                Detailed Summary
            

            
The Ministry of Petroleum and Natural Gas, by notification S.O. 3003(E) dated 6th July 2023, records that following its earlier notification S.O. 5977(E) dated 14th December 2022 declaring intention under sub-section (1) of section 3 of the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962) to acquire right of user in land for laying a pipeline from Chudva to Panipat under the New Mundra-Panipat Pipeline Project by Indian Oil Corporation Limited in Tehsil Loharu, Bhiwani District, Haryana, for transportation of crude oil, and after the Competent Authority submitted its report under sub-section (1) of section 6, the Central Government, in exercise of powers under sub-section (1) of section 6, declares the right of user in the scheduled land acquired for laying the pipeline, and under sub-section (4) of section 6, directs that the right of user shall vest not in the Central Government but in Indian Oil Corporation Limited, free from all encumbrances, from the date of publication; Indian Oil Corporation Limited is stated to be exclusively liable for compensation under Section 10 of the Act, with no suit lying against the Central Government. The Schedule lists numerous survey/mustil numbers and areas across the villages of Loharu, Jhumpa Kalan, Jhumpa Khurd, Basirwas and Barwas in Loharu Tehsil, Bhiwani District, Haryana. The notification is signed by P. NOTIFICAT ION
New Delhi, the 6th July, 2023
S.O. 3003(E).—Whereas, by the notification of the Government of India in the Ministry of Petroleum and
Natu ral Gas, published in the Gazette of Indi a No. 5739, Part -II, Section -3, Sub Section(ii) dated 21st  December, 2022
vide S.O. No.5977 (E), dated 14th  December, 2022, issued under sub -section (1) of section 3 of the Petroleum and
Minerals Pipelines (Acquis ition of Right of User in Land) Act, 1962 (50 of 1962), (hereinafter referred to as the said
Act), the Central Government declared its intention to a cquire the right of user in the land specified in the Schedule
appended to that notification for the purpos e of laying of Pipeline from Chudva to Panipat under New Mundra -
Panipat Pipeline Project by Indian Oil Corporation Limited in Tehsil -Loharu of Bhiw ani District in the State of
Haryana for transportation of Crude Oil.
And whereas copies of the said Gazet te notification were made available to the public, And whereas the
Competent Authority has under sub -section (1) of section 6 of the said Act, has su bmitted report to the Central
Government.
And whereas the Central Government, after considering the said re port and on being satisfied that the said
land is required for laying the pipeline, has decided to acquire right of user therein.
Now, therefore, in exercise of the powers conferred by sub -section (1) of section 6 of the said Act, the
Central Government he reby declares that the right of user in the land specified in the Schedule appended to this
notification is hereby acquired for laying the pipeline;

And further, in exercise of the powers conferred by sub -section (4) of section 6 of the said Act, the Centr al
Government hereby directs that the right of user in the said land for laying the pipeline shall, instead of vesting in the
Central Government, ves t on the date of publication of the declaration, in Indian Oil Corporation Limited, free from
all encumbran ces.
Indian Oil Corporation Limited shall be exclusively liable for any compensation in terms of Section 10 of the
P&MP Act, 1962 and no suit, claim or legal proceeding would lie against the Central Government on any matter
relating to the pipeline.
