The Ministry of Commerce and Industry, Department of Commerce, Directorate General of Foreign Trade, vide Notification No. 68/2023 and S.O. 1129(E) dated 7th March 2024, in exercise of powers under Sections 3 and 5 of the Foreign Trade (Development & Regulation) Act, 1992 read with paragraphs 1.02 and 2.01 of the Foreign Trade Policy 2023, amends Import Policy Condition No. 06(b) of Chapter 27 of Schedule-I (Import Policy) of ITC (HS) 2022, revising the permissible import quantities: total import of Raw Petroleum Coke (RPC) for manufacturing Calcined Petroleum Coke (CPC) is capped at 1.9 Million Metric Tonnes and CPC import for the Aluminium Industry at 0.5 Million Metric Tonnes during 2024-25, rising to 1.9 Million Metric Tonnes RPC and 0.8 Million Metric Tonnes CPC from 2025-26 onwards, subject to conditions including that RPC/CPC be used only as feedstock/raw material and not as fuel, imports be on Actual User basis with no transfer to other units including SEZ units, no export of Anode by the Aluminium Industry, and processing capacity as on 14th February 2024 (the date of the Commission for Air Quality Management in NCR and Adjoining Areas Order No. 160014/16/2021-MERD/PetCoke-35) to be used for pro-rata allocations; the change implements CAQM's recommendations from its Order dated 14th February 2024 and was approved by the Minister of Commerce & Industry; the notification bears reference No. 01/89/180/22/AM-23/PC-2(A)/E-38642 and is signed by Santosh Kumar Sarangi, Director General of Foreign Trade and Ex-officio Additional Secretary.

Import of CPC by Aluminium Industry shall be on Actual User basis. Export of Anode by Aluminium Industry shall not be permitted. | | v. The RPC/CPC Processing capacity as on the date of the CAQM Order i.e. 14.02.2024 shall be taken on record for any pro-rata allocations. | | vi. All other conditions as mentioned in the Commission for Air Quality Management in NCR & Adjoining Areas Order No-F. No. 160014/16/2021-MERD/PetCoke-35 dated 14.02.2024 should also be complied with.
