Dakshin Bihar Gramin Bank issued notification F. No. DBGB 1/2024 dated 1 August 2024, under Section 30 read with sub-section (1) of Section 17 of the Regional Rural Banks Act, 1976 (21 of 1976), whereby its Board of Directors, after consultation with sponsor bank Punjab National Bank and the National Bank for Agriculture and Rural Development (NABARD) and with the prior sanction of the Central Government, made the Dakshin Bihar Gramin Bank (Officers & Employees) Service (Amendment) Regulations, 2024, effective from the date of publication in the Official Gazette, amending the Dakshin Bihar Gramin Bank (Officers and Employees) Service Regulations, 2010; Regulation 61(4) is substituted to cap accumulation of Privilege Leave at 270 days (except where leave was applied for and refused) and restrict its encashment to a maximum of 240 days; Regulation 67 is amended: the second proviso is modified to reference "under the provisions of regulation 11"; the third proviso is substituted to entitle an employee whose service is terminated by retrenchment to payment equivalent to emoluments for the accumulated privilege leave period (subject to Regulation 61(4)); and new provisos are added entitling (i) an officer or employee who voluntarily retires on or after 1 April 2018 under sub-regulations (1) and (2) of Regulation 27 of the Dakshin Bihar Gramin Bank (Employees') Pension Regulations, 2018, (ii) an officer or employee compulsorily retired, including as a measure of punishment, and (iii) an officer or employee who resigns or discontinues service under sub-regulation (1) of Regulation 10, to payment equivalent to emoluments for accumulated privilege leave, subject to Regulation 61(4), with the resignation case capped at half of the accumulated leave up to a maximum of 120 days; the notification is signed by Ashutosh Kumar Jha, Chairman, under advertisement reference ADVT.-III/4/Exty./365/2024-25, and notes that the 2010 principal Regulations were originally published in the Gazette of India, Part III, Section 4, dated 19 July 2019.

No. DBGB 1/2024. In exercise of the powers conferred by Section 30 read with sub-section (1) of Section 17 of the Regional Rural Banks Act, 1976 (21 of 1976), the Board of Directors of Dakshin Bihar Gramin Bank after consultation with Punjab National Bank, being the Sponsor Bank and the National Bank for Agriculture and Rural Development and with the previous sanction of the Central Government, hereby makes the following regulations to further amend the Dakshin Bihar Gramin Bank (Officers & Employees) Service Regulations, 2010, namely:- 1. (1) These Regulations may be called Dakshin Bihar Gramin Bank (Officers & Employees) Service (Amendment) Regulations,2024. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Dakshin Bihar Gramin Bank (Officers and Employees) Service Regulations, 2010 (hereinafter referred to as said regulations), in the regulations 61 for sub-regulation (4), the following sub-regulation shall be substituted, namely:- "(4) Privilege Leave may be accumulated up to not more than 270 days, except where leave has been applied for and it has been refused: Provided that encashment of Privilege Leave shall be restricted up to a maximum of 240 days." 3. In the said regulations, in regulation 67,- (a)In second proviso, after the words "retires from the service of the Bank", the words "under the provisions of regulation 11" shall be inserted; (b) For third Proviso, the following proviso shall be substituted, namely:- "Provided also that in respect of the employee where his services are terminated owing to retrenchment, he shall be eligible to be paid a sum equivalent to the emoluments for the period of privilege leave he had accumulated subject to sub-regulation(4) of regulation 61." (c) After third proviso, the following provisos shall be inserted, namely,- "Provided also that where an officer or employee voluntarily retires from service on or after the 1stof April 2018, after giving due notice under sub- regulations (1) and (2) of regulation 27 of the Dakshin Bihar Gramin Bank (Employees') Pension Regulations, 2018, he shall be eligible to be paid a sum equivalent to the emoluments for the period of privilege leave he had accumulated, subject to sub-regulation (4) of regulation 61. Provided also that where an officer or employee has been compulsorily retired including as a measure of punishment, he shall be eligible to be paid a sum equivalent to the emoluments of any period, subject to sub-regulation (4) of regulation 61. Provided also that where an officer or employee leaves or discontinues from service or resigns under the provisions of sub-regulation (1) of regulation 10, he shall be eligible to be paid a sum equivalent to the emoluments in respect of privilege leave to the extent of half of such leave to his credit on the date of cessation of service, subject to a maximum of 120 days."
