Ministry of Road Transport and Highways notification G.S.R. 556(E) dated 9 September 2024, issued under Section 9 of the National Highways Act, 1956 (48 of 1956), making the National Highways Fee (Determination of Rates and Collection) Amendment Rules, 2024, effective from the date of publication in the Official Gazette. It amends the National Highways Fee (Determination of Rates and Collection) Rules, 2008 (principal rules published vide G.S.R. 838(E) dated 5 December 2008, last amended vide G.S.R. 725(E) dated 6 October 2023): clause (da) and clause (hd) of sub-rule (1) of Rule 2 are amended to add collection through a Global Navigation Satellite System On-Board Unit or any such device, an Automatic Number Plate Recognition Device, FASTag, or any combination thereof; a new clause (he) is inserted defining a Global Navigation Satellite System On-Board Unit as a non-transferable, firmly fitted vehicle device linked to GNSS-based user fee collection; a new proviso is added to sub-rule (3) of Rule 6 permitting an exclusive lane for GNSS On-Board Unit-fitted vehicles, with vehicles entering the lane without a valid functional unit liable to a fee of twice the applicable user fee; and a new sub-rule (5) is inserted in Rule 9 providing a zero user fee for up to twenty kilometres of daily travel per direction under GNSS-based fee collection for non-National-Permit vehicles, with the actual distance charged beyond twenty kilometres. L. -33004/99 EXTRAORDINARY PART II —Section 3 —Sub-section ( i) PUBLISHED BY AUTHORITY No. 514] NEW DELHI , TUES DAY , SEPTEMBER 10, 2024/BHADRA 19, 1946 CG-DL-E-10092024-257024 MINISTR Y OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 9th September, 2024 G.S.R. 556(E). —In exercise of the powers conferred by section 9 of the National Highways Act, 1956 (48 of 1956), the Central Government hereby makes the following rules furthe r to amend the National Highways Fee (Determination of Rates and Collection) Rules, 2008, namely: - 1.- (1) These rules may be called the National Highways Fee (Determination of Rates and Collection) Amendment Rules, 2024. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the National Highways Fee (Determination of Rates and Collection) Rules, 2008 (hereinafter referred to as the said rules), in sub -rule (1) of rule 2, - (i) in clause (da) after the words “highway or expressway”, the following shall be inserted, namely: - “and collected through Global Navigation Satellite System On -Board Unit or any such device or Automatic Number Plate Recognition Device or FASTag or any combin ation thereof”; (ii) in clause (hd), after the words “user fees”, the following shall be inserted, namely: - “through Global Navigation Satellite System On -Board Unit or Automatic Number Plate Recognition Device or FASTag or any combination thereof”; (iii) after clause (hd), the following clause shall be inserted, namely :- ‘(he) “Global Navigation Satellite System On -Board Unit” means a non -transferable and firmly fitted device in a vehicle linked to Global Navigation Satellite System based user fee collect ion;’; 3. In rule 6 of the said rules, in sub -rule (3), after the second proviso, the following proviso shall be inserted, namely: - “Provided also that exclusive lane can be earmarked for Global Navigation Satellite System On-Board Unit fitted vehicle an d in case vehicle enters such lane, without a valid, functional Global Navigation Satellite System On -Board Unit, shall pay a fee equivalent to two times of the user fee applicable at that fee plaza:”. 4. In rule 9 of the said rules, after sub -rule (4), the following sub -rule shall be inserted, namely: - “(5) A driver, owner or person in -charge of a mechanical vehicle other than National Permit vehicle who makes use of the same section of national highway, permanent bridge, bypass or tunnel, as the case may be, shall be levied a zero -user fee upto twenty kilometers of journey in each direction in a day under Global Navigation Satellite System based user fee collection system and if the distance travelled is more than twenty kilometers, then fee will be ch arged for actual distance travelled.”.
