The Ministry of Commerce & Industry, Department for Promotion of Industry and Internal Trade, issued Order S.O. 1152(E) dated 6th March 2024. In exercise of powers conferred by section 16 of the Bureau of Indian Standards Act, 2016 (11 of 2016), and after consulting the Bureau of Indian Standards (BIS), the Central Government makes the "Asbestos or Fibre Cement based Products (Quality Control) Order, 2024," which comes into force on expiry of six months from the date of publication. The Order requires goods and articles listed in the Table to conform to the corresponding Indian Standard and bear the Standard Mark under a licence from BIS as per Scheme-I of Schedule-II to the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018, with exemptions for goods manufactured domestically for export, for small enterprises (as defined under clause (m) of section 2 of the Micro, Small and Medium Enterprises Development Act, 2006 (27 of 2006)) until nine months from publication, and for micro enterprises (clause (h) of section 2 of the same Act) until twelve months from publication. BIS is designated the certifying and enforcing authority, with contravention punishable under the BIS Act, 2016. The Table lists eleven applicable Indian Standards, including IS 459:1992 (Corrugated and Semi-Corrugated Asbestos Cement Sheets), IS 1592:2003 (Asbestos Cement Pressure Pipes and Joints), IS 2096:1992 (Asbestos Cement Flat Sheets), IS 2098:1997 (Asbestos Cement Building Boards), IS 6908:1991, IS 13000:1990, IS 8870:1978, IS 9627:1980, IS 13008:1990, IS 14862:2000 and IS 14871:2000. In exercise of the powers conferred by section 16 of the Bureau of Indian Standards Act, 2016 (11 of 2016), the Central Government, after consulting the Bureau of Indian Standards, is of the opinion that it is necessary and expedient so to do in the public interest, hereby makes the following Order, namely:- 1. Short title and commencement.—(1) This Order may be called the Asbestos or Fibre Cement based Products (Quality Control) Order, 2024. (2) It shall come into force on the expiry of six month from the date of publication of this notification in the Official Gazette. 3 2. Compulsory use of Standard Mark.—Goods or articles specified in column (1) of the Table shall conform to the corresponding Indian Standard specified in column (2) of the Table and shall bear the Standard Mark under a licence from the Bureau of Indian Standards as per Scheme-I of Schedule-II to the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018: Provided that nothing in this Order shall apply to goods or articles manufactured domestically meant for export: Provided further that nothing in this order shall apply to small enterprises, as defined under clause (m) of section 2 of the Micro, Small and Medium Enterprises Development Act, 2006 (27 of 2006), till the expiry of nine month from the date of publication of this notification: Provided also that nothing in this order shall apply to micro enterprises, as defined under clause (h) of section 2 of the Micro, Small and Medium Enterprises Development Act, 2006 (27 of 2006), till the expiry of twelve month from the date of publication of this notification: 3. Certification and enforcement authority—The Bureau of Indian Standards shall be the certifying and enforcing authority for the goods or articles specified in the Table. 4. Penalty for contravention—Any person who contravenes any of the provisions of this Order shall be punishable under the provisions of the Bureau of Indian Standards Act, 2016.
