MINISTRY OF PETROLEUM AND NATURAL GAS
NOTIFICATION
New Delhi, the 6th July, 2023
S.O. 3022( E).— Whereas by the notification of The Government of India in the Ministry of Petroleum and
Natural Gas, Published in th e Gazette No 955 dated 02.03.2023, S.O. No. 993(E) dated 28.02.2023 Part -II,Section -
3,Sub -Section (ii) issued under sub -section (1) of section 3 of the Petroleum and minerals pipelines (Acquisition of
Right of User in Land) Act, 1962 (50 of 1962), (Her einafter referred to as the said Act), the Central Government
declared its intention to acquire the right of user in the land situated in Tehsil Bhognipur & Akbarpur, District Kanpur
Dehat in Uttar Pradesh State, specified in the schedule appended to that notification for the purpose of laying pipeline
for the transportation of LPG from Kandla to Gorakhpur by the IHB Ltd for implementing the Kandla to Gorakhpur
LPG Pipeline Project.
And whereas the copies of the said Gazette notification were made available to the public on 20 March 2023.
And whereas Shri Somdatt Maurya, Competent Authority, IHB Limited, Kandla Gorakhpur LPG Pipeline
Project, Kanpur (UP) has under sub -section (1) of section 6 of the said Act, has submitted his report to Central
Government.
And whereas, the Central Government after Considering the said report and on being satisfied that the said
land is required for laying the pipeline, has decided to acquire right of the user therein;
Now, therefore, in e xercise of the powers conferred by sub -section (1) of section 6 of the said Act, the
Central Government hereby declares that the right of user in the land specified in the Schedule appended to this
notification is hereby acquired for laying the pipeline;
And further, in exercise of the powers conferred by sub -section (4) of section 6 of the said Act, the Central
Government hereby directs that the right of user of the said land for laying the pipeline s hall, instead of vesting in the
Central Government, vests on the date of publication of this declaration, in IHB Ltd, free from all encumbrances.
IHB Ltd shall be exclusively liable for any compensation in terms of section 10 of the P & MP Act, 1962 and
no suit, claim or legal proceeding would lie against the Central Government on any matter relating to pipeline.
