                Detailed Summary
            

            
The Ministry of Petroleum and Natural Gas, through notification S.O. 3004(E) dated 6th July, 2023, declared under sub-section (1) of section 6 of the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962) that the right of user in land specified in the Schedule (villages Dohka Dina, Dudiwala Nandkaran, Dudiwala Kishanpura, Rampura, Sarangpur, and Narsingwas in Tehsil Dadri, Charkhi Dadri District, Haryana) is acquired for laying a pipeline from Chudva to Panipat under the New Mundra-Panipat Pipeline Project, following the Central Government's earlier declaration of intention published as S.O. 5979(E) dated 14th December, 2022 (Gazette No. 5741 dated 21st December, 2022) and a report submitted by the Competent Authority under sub-section (1) of section 6; under sub-section (4) of section 6, the right of user vests, free from encumbrances, in Indian Oil Corporation Limited, which is made exclusively liable for compensation under Section 10 of the Act; the order was issued under file number R-11017/6/2022-OR-II/E-45116 and signed by P. NOTIFICATION
New Delhi, the 6th July, 2023
S.O. 3004(E).—Whereas, by the notification of the Government of India in the Ministry of Petroleum and
Natural Gas, published in the Gazette of India No. 5741, Part -II, Secti on-3, Sub Section(ii) dated 21st  December, 2022
vide S.O. No.5979 (E), dated 14th  December, 2022, issued under sub -section (1) of section 3 of the Petroleum and
Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962), (hereinafte r referred to as the said
Act), the Central Government declared its intention to acquire the right of user in the land specified in the Schedule
appended to that notification for the purpose of laying of Pipeline from Chudva to Panipat under New Mundra -
Panipat Pipeline Project by Indian Oil Corporation Limited in Tehsil -Dadri of Charkhi dadri District in the State of
Haryana for transportation of Crude Oil.
And whereas copies of the said Gazette notification were made available to the public, And whereas  the
Competent Authority has under sub -section (1) of section 6 of the said Act, has submitted re port to the Central
Government.
And whereas the Central Government, after considering the said report and on being satisfied that the said
land is required for  laying the pipeline, has decided to  acquire right of user therein.
Now, therefore, in exercise of the powers conferred by sub -section (1) of section 6 of the said Act, the
Central Government hereby declares that the right of user in the land specified in the Schedule appended to this
notification is hereby acquired for laying the pipeline;

And further, in exercise of the powers conferred by sub -section (4) of section 6 of the said Act, the Central
Government hereby directs that the right of user in the sai d land for laying the pipeline shall, instead of vesting in the
Central Government, vest on the date of publication of the declaration, in Indian Oil Corporation Limit ed, free from
all encumbrances.
Indian Oil Corporation Limited shall be exclusively liabl e for any compensation in terms of Section 10 of the
P&MP Act, 1962 and no suit, claim or legal proceeding would lie against the Central Government on any matter
relating to the pipeline.
