L.-33004/99 The Gazette of India CG-DL-E-11032025-261558 EXTRAORDINARY PART II-Section 3-Sub-section (ii) PUBLISHED BY AUTHORITY No. 1119] NEW DELHI, TUESDAY, MARCH 11, 2025/PHALGUNA 20, 1946 MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 11th March, 2025 S.O. 1132(E).—Whereas by notification of the Government of India in the Ministry of Road Transport and Highways number S.O. 1192(E) dt. 03/12/2001 and number S.O. 465 (E) dated the 26th April, 2002 issued under Section 11 of the National Highway Authority of India Act 1988 (68 of 1988), the Central Government has entrusted the stretches from km 143.00 to km 160.00 (Gondal-Ribda section) and from Km. 0.00 to 143.00 and 160.00 to Km. 217.00 (Porbandar-Rajkot-Bamanbore Section) of National Highway no. 8B respectively in the State of Gujarat to the National Highways Authority of India referred to as the “Authority"); And whereas, the Authority was entered into an agreement with West Gujarat Expressway Limited, having its registered office at The IL&FS Financial Centre, Plot C-22, G-Block, Bandra Kurla Complex, Bandra East, Mumbai-400051 (hereinafter referred to as the “Concessionaire") for widening of the existing stretch from Km. 117.00 to Km. 143.00 (Jetpur-Gondal Section), and from Km. 175.00 to km. 185.00 (Rajkot bypass) from two lane to four lane and making improvement in the existing four lane stretch from km. 143.00 to km. 175.00 (Gondal-Rajkot Section), of the national highway number 8B (NH 8B) and Operation and Maintenance of the said section on BoT(Toll). And whereas, in exercise of the powers conferred by section 8A of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways (Collection of Fees by any Person for the user of Section of the National Highways/Permanent Bridge/Temporary Bridge on National Highways), Rules 1997, and rule 3 of the National Highways (Rate of Fee), Rules, 1997, and in supersession of the notification of the Government of India in the Minister of Shipping, Road Transport and Highways (Department of Road Transport and Highways) number S.O. 1725 (E), dated the 6th October, 2006, except as respects things done or omitted to be done such supersession the Central Government, by notification of the Government of India vide S.O. No. 1083(E), dated 05.05.2008, authorized Concessionaire for collect and retain fees on and from the date of Commercial operation or publication of this notification in the Official Gazette, whichever is later: and till the termination date. And whereas, the BoT (Toll) Concession Agreement was foreclosed on account of termination of BoT Concession Agreement by the Authority and Eventually, the said section has been taken over by Authority on 01.04.2022 from Concessionaire, after order of Hon'ble High Court of Delhi Dt. 30.03.2022, upon taken over the said section, NHAI is continuing the user fee collection as per provision of Concession Agreement/Fee Notification issued vide S.O. No. 1083(E), dated 05.05.2008. However, w.e.f. date of publication of this fee notification, NHAI shall collect user fee as per provisions under this fee notification, superseding the notification bearing No. S.O. 1083 (E) dated 05.05.2008. No user fee shall be levied for the delayed period between the Scheduled date of completion (910 days from the Appointed Date) and the date of actual completion of the project, if it is delayed. For the purposes of this rule, any provisional completion of the project shall not be treated as completion of the project. 4. The rate of monthly pass for a person who owns a mechanical vehicle registered for non- commercial purposes and resides within a distance of twenty kilometres from the fee plaza is Rs 340.000 (Three Hundred and Forty Only) for the year 2024-25 and is subject to revision every year as per the provisions of the said rules. 5. Fee for commercial vehicle (excluding vehicles plying under national permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles. 7. The driver or owner or a person in charge of a mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collecting agency, equal to the fee specified in sub-rule 1A of rule 10 of the said rules, and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle. 8. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road, etc., shall be as per definitions specified in the said rules. 9. The fee rates shall be displayed for information of the users in accordance with rules 12 of the said rules. 10. Based on the base rate of fee per kilometre for the base year 2007-2008 as mentioned in Table 1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of the completed length of the section and revised annually in accordance with the Rule 5 of the said rules and the same shall be published in at least one newspaper in English and vernacular language. 11. The estimated capital cost of the project is Rupees 1815.81 crore. The capital cost is subject to variation as the activities of land acquisition, utility shifting, tree cutting etc., are yet to be completed.
