rate of fee per km for the base year 2007 -08 (in Rupees) (1) (2) Car, Jeep, Van or Light Motor Vehicle 0.65 Light Commercial Vehicle, Light Goods Vehicle or Mini Bus 1.05 Bus or Truck (Two Axles) 2.20 Three -axle commercial vehicles 2.40 Heavy Construction Machinery (HCM) or Earth Moving Equipment (EME) or M ulti Axle Vehicle (MAV) (four to six axles) 3.45 Oversized Vehicles (seven or more axles) 4.20 1. The rate of monthly pass for a person who owns a mechanical vehicle registered for non -commercial purposes and reside s within a distance of twenty kilometers from the fee plaza is Rs. 330/ - (Rupees Three Hundred and Thirty only) for the year 2023 -24 and is subject to revision every year as per the provisions of the said rules. 5. For multiple journeys on the highway secti on, passes shall be issued at the following rates, namely: Table -5 Amount Payable Maximum number of one way journeys allowed Period of validity One and half times of the fee for one way journey Two Twenty four hours from the time of payment Two-third o f amount of the fee payable for fifty single journeys Fifty One month from date of payment 6. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the specified rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles. 7. The driver or owner or a person in charge of a Mechanical vehicle which is loaded in excess of permissible load specified for its c ategory, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collecting agency, equal to the fee specified in sub rule 1A of Rule 10 of the said rules, and shall not be entitled to make use of the highway secti on unless the excess load has been removed from such mechanical vehicle. 8. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specifi ed in the said rules. 9. The fee rates shall be displayed for information of the users in accordance with rules 12 of the said rules. 10. Based on the Base rate of fee per kilometer for the base year 2007 -08 as mentioned in Table -1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper, each in English and vernacular language. 11. The estimated capital cost of the project is Rupees 1658.42 Crore. [The capital cost is subject to variation as the activities of land acquisition, utility shifting, tree cutting etc. are yet t o be completed and the final capital cost will be notified separately]. The Authority shall maintain a record of the recovery of capital cost through user fee realised and after recovery of the capital cost, the fee leviable shall be reduced to 40% of the rates and shall be revised annually in accordance with the said rules.
