O. No. 992(E), dated 28.02.2023 Part -II,Section - 3,Sub -Section (ii) issued under sub -section (1) of section 3 of the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962), (Here in after referred to as the said Act) the Central Government declared its intention to acquire the r ight of user in the land situated in Tehsil Jhansi District Jhansi in UP State, specified in the schedule appended to th at notification for the purpose of laying pipeline for the transportation of LPG from Kandla to Gorakhpur by the IHB Ltd for implementin g the Kandla to Gorakhpur LPG Pipeline Project. And whereas the copies of the said Gazette notification were made availa ble to the public by 21 March 2023. And whereas Shri Madan Chandra Dubey, the Competent Authority (U.P.) has under sub -section (1) of se ction 6 of the said Act, has submitted his report to Central Government. And whereas, the Central Government after Consi dering the said report and on being satisfied that the said land is required for laying the pipeline, has decided to acquire right of th e user therein; Now, therefore, in exercise of the powers conferred by sub -section (1) of section 6 of the said Act, the Central Government hereby declares that the right of user in the land specified in the Schedule appended to this notification is hereby acquired for laying the pipeline; And further, in exercise of the powers conferred by sub -section (4) of section 6 of t he said Act, the Central Government hereby directs that the right of user of the said land for laying the pipeline shall, instead of ves ting in the Central Government, vests on the date of publication of this declaration in IHB Ltd, free from all encumbran ces. IHB Ltd shall be exclusively liable for any compensation in terms of section 10 of the P&MP Act, 1962 and no suit, claim or legal p roceeding would lie against the Central Government on any matter relating to pipeline.
