Detailed Summary

Under Section 30 read with sub-section (1) of Section 17 of the Regional Rural Banks Act, 1976 (21 of 1976), the Board of Directors of Bangiya Gramin Vikash Bank, after consultation with Punjab National Bank (Sponsor Bank) and the National Bank for Agriculture and Rural Development, and with the previous sanction of the Central Government, issued Notification No. BGVB/HO/HR/4637/2024-25 dated 9th September 2024, making the Bangiya Gramin Vikash Bank (Officers and Employees) Service (Amendment) Regulations, 2024, effective from the date of publication. The amendment modifies the Bangiya Gramin Vikash Bank (Officers & Employees) Service Regulations, 2010 (published in the Gazette of India, Part III, Section 4, dated 15th November 2010, notification No. 303, and previously amended by notification No. 293 dated 20th November 2013). Regulation 61(4) is substituted to allow accumulation of Privilege Leave up to a maximum of 270 days (except where leave applied for was refused), with encashment restricted to a maximum of 240 days. Regulation 67 is amended: the second proviso now references retirement under regulation 11; the third proviso is substituted to state that employees terminated due to retrenchment are eligible for payment equivalent to emoluments for accumulated privilege leave subject to regulation 61(4); and additional provisos are inserted covering voluntary retirement on or after 1 April 2018 (under regulation 27 of the Bangiya Gramin Vikash Bank (Employees') Pension Regulations, 2018), compulsory retirement including as a measure of punishment, and resignation or discontinuation of service under regulation 10(1), the latter limited to half of accumulated leave up to a maximum of 120 days. EXTRAORDINARY PART III—Section 4 PUBLISHED BY AUTHORITY No. 701] NEW DELHI, MONDAY , SEPTEMBER 9, 2024/BHADRA 18, 1946 CG-DL-E-11092024-257041 BANGIYA GRAMIN VIKASH BANK NOTIFICATIO N New Delhi , the 9 th September , 2024 No. BGVB/HO/HR/4637 /2024 -25.—In exercise of the powers conferred by Section 30 read with sub - section (1) of Section 17 of the Regional Rural Banks Act, 1976 (21 of 1976), the Board of Directors of Bangiya Gramin Vikash Bank after consultation with Punjab National Bank , being the Sponsor Bank and the National Bank for Agriculture and Rural Development and with the previous sanction of the Central Government, hereby makes the following regulations to further amend the Bangiya Gramin Vikash Bank (Officers & Employees) Service Regulations, 2010, namely: - 1. (1) These Regulations may be called Bangiya Gramin Vikash Bank (Officers and Employees) Service (Amendment) Regulations, 2024 (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Bangiya Gramin Vikash Bank (Officers & Employees) Service Regulations, 2010 (hereinafter referred to as said regulations), in the regulations 61 for sub -regulation (4), the following sub -regulation shall be substituted, namely: - "(4) Privilege Leave may be accumulated up to not more than 270 days, except where leave has been applied for and it has been refused: Provided that encashment of Privilege Leave shall be restricted up to a maximum of 240 days." 3. In the said regulations, in regulation 67, - (a) In second proviso, after the words "retires from the service of the Bank", the words "under the provisions of regulation 11" shall be inserted; (b) For third Proviso, the following proviso shall be substituted, namely: - "Provided also that in respect of the employee where his services are terminated owing to retrenchment, he shall be eligible to be paid a sum equivalent to the emoluments for the period of privilege leave he had accumulated subject to sub -regulation (4) of regulation 61." (c) After third proviso, the following provisos shall be inserted, namely, - "Provided also that where an officer or employee voluntarily retires from service on or after the 1st of April 2018, after giving due notice under sub - regulations (1) and (2) of regulation 27 of the Bangiya Gramin Vikash Bank (Employees’) Pension Regulations, 2018 , he shall be eligible to be paid a sum equivalent to the emoluments for the period of privilege leave he had accumulated, subject to sub -regulation (4) of regulation 61. Provided also that where an officer or employee has been compulsorily retired including as a measure of punishment, he shall be eligible to be paid a sum equivalent to the emoluments of any period, subject to sub -regulation (4) of regulation 61. Provided also that where an officer or employee leaves or discontinues from service or resigns under the provisions of sub -regulation (1) of regulation 10, he shall be eligible to be paid a sum equivalent to the emoluments in respect of privilege leave to the extent of half of such leave to his credit on the date of cessation of service, subject to a maximum of 120 days."
