Detailed Summary

The Ministry of Road Transport and Highways, via Notification S.O. 5069(E) dated 29th October, 2025, has levied and authorized the National Highways Authority of India (NHAI) to collect fees for the use of the four/six laning Bangalore - Nelamangala section, from Km. 10.000 to Km. 29.500, of National Highway No. 4 (New NH-48) in Karnataka. This action is taken under section 7 of the National Highways Act, 1956 (48 of 1956), read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 and its amendments, and supersedes Gazette notification number S.O. 2089 (E) dated 26th August, 2010. Previously, the Central Government had entrusted this stretch to NHAI under S.O. 78 (E) dated 04th February, 1999, issued under section 11 of the National Highways Authority of India Act, 1988 (68 of 1988). M/s Navayuga Bengalooru Tollway Private Limited was authorized to collect fees until their BOT (Toll) Concession Agreement was terminated by the Authority on February 21, 2021. The new fee structure specifies base rates per kilometer for the base year 2007-08, ranging from Rupees 0.65 for Cars to Rupees 4.20 for Oversized Vehicles (seven or more axles). Fees are payable at specific Fee Plazas in Bengaluru Urban and Rural districts for a net road section length of 15.131 Km and an equivalent structure length of 44.34 Km (structures exceeding 60m are multiplied by an equalisation factor of 10, including an Elevated Highway of 4.086 Km and a Flyover of 0.348 Km). Provision is made for multiple journey passes (two journeys within 24 hours for 1.5 times the one-way fee, or fifty journeys within one month for two-thirds of the fifty single journeys fee). Overloaded mechanical vehicles are liable to pay a fee per sub-rule 1A of rule 10 of the said rules and must remove excess load. All definitions are as per the said rules, and fee rates must be displayed per rule 12. The Authority will calculate actual fees and discounts annually based on completed section length and revise them per rule 5, publishing them in English and vernacular newspapers. The estimated capital cost of the project is Rupees 1455 Crore, with NHAI maintaining records of capital cost recovery through user fees.

And whereas, BOT (Toll) Concession Agreement was terminated by Authority on 21 February, 2021, thereby resulting in the foreclosure of the agreement. The driver or owner or a person in charge of a mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collecting agency, equal to the fee specified in sub-rule 1A of rule 10 of the said rules, and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle. 5. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road, etc. shall be as per definitions specified in the said rules. 6. The fee rates shall be displayed for information of the users in accordance with rule 12 of the said rules. 7. Based on the base rate of fee per kilometer for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper in English and vernacular language. 8. The estimated capital cost of the project is Rupees 1455 Crore. The capital cost is subject to variation as the activities of land acquisition, utility shifting, tree cutting, etc. are yet to be completed. The Authority shall maintain a record of the recovery of capital cost through user fee realised. [F.
