                Detailed Summary
            

            
The Ministry of Road Transport and Highways, through S.O. 1234(E) dated March 6, 2025, has issued the Central Motor Vehicles (First Amendment) Rules, 2025, in exercise of powers conferred by section 27 of the Motor Vehicles Act, 1988 (59 of 1988). These rules amend the Central Motor Vehicles Rules, 1989, specifically by substituting sub-rule (1) of rule 129. The amendment mandates that drivers of two-wheeled motor cycles shall wear helmets conforming to specifications specified by the Bureau of Indian Standards and bearing the Indian Standards Institution mark. Exemptions are provided for persons who are Sikhs wearing turbans, and the provisions shall not apply to the State of Goa, or for drivers and pillion riders of two-wheeled motor cycles in the State of Meghalaya, as specified by their respective State Governments. This notification follows the publication of draft rules via G.S.R. 456(E) dated June 22, 2024, under sub-section (1) of section 212 of the Motor Vehicles Act, 1988, inviting objections and suggestions, which were subsequently considered by the Central Government.

NOTIFICATION
New Delhi, the 8th June, 2026

S.O. 2912(E).—Whereas by the notification of the Government of India in the Ministry of Road Transport
and Highways, S.O. 4130(E) Dated:11/09/2025 , published in the Gazette of India, Extraordinary, Part II, Section 3,
Sub-section (ii) issued under sub-section (1) of section 3A of the National Highway Act, 1956 (48 of 1956)
(hereinafter referred to as the said Act), the Central Government declared its intention to acquire the land specified in
the Schedule annexed to the said notification for Construction of bypass to Tiruvannamalai town branching at Km
135/550 to Km 157/550 of NH-38 Mangalore-Villupuram road (Km 135/550 - 145/600 (Section-A) and Km 155/200-
157/550 (Section-C)) in the district of TIRUVANNAMALAI in the state of TAMIL NADU.

And whereas the substance of the said notification has been published in "The Hindu” dated 09/10/2025 ,
"Dhina Thandi" dated 09/10/2025 ; under sub-section (3) of section 3A of the said Act;

And whereas the Competent Authority has received objections filed under Section 3-C, considered and
settled the same appropriately;

And whereas, in pursuance of sub-section (1) of section 3D of the said Act, the competent authority has
submitted its report to the Central Government;

Now, therefore, upon receipt of the said report of the competent authority and in exercise of the powers
conferred by the sub-section (1) of section 3D of the said Act, the Central Government hereby declares that the land
specified in the said Schedule should be acquired for the aforesaid purpose;

And further, in pursuance of sub-section (2) of section 3D of the Act, the Central Government hereby
declares that on publication of this notification in the Official Gazette, the land specified in the said Schedule shall
vest absolutely in the Central Government, free from all encumbrances.

NOTIFICATION

New Delhi, the 6th March, 2025

S.O. 1234(E).— Whereas the draft rules further to amend the Central Motor Vehicles Rules, 1989 were
published as required by sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988), in the
Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i), vide notification of the Government of
India in the Ministry of Road Transport and Highways number G.S.R. 456(E), dated the 22nd June, 2024,
inviting objections and suggestions from all persons likely to be affected thereby before the expiry of thirty
days from the date on which the copies of the said Gazette were made available to the public;

And whereas the copies of the said Gazette were made available to the public on the 22nd June, 2024;

And whereas the objections and suggestions received from the public in respect of the said draft rules have
been considered by the Central Government;

Now, therefore, in exercise of the powers conferred by section 27 of the Motor Vehicles Act, 1988 (59 of
1988), the Central Government hereby makes the following rules, namely:—

1.  **Short title and commencement.**— (1) These rules may be called the Central Motor Vehicles
    (First Amendment) Rules, 2025.
    (2) They shall come into force on the date of their final publication in the Official Gazette.

2.  In the Central Motor Vehicles Rules, 1989, in rule 129, for sub-rule (1), the following sub-rule
    shall be substituted, namely:—

    "(1) The driver of a two-wheeled motor cycle shall wear a helmet of such specifications as
    may be specified by the Bureau of Indian Standards and which shall bear the Indian Standards
    Institution mark:

    Provided that the provisions of this sub-rule shall not apply to a person who is a Sikh wearing a
    turban:

    Provided further that the provisions of this sub-rule shall not apply to the State of Goa, and for the
    drivers and pillion riders of two-wheeled motor cycles in the State of Meghalaya, as specified by
    the respective State Governments."
