Detailed Summary

The Ministry of Road Transport and Highways, through Notification S.O. 3024(E) dated July 4, 2025, in exercise of powers conferred by Section 7 of the National Highways Act, 1956 (48 of 1956), read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008, has levied user fees. This notification supersedes existing user fee notifications, including S.O. 716(E) and 717(E) dated August 21, 1998, and their amendments, which were last amended by S.O. 225(E) and 224 dated January 8, 2018. This action follows the Central Government entrusting the stretch from Salem to the Tamil Nadu/Kerala border section of NH 544 to the National Highways Authority of India (the Authority) via Notification S.O. 1883(E) dated April 25, 2025, issued under Section 11 of the National Highways Authority of India Act, 1988 (68 of 1988). The fee is levied for the Neelambur to Walayar section from Km 144.680 to Km 183.010 of National Highway no. 544 in Tamil Nadu, with the Authority authorized to collect it at the Fee Plaza located at Km 170.275 of NH 544 (existing Chainage at Km 167.100 of Old NH 47) in Madukkarai Village, Coimbatore District, Tamil Nadu State. Specific base rates per kilometer for the base year 2007-08 are detailed in Table 1 for various vehicle types, ranging from Rs. 0.65 for Car/Jeep/Van/Light Motor Vehicle to Rs. 4.20 for Over Sized Vehicles (seven or more axles). The fee structure includes 100% of base rates for 8.910 Km of four or more lane use, an additional 90% of the base rate for the 26.135 Km Coimbatore bypass (costing Rs. 104.40 Crore) for two-lane use with paved shoulders, and 150% of the base rate for the 3.220 Km KG Chavadi Bypass (costing Rs. 63.02 Crore) for four or more lane use. A 60% base rate applies to an equivalent road length of 0.645 Km for structures exceeding 60m (specifically a 0.0645 Km Major Bridge). A monthly pass for non-commercial vehicles registered within 20 kilometers of the toll plaza is set at Rs. 350/- for FY 2025-26, subject to annual revision. Provisions for multiple journey passes, a 50% fee for commercial vehicles registered in the district (if no service/alternate road), and liability for overloaded vehicles as per Rule 10(1A) are also included. The capital cost of the project length is Rs. 430.71 Crores. Fee rates will be displayed as per Rule 12 and revised annually by the Authority based on Rule 5, with publication in English and vernacular newspapers. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza shall be 50% of the specified rate for that category of vehicle provided no service road or alternate road is available for use of such commercial vehicles. 7. The driver or owner or a person in charge of a mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the over loaded vehicle on the National Highway to the fee collecting agency, equal to the fee specified in sub-rule 1A of rule 10 of the said rules, and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle. 8. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the Rules. 9. The fee rates shall be displayed for information of the users in accordance with rules 12 of the said Rules. 10. Based on the Base rate of fee per km for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspapers in English and vernacular language. 11. The capital cost of the project length is Rupees 430.71 Crores. The Authority shall maintain a record of the capital cost through user fee realised. [F.
